Application for stay of execution may either be moved in court where execution is pending or in court of appeal. Executing court may exercise its discretion to stop the execution if applicant submits security bonds, or otherwise when appellant convenes the appellate court.

HELLO sir. Hope you would be fine.Firstly, If a decree from court of first instance is passed against one party,and Neither Decree holder apply for execution of decree Nor judgment debtor files an appeal against decree. What would be remedy for judgment debtor after time for filing appeal expires.?
Secondly, A decree is passed and decree holder is not applying for execution of decree,Should I(Judgment debtor) prefer an appeal or wait for execution?

Brother he is waiting your appeal, if he file execution, your appeal will stop his execution. And when prescribed period of appeal empires, he will file execution

@@plead4justice775 Valid point . But sir the decree was passed in Dec,2019 and is still not in court of law for execution . What remedy is left with judgment debtor in this case. Judgment debtor has preferred no appeal yet.
