    I wonder if Horwarth would ever use this clause? Damn right she would! Doug Ford is completely within his provincial rights as Premier to use this clause as it is part and parcel of our national constitution.Thank god for the forward thinking Peter Lougheed, because without this clause we would be at the mercy of a single appointed judge upstaging democracy!

      No I wouldn't! I know the the history and reason this Clause was granted to all provincial governments, thanks to the hard work and foresight of the late, great Peter Lougheed! The courts do not override provincial jurisdiction. I would have no right to complain about Horwarth using this provincial legality! Thankfully, Horwarth will never be in a position to ever use it!

    I had to smile at the reaction from the Host when all three past Premiers agreed that Premier Ford could legally use the clause and that he is the ultimate authority and Trudeau has absolutely no authority here. They all wisely did not say he should or should not use it but that he is elected and will ultimately answer to the electorate. And they all agreed that Trudeau will possibly be expected to finally use this or similar authority to get the pipeline built. If he does not, Trudeau will again be answering to the electorate.

      Trudeau actually does have a legal right to prevent Ford's action, but he won't, because it would be as ridiculous as using the notwithstanding clause to throw chaos into a municipal election rather than appealing a court decision.

    This is where Canadian politics sharply differs from US. Notice that both Christy Clark and Jean Charet are Liberal Party former premiers yet they judge Conservative Doug Ford's decision based on law not on political affiliation.

      I voted for him, So far haven't heard any sufficiently good reasons to do this. Saving money by itself on the counselors is an idiotic idea. One needs a really detailed policy on all this stuff at the very least it would involve the likely counter measures, and we already know what the response will be: It will be more bureaucracy, or neighbourhood councils. Even if Ford can what the council for the rest of his term/s that isn't his job, and one day he will be gone. Simplistic solutions with long tails often don't work out how one wants them to.

      @@HondoTrailside There's too many councilors trying to figure things out together and there's too many opinions to be heard and things just take longer that way. It's like trying to have 3-4 mechanics all work on a car at once...not necessary 1 is usually enough to fix one car. Doug has mentioned before even other cities larger then Toronto both in population and In area have half the councilors.

      I am sorry but I make a habit of not listening to what people say but what they avoid saying and what they actually do. So far I have seen false claims by him and unknown claims by members of his family amounting to what may be criminal activities. I am of the camp that making a good thing from illegal and immoral means does not make it right. Making is right is doing what is right the right way.

    Christy Clark, Former Premier of British Columbia thank you, the elected Premier / Prime Minister or President is answerable to the voters. Lawyers or Judges are not. Ford is elected premier of Ontario.

      Premiers and Prime Ministers are chosen by the most elected MP/MPP in the legislature. However, judges are not, they still play an important role in our democratic system.

    Hey CBC; why have we not seen one interview that agreed that Toronto city council is dysfunctional ? The Toronto councils have been dysfunctional for decades ! Look what we don’t have now that Toronto has completely built up .... insufficient subways.... insufficient expressways ..... waterfront is gone !

      Right on Bill … Toronto actually expropriated some and notified others of a move to build an expressway roughly parallel to the CN tracks in the east end, and also to continue the Allen Expressway into the city, but low and behold that was in the 70s and it still has not been done.

    It's a start.

    Bravo, finally people who understand the actual issues. And I love how Jean Charest let the worse kept secret out of the bag about how dysfunctional Toronto city hall really is. "everyone know how difficult it is to manage" was his exact words, now contrast that with John Tory's belief that Toronto politics is a well oiled machine. And some very good points from Christy Clark who, if I dare say looks more relaxed and happier in the private sector.

      Take a look at Maxime Bernier. Im a 4th generation Canadian & I’m a second generation Conservative...but, I CANNOT support Andrew Scheer. The Conservative ballot-burning before a recount could be done since it was SO close... was illegal. Bernier was upset, of course. Wouldn’t you be, if you were Bernier?
      Having the dairy cartel all voting just for paid-Scheer?? He even gloated publicly the dairy cartel win, by drinking milk to rub it into Canadians who voted for Max Bernier.
      Scheer has met recently with Soros! WHY? Scheer supports Trudeau and illegals!
      This Soros paid Justin Trudeau who said

    13:52 I think it was Vassy's laughter after Brad Wall explained that using the NWC had been no big deal which was the moment when she realized she wasn't going to get anything to use to tar Ford with. Not a single soundbite to put on repeat. It puts a spotlight on how histrionic the accusations Toronto commentators have been making against Ford, and the Premiers' unanimity reveals how beyond the pale of ordinary discourse their reaction really is.

    I don't think people should panic yet , section 33 is there for a reason, now if the Premier of Ontario begins to utilize the clause with every legislation. It would ultimately should be a cause of concerned, however as the Premier reflected the section has to be renewed every 5 year's, if the electorate does not agree they are free to choose in the next election if the section should be renewed

    wow the CBC with actual information. A real panel of people with real answers. Didnt think the CBC had it in them anymore, even tho the interviewer still tried to get Ford thrown under the bus. It backfired on the CBC and we got real news for a change. I can even actually comment on this story, about time CBC, cant wait until you are defunded, tired of paying for your propaganda.

    Level headed interview. I haven't listened to CBC since the election and subsequent bashing of whites on a daily basis. THANKS CBC you're doing your job and maybe now I'll consider listening again.

    I’m glad there is a way for Canadians to protect themselves from abusive government. Toronto has been barraged with abuse from beurocrats and my hope is that the people will assertively stand their ground. And if they can do it, other cities can too!

      I agree with her on this issue, but she is a terrible politician. Stole hundreds of thousands of dollars. And she's a state capitalist, very bureaucratic rather than free market capitalist.

    Doug Ford is doing great for Ontario. Toronto don't need that many elected Politicians at City Hall there are city's like Los Angeles and other bigger city's then Toronto that has less then Toronto and they are doing great why can't Toronto do the same.

    The notwithstanding clause will have to be used more and more because of the way in which our judges are taking it upon themselves to grind things to a halt here in Canada. For example, whenever cabinet provides approval for a major project such as a pipeline, a law to that effect (invoking the notwithstanding clause) will have to immediately be passed to provide protection from the courts, and while not everyone will agree with this, the vast majority will, and that's what counts.

    I am so incredibly proud of our elected Premier Doug Ford. Lets remember that Ontario voters just overwhelming voted Conservative and for the entire Doug Ford platform. We Ontario voters were so disgusted with Dalton McGinty and Kathleen Wynne that we sent the Liberals from a MAJORITY government down to just 7 seats, which is 1 seat BELOW an official party, so Ontario voters are so pissed off at Liberals that we don't even see them a political party anymore.
    So now we have the Liberal media, enraged at the resounding loss, which have started their harassment campaign against Doug Ford. This will be much worse than when The Toronto Star harassed Rob Ford and was probably complicit in his quick health decline.
    One thing we do know is that The Notwithstanding Clause was so obscure that the Liberals didn't even know about it, because they SURE AS HELL would have used it. And that is concerning me now. Even the dumbest Liberals, and there are over 1 million of them who barely remember to breath, are now waiting for their chance to use thus clause, and as we've seen from Liberal's past record of destruction, they will use this clause like its a regular part of their day.
    Liberals, shut the hell out, get out the way and just go smoke some pot somewhere. The adults are here now and we've got big chances to make to fix all the crap the last two Liberals almost destroyed the province on.

    It should have been noted that this issue was brought to the courts by the elected city councillors of Toronto. Framing this as elected officials vs technocrat judges is misleading. This is more of a battle between the premier and the city of Toronto and that's why people are condemning the democratic use of the clause.

    The notwithstanding clause was put into the Constitution for a specific reason. The Premiers of the day who insisted on the clause were seemingly as prescient as the architects of the American constitution. It's almost as if they foresaw activist courts becoming a reality.

    Yes, that's right CBC, the Ontario government is doing the correct thing here in getting this done quickly. The sooner the better so Toronto can have their election and vote in Faith Goldie for mayor, to help prevent Toronto from turning into a Chicago gangland.

    The authors of the not with standing clause have said that the clause was never intended to be used in this way . It was intended to be used in situations where there is a deadlock and it is critical that a decision be made . This does not meet that standard and incidentally was not a platform which he campaigned on and he was not given a mandate by the electorate. This was an issue he brought with him from his days on Toronto City council . More a case of vindictiveness rather than duty to Ontarians

    wow, suddenly i respect these 3 way more then i did before. Doug ford is reminding toronto that they are part of a provincial system. Toronto is used to getting everything and anything it wants the rest of Ontario be damned, ford has a province to run, and this is just a re settling of the roles into their traditional places.

    Unfortunately, the Canadian Charter of Rights, like the Human Rights Declaration, often get in the way of legal and governmental efficiency.
    They also allow cover for many shady individuals to execute their plans with impunity.
    The LAW must serve and protect the people, and must never become LAW for the sake of LAW.

    The flaw is the sheepeole... not paying attention to the implications of this clause and its potential use. "Not withstanding" clause can suspend very many sections of the Charter. That includes: freedoms of expression, conscience, association and assembly; life, liberty (like being jailed for cause) and the security of the person (Privacy); and equality. All can be set aside using the not withstanding clause. That clause should really go away.

    It's actually ironic that some individuals believe they can challenge the Ontario Premier through the court system. Yet when the Premier has the right to use both the legal and voters end of the spectrum which is represented through the not withstanding clause. It seems to be problem with them. This actually proves the NDP Party believes in the Dicatorship type Party over an elected one.
