  • The PS5 - the newest console in the latest generation of gaming. It's been highly sought after - but for more reasons than one. The pandemic has meant there's been a higher demand for electronics, and a chip shortage has caused a lower supply of consoles. So, in come the scalpers - people who use bots to monitor and buy up rare items, before reselling them at a higher price. Though completely legal in practice, it's very unpopular - but not everyone practices it for greed.

      @Mr10Residentevilfan That's because the Copyright, Designs and Patents Act 1988 says it is an infringing act to reproduce literary, dramatic, musical or artistic work in any material form, including storing it in any medium by electronic means.
      Reselling a physical product that you have purchased and therefore own, is not comparable.

      @@jacobhenderson5499 scalping is fraud. Many successful prosecutions in the UK support this long before ticket scalping was specifically prohibited in the UK. There’s also a bill making it’s way through the commons to make product scalping illegal too.

Scalping is the act of someone purchasing an item, it then becomes theirs, and they decide to sell it for an advertised price, there's nothing illegal about that lmao

    Been after a PS5 from day one, never was able to get one, and now it's been almost 2 years I'm longer interested and I'm not gonna ever pay scalper for rip off prices.

      That is not true at all, once someone buys a multi-pack it is their product and they can split and sell the product however they like. If the manufacturer doesn’t like it then they MAY CHOOSE not to sell their product to him in the future. Please do your research before commenting something like this, it's hardly comparable.

    It's the idea in a chip shortage, so many devices are just wasting away in a garage somewhere basically waiting for a ransom to be paid. Scalping should definitely be illegal for that reason and it violates warranty and liability.

      @@jacobhenderson5499 firstly it’s not 100% legal to use bots to deceive the retailers. There is legal precedent here, it’s fraudulent and deceptive. They’re risking imprisonment and bankruptcy.
      Secondly scalping voids warranties/guarantees and denies the consumer the option to insure their product to which they’re legally entitled. Scalpers don’t honour warranties and manufacturers will often say there is no warranty claim as only the original purchaser has a warranty.
      Thirdly, the thought process which concludes scalping is acceptable (and also the thought process for your comment) is no different to those groups of awful people you mentioned. Those people take from their victims with absolutely no regard for anyone else as does the scalper.
      Your need/want argument is severely floored and is at best clutching at straws. It also works the other way. Scalping is a want not a need. There’s plenty of worthwhile jobs for scalpers, like flipping burgers and stacking supermarket shelves.

      @@jacobhenderson5499 it’s not legal to circumvent protections retailers have put in place to prevent scalping if that involves using fake names and addresses and credit cards that don’t belong to you.
      The need/want argument is floored. You don’t need a device which allows you to post comments on UA-cam. Scalpers don’t need to scalp in order to live when there’s universal credit. Are you really such a narcissist to think that you get to decide what are needs and wants?

      @@dwayne_dibley 1) not all scalpers use bots, a lot of them can do it manually and very effectively, if bots became illegal, scalping would still exist, but currently it's not, and the MP who tried to put the bill through had it rejected.
      2) Warranties are void to a certain extent but again, this is not illegal - customers are made completely aware of this by eBay before purchasing, plus the 1 year manufacturers warranty on playstation 5 consoles is completely transferrable to the next recipient.
      3) Again, I don't really understand at what point these people become "victims" - I'd only argue this was the case if someone was buying up a necessity, for example what was happening with loo roll and hand sanitiser, someone else gave an example of water then yes - morally wrong. But at the end of the day this is a £500 games consoles, there are other games consoles out there e.g. PS4 and the buyer is fully aware of their purchase, and is clearly not coerced into doing so by anyone.
      In legal terms your arguments are completely incorrect, there is no fraud/deception that takes place anywhere, the only thing I could possibly see thats wrong with it is tax dodging, but most scalpers declare their profits via self assessment.
      I think you're the one clutching at straws, people will keep doing it at the end of the day, don't hate the player hate the game, and if scalping via bots becomes illegal, people will just continue to do it manually, there's nothing illegal about a free market!

    In the US, S.3276 - Stopping Grinch Bots Act of 2021 This bill makes it unlawful to use automated tools (i.e., bots) to intentionally bypass a website's security measures in order to purchase and resell its products or services in interstate commerce. I haven't heard a lot about it being discussed.

    It should be illegal to advertise and/or sell any product in production for MORE than the RRP.
    That would stop those buying at RRP then selling them for more on any website (like Ebay). Auctions for example would have to offer a 'buy it now' at the full RRP option to stop them going over.
    It wouldn't stop people buying and then selling if they don't want it - but most they can get is their full money back. It also doesn't affect Antique/limited edition collectors pieces because they are no longer in production so don't have 'current' RRP.
    Of course, if people refused to buy these from Scalpers, they'd stop or be left with stock they'd lose money on...
    Fortunately, I got my Series X pre-ordered for Launch but had to register with a retailer so they'd contact me to order when they had stock so I could get my PS5 - which I got about 3months after launch because I refuse to buy from a Scalper with no warranty and could scam you too!!

    Scalpers are terrible and that's because what they do is not complicated. It just goes against the moral values of everyone else, so they just shamelessly take advantage of this fact to get rich. Even that last guy, what an asshole, he was afraid of losing his house. Well, guess what, most of us can't afford a house. I have to pay rent month after month. If you dropped the price of your house, I'm sure you could sell it, move in a smaller house and use the extra to cover medical bills and so on.
    But these guys scalping electronics are probably the same ones who scalp the housing industry, so they don't like it when they have to drop the price. I'm sure it's awful making less than 50x on your investment.
    I personally just ordered an RTX 3080 with a $300 "scalping tax" (which stores also apply if we're fair) and I could flip my GTX 1080 and cover that, because my graphics card is overpriced as well. In fact, on the second hand market it costs more than I paid for the whole PC 3-4 years ago. It just goes against my moral values to try to rip off a kid or some other gamer.
    There's no excuse other than being an utter scumbag.

    I don't condone what these people do but at the end of the day they aren't the ones making you pay over the odds for rare items. I want a PS5 as much as the next person but I will only pay a sensible price, so will wait.

    it is the proxies that are illegal. as you showed, at just under seven minutes in, bots cannot operate from a single IP, they need to be able to appear to be coming from all over, to escape detection. these proxies are hacked computers, all over the world, collated into "botnets" and sold on the black market. it is the use of proxies that makes these people criminal. may i ask why you did not cover this?

    Curries, Argos and others get their cuts, because they provide distribution network and final cost agreed with the brand manufacturer (Sony). Whereas Scalping doesn't add value to distribution, they hoards, instead they jack up the price without manufacturer acknowledgement.

      It does technically add value, it's a common misconception that scalpers 'hoard' consoles, they do not - they buy them from retailers and sell them straight on. It would be completely illogical to hold onto something that has an infinite supply. Scalpers also sell all their stock, to people who want consoles, so even if scalping didn't exist, the same amount of consoles would still be produced, and demand would stay exactly the same, they would still be out of stock absolutely everywhere. Scalpers offer the opportunity of convenience for a higher price, and people will pay for it!

    Amazon and ebay in a nutshell. Don't buy. Scalpers are out that money if no one buys from them. just don't buy from a non-authorized reseller. Simple. Do scalpers report all of their income? Do you need a license to sell over xx of an item before you are considered a dealer of said item.? Does he have enough insurance if he were to lose his inventory in a disaster?

    scalping and botting are 2 very different things. Bots bypass all security checks, they bypass limits on buying and jump the entire line in many instances. It creates artificial demand. A person like me and you buying a game console, car, a ticket and the value of that product is lets say $100 vs a $75 MSRP why in the world would I sell for $75? What are people going to complain about next? House flipping? Retail profit margins? How about brands that sell a shoe for $300 but it costs $20 to make, $10 per to market and $5 to ship? "Value" is a slippery slope. Botting should be illegal or retailers should put in better safeguards against it. Scalping is another conversation. The bot owner that was interviewed here is a douchebag

      Except there is, it's essentially a fee for being able to buy the product at your convenience. There's a common misconception that scalpers 'hoard' their stock, they don't, the guy in this video has simply done it for aesthetic. They like to get their stock out the door as quick as possible, and people buy them at the higher prices, if scalping didn't exist it wouldn't have an effect on the main issue which is the overall supply.
