There's a counter-story here. Garrett made a fair tackle on the QB who then made an immediate attempt to rip his helmet off (that was the initiation and first penalty which should be on the QB). This made Garret upset and he responded tit-for-tat by actually pulling the helmet off the QB (it seems the official threw his flag at this point for that). Then both the QB and 2 other Steelers continued to advance on Garrett and while backpedaling he swung the helmet in self defense. He was then aggressively tackled and unnecessarily struck by blows (both fists and feet) from one of the other 2 players, which is definitely an unnecessary assault. Seems like a weak case but again he wasn't the initiator of what should have been the first penalty (unless the tackle itself is deemed a penalty) and was immediately accosted 3 on 1. You can make the point that on the streets the helmet swing would be assault with a weapon but if 3 guys jump you on the street then perhaps you actually have the right to defend yourself with such a weapon.

There's a counter-story here. Garrett made a fair tackle on the QB who then made an immediate attempt to rip his helmet off (that was the initiation and first penalty which should be on the QB). This made Garret upset and he responded tit-for-tat by actually pulling the helmet off the QB (it seems the official threw his flag at this point for that). Then both the QB and 2 other Steelers continued to advance on Garrett and while backpedaling he swung the helmet in self defense. He was then aggressively tackled and unnecessarily struck by blows (both fists and feet) from one of the other 2 players, which is definitely an unnecessary assault. Seems like a weak case but again he wasn't the initiator of what should have been the first penalty (unless the tackle itself is deemed a penalty) and was immediately accosted 3 on 1. You can make the point that on the streets the helmet swing would be assault with a weapon but if 3 guys jump you on the street then perhaps you actually have the right to defend yourself with such a weapon.
