It's so discouraging hearing about the laws but also very good to hear. Here in Finland, I hate the fact that when you register your business even tho u haven't opened yet, if u already register your business, big taxes will come on you already😢
As a new pod shop that is barely making any money, I would go into the negative if I purchased insurance. I am only selling t-shirts and crewneck sweatshirts. How on earth could anyone injure themselves with those items 😒. It’s just so discouraging to hear this. People are so sue happy that it makes me afraid to have a tiny Etsy shop selling items no person could possibly injure themselves with.
I completely understand where you're coming from, and it can feel really overwhelming when you're just starting out. It does seem unlikely that someone could get hurt by a t-shirt or sweatshirt, but I think it’s more about covering those unexpected "what ifs." While many sellers opt to wait until their shop is more established before investing in insurance, others feel peace of mind having it from the get-go so it's completely up to you & you business. From my personal experience, admittedly, I didn't look into business insurance until a few years in. Luckily I haven't had any problems but looking back I wish I got it when I started seeing profit to cover the expense per month. It’s a tough call, especially when you’re trying to keep costs down. Hang in there! You’re taking steps to learn and protect your business, which is already a win. 💪 Keep going, you’ve got this! 🌟
@@itsheatherstudioThanks, that is good advice. I’m not opposed to having it once I start seeing more and consistent sales. As usual, thanks for the video. It is a topic I’ve been wondering about for a while. I am one of the people that brought up POD candles in one of your older videos, as before POD, I was aspiring to sell my candles, but decided it was too risky. POD, clothing anyway, seems way less risky!
This video was helpful but also a little scary. I feel like I should close down my shop lol. I only sell shirts and sweatshirts, but there are so many legal things to consider. Is it legal to sell products with people’s designs from Etsy? A lot of the designs I sell are designs I purchased directly from Etsy that said commercial use for POD.
If you're based in the US, then you wouldn't need any other license to start selling on the platform to my knowledge and from what I learned from Michelle in our interview. If your business is already registered though(such as through a DBA or LLC) then your already ahead of most business registration of the average Etsy seller. I personally opened my shop and started right away, then registered a 'Assumed Business Name/Doing Business As' document in my county and then got my LLC a few months later. This is my experience and I should have registered first, but, alas, this is the route many sellers take like myself. If you talk to a lawyer, this is not the right route to take by any means, but just my experience to share here that most states and counties allow you to register after starting too that I'd mention for those sellers who were like me and did the process 'backwards'. In my state, they required to file within a year of opening shop though - this could be different per state and county. Again, I have to say I am not a legal professional and laws always change, which is why it's good to talk to a lawyer or get some guidance always before starting. With this all being said, there are two optional things you'd want to look into but they are not 'necessary' to sell on Etsy. You would want to look into a resale certificate for tax exemption (this is usually a form you fill out with your POD company and I'll link the video about this below) and/or business insurance but neither are necessary to start selling on Etsy. By no means am I a legal expert to give advice and I can only share my experience here but that's why I interviewed Michelle since she gives the better process to go about what you need to sell on Etsy.
Hello Heather, I have had to unfortunately close down both my accounts on Printify and Etsy. This is because some confusion with multiple emails and a change of shop name. However, I am in the process of opening a new shop under a different email address I have but now it is charging me £11.00 which is $15US. Why is this? It never charged me for my first shop that I opened. Thanks, Andrew.
Hi Andrew, sorry to hear about all the difficulty with the new shop! Etsy recently changed their new shop creation portal this year for the $15 to $30 fee for their new verification and onboarding.
I can't answer this question besides sharing my own experience(I have to say this since I'm not a legal professional) but I can say from experience that I had to register a new DBA for my different Etsy shop names. I would always suggest contacting an attorney in your area about this in the case it's different in your state. It is a 'state-by-state' difference too so it's still good to contact a professional in your area. I'll be asking Michelle to come back next year to ask this as well!

SOOOO needed, thanks Heather!
Thanks so much for interviewing Michelle🧡
Thanks so much Heather for bringing up these topics. You’re the only POD guru I’ve heard mention that people need licenses/DBAs etc. Much appreciated.

I have a LLC and a business license, so I need another license to sell on Etsy?

If I have a licensed business on Etsy and want to open another shop do I have to register that also as a DBA?
That's what I would like to know, too. I have 3 shops.
