    Hi Darian, im glad i found your channel. I was about to apply for naturalzation. Ive been here in US for 26 yrs through marriage. My question is, theres a question that asked if i ever claimed a Us citizen? When i filed my taxes i checked box US citizen though i have green card. I have no intention of fraud or anything. Does it a ground of denying my application for naturalzation?

    Interesting information , I was deported on 10/30/2003 to Colombia, ( no criminal records back then or now) was banned for 10 years from returning to the US, I stayed there for a total of 15 years until my permanent residence petition was approved (2018) I have my naturalization interview scheduled for December 18/2023, will I have any problems during the interview? Or is it in the past? Forgotten ? Thanks

      Did you have any issues with your citizenship interview? My mother has always been a resident but she’s now trying to get citizenship. 30 years ago she was given a citation for stealing from a store will she need to disclose that or is that going to deny her application ?

    I became an LPR in June of 2019, I went back to my home country for school in January of 2020 I got the re-entry permit on March 25, 2020 just in case I took more than a year, gladly I have the re-entry permit because of Covid, my question is how long should I still wait before I can apply for naturalization? I came back in March 2, 2022. I went back again in April 22,2023 for a vacation for 40 days, and last April 27, 2024 for 55 days. I’m still employed here in the US for 2 years and 3 months now, I just filed for a leave.

    So this is the second time my wife has been denied. The first time she answered all the answers correctly but she didn’t understand some of the questions they were asking. Not pertaining to the citizenship test but regarding the oath question as well as some other personal details. Second round she comes back and answers all the questions correctly and she asks if she understands the questions and she says yes but then she asks my wife to explain in English what each individual question meaning. She answered the questions correctly but then she pressed her to tell her what each question means in English. She understands the questions but she cannot speak 100% English to explain to her what each question means. I’m thinking about filing an appeal but I’m not sure if it would be better to do this or just reapply for n-400 again . The second officer was more difficult than the first officer

    A question was asked about whether I have travelled outside the country during my 5 years of permanent residency, then I mistakenly answered no, instead of saying yes. Will that affect my application.

    • @claudykay6492
      @claudykay6492 5 місяців тому +1

      Most likely yes. They have record of all your trips outside of the United State. When you go to the interview just tell the officer you mistakenly answer no instead of yes and you should be fine.

    Hi Darian, what if your naturalization application is denied after you passed your citizenship test because you submitted your naturalization form few months before completing your 5 years of residency?

    • @DarianLaw

      You can only submit it 90 days early. Either way you can reapply.

    What about a receiving a deferred judgement from a felony. Is their any way around that or is that a permanent bar ?

    • @DarianLaw
      @DarianLaw  Рік тому

      Felonies do not automatically have immigration consequences. It depends on the exact statute.

    • @andrestewart2887
      @andrestewart2887 Рік тому

      @@DarianLaw Wouldn’t it all be encapsulated in the moral turpitude wording ? I looked at felony theft here in Iowa which requires you to plead guilty in order to get a deferred. Thanks for your reply.

    Hey darian! Hope you’re doing great. I’m a US citizen turned 21 years old 6 months ago. I want to apply for my parents and brothers immigration but I’m not in US right now as I am studying medical in another country. However, I have financial sponsors for affidavit of support. My studies will be completed in june next year. Can I apply for them by filling the I-130 form online on uscis site?

      Also, my grandfather is living in the US and have already applied for my father (with family) under the F3 category. The priority date is june 2014 for that case and it’s in NVC since 2020 but visas are not available since then. We don’t wanna wait anymore and wanna apply for IR-5 parents immigration. Should we wait for F3 petition or go for IR-5?

    • @Rana86______
      @Rana86______ Рік тому

      Lastly, I wanna know if that F3 petition filed by my grandfather be cancelled once I apply for I-130 separately for my parents and siblings?
      Also, maximum time for parents immigration process?

    • @DarianLaw
      @DarianLaw  Рік тому +1

      You don't need to be physically in the US if you have a US residence. Temporarily living abroad during school won't affect your ability to petition for your parents/brother so long as you maintain a permanent domicile in the US (and evidence of this can be a US mailing address where you receive mail). Petitioning for your parents will be much faster than your grandfather's petition (although the sibling petition will take 14+ years so it's faster for your parents to get status and then for your parents to petition for your brother). Your grandfather's petition will not be cancelled if you file a petition. Multiple petitions can be pending simultaneously.

      I got my green card for 10 years through a marriage. I been married for 10 years with kids I went and passed both test and after the test they told me that I have to file 1751 ,I file it and they denied because my green car is not expired yet. They denied my n 400 application even I pass and it was their mistake to give me a visa for 10 years. Now I lost $750 .
      I just want to stay illegal. I don't want to waste more money.

      You will probably be okay if the case was dismissed, but it could possibly result in a denial of your citizenship application if the USCIS officer determines that you had bad moral character within the last 5 years which led to your arrest.

But I doubt it for free. This is so much BS. Maybe I should just have her cross the boarder, get her credit card, and vote democrat, and get this for free! Smh
