Hal - the reason the Advice of Counsel defense wasn’t used was because it would mean Trump would of needed to testify. That would be required since he would have to testify what his attorney advised him. He could of used the defense if he was willing to testify but obviously he would never do that since it would open himself up for perjury charges.
