    Why isn't the time a person needs to go to the Dr. compensated? If you are injured at work why shouldn't you get paid for your time to get physical therapy?

    Great video all I know is that I just got p&S with permanent restrictions no more lifting over 40 lb this is all due to a lumbar laminectomy I used to make $20 an hour as a driver I work 50 plus hours a week all I'm waiting for is my qme I know I do have future medical what do you think my case is worth

    I've been out for 4 months so far. I'm having a spinal fusion surgery next week and will be out at least 3 more months. My pay rate is $10.50/hr a work week of about 55-60 hrs a week. I'm a driver and had an accident in the company van. The accident was my fault. I'm just looking for a ball park figure and also a time line.

      Only in Rebel Tube I had the spinal fusion surgery but on my neck. I had 2 herniated discs in my neck. None of those things worked I did it all. Blockers, PT, the surgery was very painful, it did help relieve most of the pain. I am now dealing with possibly having another surgery for the other side bc they say very often u hurt urself by overcompensating

    This is a very interesting and informative video, Scott. JUst to give you a little detail, I had a nerve injury in Nov, 2005, that left me with limited use and feeling in my left hand. Did all the therapy, which meant months away from home, and honestly felt there was a lot of improvement. However, I made the mistake of pushing, and insisting I was capable of returning to work. Workers Comp insisted I wasn't, and next I was on Oxy, large amounts, and pretty much lost a little better than 2 years of my life. I've been through hell, and I DO blame the Workers Comp for ruining my life. I firmly believe I could and should have been returned to work, if not at what I was doing, something, anything else. I won't bore you with further whining, but if you would like details, let me know.

      @@muziq99 Read my comment again, Kareem. I didn't return to work, even though I had felt I would have been in a better place, had I been allowed to. I followed, and trusted, that the Board was working for my best interests. In reality once they have to accept the seriousness of a workers injury, the games begin.

    I just had a question on MILD TBI. where does it rank as "worth" on a workers comp scale?. I think a brain injury is worth more than some specific "broken" body parts. I had a DEEG done 8 months after the accident, and one done 1 year 4 months later. It shows signs of healing but the brain wave movements are still there...

    My case was in colorado im in Texas but settled they didnt give me much but I took Medical for Life and they said I can settled..I hurt my L5 S1 and a second surgery to remove hardware.. another thing 2 yrs after my first surgery I had to have neck surgery 2 yrs after my first surgery but From the beginning they only took ex rays from my lower back and I knew they did not pay for my neck surgery so Medicare Medicaid did.. But anyone can tell you that if you hurt your back that if will affect. your back structure it irritated and aggregated my neck when I fell but because they didnt did not take exrays they didnt pay for my neck surgery.. Im needing any help on how to settle my Medical fo life because of the trip I take 2 a month trips 2 different places and Been. Driving for over 12 years and thats the reason I want to settle now..I need a doctor's in my area its become to much.. Does anyone have any suggestions...thank you

    My husbands company seems to be doing all the right things... but there is a dash cam video that I can not get my hands on... I have read that a company does not have to have the video after 30 days... I just txt the VP requesting that video today is sat the 30th day I hope they have it... Do you think it is important to a TBI to have that tape for the long run? Do you think that my request via txt will help?

    Scott,I was hurt on the job,had surgery received benefits but never recovered and was terminated(as an employee and benefits cut off)when I reached full MMI.The doctor released me from his care with permanent restrictions(no lifting over 10lbs)I've been without income since July of 2015.Do I have a strong case?

    I been off from work for 1 year already and I'm still waiting. I have restrictions, and lately I noticed that the way I walk cause me back pain and my right hand and arm been affected by the walking stick that I'm using. I never received any weekly payment from them. I am a single mother is impossible to have rest so my pain never stop and I'm wondering what is going to happen, I'm so stressful and depressed. I can't do nothing like I used to with my kids I haven't been able to takes them out.😢😡

      am a comp lawyer in Rochester NY.You need to get a lawyer who has comp experience.Your DR needs to clarify how your additional injuries are related to your walking stick/back injury so they can be added as consequential or secondary injuries to your original injury.
      You may be able to add depression and or anxiety to your case also.

      @calvin Calhoun that's incorrect. That lawyer is still entitled to his/her work done. Even if it was only an hours worth of work. I went through it. My brother is a prosecutor and he said that's with ALL attorneys in all 50 states. Ridiculous! I say that because my attorney I switched to did more work in a month than the other did in 6 years. He still had to pay him his percentage. It wouldn't be an additional 33.3% but, they work it out.

    Hello , so there's a special chemical that we use at work and I accidentally got some in the inside of my arms. Everyone reacts different to it but I've had rashes on the same spot for months now. I haven't gone to the doctor because I didn't think it was a big deal. The rash has t curd and doesn't seem like it will any time soon. It's red and it keeps getting irritated. Benadryl doesn't help . I've been thinking of going to the doctor. Would my job pay for that? Or do you think I have a case?

    I live in NC, was out for about a month. workers comp. hasnt helped at all and now they are trying to close my case. I ended up leaving the job shortly after due to the situation. Cant seem to get ahold of any lawyer who will even talk to me.

    You didnt answer the question on how to calculate a general amount. You only listed the elements needed but not how to calculate. You went into your sales pitch .

      As I explain in the video, it is based on a percentage of a body part. How in the WORLD am I supposed to cover every injury, every hourly rate and every medical outcome? It is an informational video.
      I also offer a free consultation where we are able to discuss it. The consultation is 100% free. The reason I offer the frree consultation is to give details advice on particular situations.
      Also, I offer one hell of a lot of help and info to injured people, so forgive my negative reaction to your tone regarding my
      'sales pitch' which amount to offering injured people a FREE BOOK AND DVD. Lol. Some sales pitchl. I lose $25 every time some requests the free information. But I do it to HELP injured people. How many other injury lawyers you know who give away free stuff? Lol.
      The name of the game is to have reasonable expectations about UA-cam videos. It isn't reasonable to get an answer about your specific situation without your specific details. Here's another thing, also discussed in the video: Different States have different laws. So keep that in mind.

      am a comp lawyer in Rochester.a general amount is 5 to 6 years of payments at your current comp rate,maybe more if a permanent injury and already classified with a permanent degree of disability,for classification injuries,i.e.back,neck.for loss of use % injuries,i.e.arm,leg,hand,vision,hearing,fingers,etc u get paid the loss of use % times the number of weeks in the injury schedule for the type of injury,times your maximum comp rate,minus what u were already paid for comp when out of work.

    leg injury, turned into blood clots, turned into pulmonary embolism's, step up over a year later. lost 90 percent of my muscle in my leg and still learning how to walk again, (gained 60 lbs because I don't know how to live like this) finally at 23 months since the injury, their insurer occasionally ok's therapy when they want to. I have a mortgage earning 65% of my pay. The company I work for put me on medical leave of absence, not my doctor but since then my doctor has held me to no work at all. But the doctors, comp lawyer and therapy office still have a hard time getting anywhere with this companies Private insurer. I restart therapy again for the 6th time next week. I had one doctor tell me I didn't have a blood clot (2 days after I got out of the hospital because of a blood clot)

    I broke my left lateral ankle (tibia) had two surgeries 1) fix the bone 2) Remove hard ware. They did not take me back at work. It is almost two years ago, impairment rate was 8% did get a little money, my ankle is not good yet, work three days a week on not regular basis. I do reopened my case, because wanna see the Dr, making sure I'm not developed arthritis, I'm fight the insurance adjuster to set me up a doctor' s appointment. Why is it so hard to find a worker's comp lawyer? Thanks

      unknown_no_name OWL So it’s a little bit complicated. If you are completely done treating and you settle your case, did you settle the case on all his shoes, then no further treatment is going to be covered under workers comp. Another possibility is that you settle your workers comp case but medical is left open. That is pretty rare for settlement, but it sometimes happens more often in a try over the judge orders the case to be over but leaves medical open meeting that you get paid for all medical treatment related to the injury in your work injury. Only for that part of the body and only that treatment that’s related to the injury. That would get paid.
      No that’s how it works under Illinois law, but if you are in a different state, it works differently. It’s actually a pretty complex questions. Please feel free to call me at 312-500-4500 if you would like to give me more details and I can give you a more detailed answer.

      You were supposed to set up a MSA Medical Set Aside account prior to or after the settlement in which the insurance company will put aside money in an annuity strictly for future surgeries, medications, therapies. If you have settled your case then its probably too late.

      If you cannot do your job and have an off work or modified duty note, in Illinois, you are supposed to be paid while off work whether your boss fires you or not. Call me if you are in Illinois and want to talk about it.

    Hi, I'm from Toledo Ohio. I was injured at work in 1992, I'm on PTD and now I want to settle my claim. My attorney that represented me since approx. 2003 isn't being much help anymore. He received $10,000.00 when I won my PTD and I thought he was still my attorney continuing but maybe I'm wrong. I've had 2 LSA's totaling $62,000.00.I filed the LSS on my own for $178,000.00 recently . What are my chances of receiving the LSS and how long does it take? Thanks! (I'm 50 yrs old and I've had 3 major spinal surgeries and I rely on pain meds through pain management for the rest of my life. I only settled on the indemnity.)

    I have a question. I just had my QME evaluation done yesterday and the QME doctor feels that I will likely have permanent disability to my lower back. Now that the QME is done, how long will it take to settle my case? Are my TTD payments going to stop? The QME doctor did not say I would return to work on light or modified duties. My lawyer office is giving me no straight answer. Already my TTD payments is 4 days late even before going to see the QME doctor? I have no clue of where my case is at and what to expect. Can anyone answer my questions please? Thank you

      What state are you in? In California you can receive TTD for up to 2 years which is 104 weeks. I am not an attorney, but I can help.

      J LUMINADO In Illinois, pain and suffering is not included in Worker’s Comp. you can only claim pain and suffering in a regular lawsuit.

    Most times in single unit accident with no innocent by standers... Or carrying 1000000.00 max insurance..on standard rollovers after meds victims clean up..mutual faults etc.. after lawyers..fees bs 100 to 225 to family ... You may be disabled apply for ssdi...teddy

    I been on wc. For 3 years already. Fusion surgery on my back L-4 L-5
    Lots of therapy for shoulder and wrist. Wc. Never approved the surgery for my shoulder that dr. Recommend. Now that want to close my case. The Dr. Give me 20% permanent disability for my shoulder and 10% permanent disability for my wrist. After 1 year after the fusion surgery my back still in pain. Sir. How much you think my case Worth. ?
