  • Were you exposed to asbestos fibers during your service? Although it's no longer used, asbestos was once commonly found in old buildings and on construction sites. If you were exposed to asbestos fibers, you likely have respiratory issues as a result of inhaling the fibers.
Join us as Dale Davidson, Veteran Affairs Attorney, explains the presumptive conditions defined by the VA for asbestos exposure. He'll explain how you can qualify for benefits if you were exposed during your military service.

I was temporarily assigned, trained, and certified as a asbestos inspector / management planner / microscopical analysis in which I took samples of construction materials from about 5000 buildings at a large air force base. Nearly every building on base had asbestos. The base housing had asbestos siding. When the troops mowed their lawns, the mowers would chip off pieces of asbestos siding. The kids in the neighborhood used the broken pieces to draw hopscotch on the sidewalks.
We had open areas inside the shops where they cut bricks of highly refined asbestos for aircraft parts. Plumes of dust covered everything.

I had chemical exposures in service, burn pit at a dump as well as Asbestos exposure on a ship plus burying it at a landfill, so I need to look into this as I have these symptoms.

All navy ships had asbestos. In navy vessels do not matter what you did, the asbestos dispersed throughout the ship by the ventilation system. Only One ventilation system on ships do exists, goes everywhere. Served in nine surface vessels and two submarines.

If you were stationed at military bases the US occupied after WWII it is guaranteed that every building had all kinds of construction materials containing asbestos. even the textured coatings on walls and ceilings contained asbestos and were applied to wall board the contained asbestos. The US military had no poicy for the removal of asbestos until the late 1980s. On domestic bases any building put uo prior to 1970 likely contains asbestos

I was in the Navy Seabees (Construction) we rehabilitated several marine barracks built in the 40s at Atsugi, Japan. the ceilings we tore down were asbestos and in 1972-1976 we were not aware of the fibers and problems so no masks were worn.

If there's symptoms listed on an exit physical (1976) like wheezing, fainting, coughing up blood, cough but currently no dx for anything other than cough and wheezing, has been prescribed allbuterol for years, does there need to be a "diagnosis" for asthma or anything specific ICD CODE.? I did find a note about lung calcification.

I was in the infantry. But when I was “deployed” to Camp Aachen, Germany there were notices on our barracks that said our buildings had asbestos in the ceiling/ roof but it was fine because there were plastic insulating panels between us and the asbestos. However in multiple locations there were holes and gashes in the plastic panels. Even though we weren’t disturbing it do you think I may still have a claim?

Yes, yoiu will have to prove nexus. The signs and barracks are long gone so you may have to contact some of your buddies and get statements from them.

If you have PFT diminished markers or a chest CT scan indicating damaged lungs and especially lower DLCO predicted value, you should.

I was diagnosed with plural placking in my lungs . I was exposed to asbestos while in the navy in 76,77,78. All this is documented. I have file a claim with the VA.
Can you let me know what to expect in the future? My doctor suggested I start this claim. He wrote me a nexus letter also

@@davidsonlawoffices Man, u said it! Any potential terminal condition regardless of the weight of the evidence is getting the merry-go- round treatment. Especially if it has something to do with a married veteran who would be entitled to DIC. The VA will stonewall the hell out of future liability claims after the veteran is long dead.

I'm service connected for asbestosis at zero percent. I believe the only way you get compensated is if you need oxygen therapy or have cancer. I hope I never received a dime for it..

  • @teaaet1

So how would or should the VA deem USAF veterans who were removed from their military trained jobs and placed forcibly on ASBESTOS abatement teams with documented evidence? I've been told we can't get it bcs not technically a military titled job - seems like the VA should consider this an atypical form of service connection, but stonewalled and given any other non-asbestos related respiratory disease (bronchitis, bronchiectasis). Seems like it's VA avoidance protocol at all cost. Been diagnosed with pulmonary fibrosis (scarring of the lungs) but NOT called asbestosis by private doctors (seems like a cover up ongoing) despite the strong evidence of exposure. Life long non-smoker with negative blood test validated cystic fibrosis alpha-1 marker.

The key is did the injury/exposure occur during service?

    • @teaaet1
      @teaaet1 9 місяців тому

@@davidsonlawoffices Absolutely. I have an accident report from the base hospital explaining what happened sir. 4 PFT test from my C-File file that somehow have been altered (had written in) in predicted recorded % readings in the 90 and above threshold, that were originally low 80 percentage. Additionally with the passage of the Gramm Rudman Bill and the laws mandating removal of asbestos from all federal properties, the USAF formed long term asbestos abatement (different at each MAJCOM) teams to meet the requirement - unfortunately completed on a frugal budget.

Not "technically" a military job but happened during your service so I am not understanding the VA's BS argument. Sounds like an appeal to me.

But it's emphysema related to asbestos? I thought emphysema plays out primarily in the upper portion of the lungs, wherein asbestos is most notable in the lower lobes of the lungs.

@@davidsonlawoffices This list is not comprehensive at all. My ship - the USS Kitty Hawk (CV-63) - utilized asbestos heavily and we removed it by hand during shipyard repairs and refitting. Every aircraft carrier in the same class (built around the same period) also had asbestos installed. The Navy sued asbestos extensively on nearly all ships built before the 1970s.
