Thousands of cases will be thrown out, if they succeed in getting this case thrown out based on the grand jury ruling. The more seemingly ridiculous their arguments get, the more I think they don’t have any defense. They’re going to try to attack procedure, try to get State’s evidence thrown out, then say there isn’t enough evidence. This is not an innocent man’s defense in my opinion.
It was touch dna , not blood or sweat or semen. Touch dna can be found on items you never actually touched. And, it was not the only unidentified male dna found at the scene. He may well be guilty, but the evidence needs to be strong if you are wanting to convict someone of mass murder.
I think they would have looked at the other 3 dna samples as well and ruled them out. The only other way his dna would be there if it was someone else who did it . Had touched him in a few hours. But didn't he say he was out driving alone ?

What you're correctly saying is that touch DNA can be transferred from person to person, but tell me, how astronomical would the chances have to be for someone else to have transferred Kohberger's dna to a knife sheath that just happens to be found at the murder scene where so many other elements of the case point directly at Kohberger? Touch DNA is not any less reliable in terms of it matching Kohberger's DNA, but the jury will have to decide if it seems likely that this "coincidental transfer" occurred, or if the touch DNA was left by Kohberger himself. I think a conviction will depend largely on the presentation of the prosecution, including whatever other evidence we have not been made aware of to date. The defense has been left with nothing to work with beyond praying they can find some type of errors in the prosecutions case. I'd bet my pension that the defense will be extremely disappointed at tomorrows hearing when the Grand Jury indictment is upheld. Anne Taylor's desperate arguments to have the indictment dismissed will no doubt be viewed as "less than compelling".

He had many weeks to clean his car professionally. Nov 13th murders - arrest came in mid December - thats a long time to clean up and it took a long time to get the evidence processed. People are so stupid. He also could have worn a hazmat suit or something over him & tossed that immediately. He didn't get home in Pullman for hours but he went back to the killing house at 9 am to see what was going on. Guilty as charged. And Maddie rejected him on Instagram, never answering him ever!

Yes! Thank you! That is a giant bur under my saddle. There may be perfectly legitimate reasons why the glove, etc, were apparently disregarded completely (although I don’t see how), but none of the reports ever brings them up at all, anymore. To me, that’s a giant, red, reasonable doubt flag until when and if all of them are satisfactorily explained - which I don’t see how they can be. If I were on the jury, I couldn’t vote guilty. I sure hope the defense doesn’t overlook them.

They had tons of parties with tons of people coming in and out of their house.. Of course there was other dna in the house.. You have other people's dna in your house too.. What's that got to do with it and how do you know they didn't check it? Why do people think that "well, there is hardly any DNA at the scene...." is a good point of argument or any argument at all? SOMEONE did this so someone barely left any DNA. It is ridiculous to even bring that up. Someone like BK would be the exact type of suspect to hardly leave any DNA at the scene because of his educational background and interests.
Well, if you’re gonna go off the knowledge of his background, he would know better to not bring his own car, maybe not have his hands full. And for the fact that he did bring his own car and there was no DNA for such a messy crime scene. And you don’t know that that was his car because we haven’t seen any footage. We don’t even know there is any footage because you know it’s all hidden so we don’t know if they actually have any other evidence besides the DNA that they somehow got and processed.

I sat on the West trial out of California this yr.. over 20 hrs and I followed it from the start 3 yrs prior. yeah, thats why there are innocent people on death row again and again over the years. Don‘t get me wrong, i think they have the right one in this case, but to assume in general a death penalty trial means there is enough evidence aka the defendant is guilty is very naive.
Speaking of DNA. None on him, his car,his apartment or his parent's house. There were also 3 other DNA profiles found that weren't investigated. 2 inside the house and 1 outside. Not to mention the footprint that was cleaned up outside Dylan's door.
Cell phone data doesn’t show location. How could the roommate who first said she was asleep downstairs now say she was on the 2nd floor. A smudge of blood in the knife sheath. This evidence is so flimsy. It seems with all the resources they had the police dropped the ball on this case. Doors have locks for a reason. I guess these people haven’t heard of Innocent until PROVEN guilty.

The trial will allow the evidence to be presented and I believe all the pieces will make sense and he will be PROVEN guilty. His defense will of course try to prove innocence.....not sure what they have work with.
All the defense needs to do is to convince the jury that the prosecution did not prove his guilt - not that he’s innocent. (That’s not related to my belief in his guilt or innocence, nor to what I think the verdict will be).

This State has a law to prevent witch hunts & fishing expeditions, and the standard for jurors by law, is beyond a reasonable doubt. It doesn't matter what other States standards are.
@spoonypoon7998 NO. Their State law for grand jury instructions are, the weight of evidence has to be beyond a reasonable doubt. It's much more stringent than, probable cause, like a warrant, or most States for holding someone for murder. They just haven't followed their own law for so long, that they'll claim precedence- but, that's not how precedence works. Precedence doesn't superced State laws. If it was federal court, it would be the lower standard. There's plenty of evidence for a grand jury to still find beyond reasonable doubt, so they should just reconvene, and follow their own laws. It might get overturned later, on this point. 🤔

Having his DNA in the house, on the sheath that probably carried the murder weapon, and his phone placing him at the crime scene over 10 times, once a couple hours before the murders, and a few hours after. Hardly lacking in evidence I’d say.
Unless the prosecution has more evidence they haven't released yet, as it stands now, if I was on a jury I could not consider him guilty beyond reasonable doubt. There are too many questionable things how the police have handled the whole case. And police timeline doesn't truly align. It seems if anything Bryan kohberger didn't do this alone.It's bad how the media doesn't remember people are innocent until proven guilty and report things that are not exactly true or have been proven

There's a lot for defense---why is prosecution tried 9X's for discovery & still haven't received it ? This is a complete circumstantial case. Can't prove that was even his car or it's even connected to the crime. 8 hours before police called & a single footprint in a house of 6. Sounds like serious clean up. However just because they said they were looking for one specific type of car does not constitute a cover up or lack of evidence.

In the Murdaugh trial, the car itself provided very very detailed information about where the car was, its speed, etc. Is this information available for a Hyundai Elantra?

Unless the video footage of his *no-front-license plate Elantra* isn't what we expect, he arguably puts himself in the immediate vicinity of the crime scene with his non-alibi alibi. He takes himself out of his apartment and puts himself in that car. He has all but conceded that *_it is his car_* on camera, leaving Pullman, headed to Moscow, and followed in detail from there.

I watched the judge’s response in his courtroom and am glad he did the right thing dismissing the motion but a few of his nonsensical apologetic comments seemed sympathetic to the defense lawyer’s crazy filing.

Grand Juries do not use a "beyond reasonable doubt" standard. They use probable cause which is a much lower standard and just indicates "yeah there's enough to proceed to the next phase. The defence is trying (and will fail) to argue that the standard SHOULD be BRD.

To convict someone on touch dna is terrible for our justice systems. Anyone can shake your hand and commit a crime and you show up. To give death penalty to someone over that evidence is crazy.
Except the touch DNA was on the underside of the button, the part that's on the inside of the flap, and no other DNA was found anywhere on it besides his, and I assume Maddie's. Also, they'd have to have shaken his hand and then touched the knife for it to be transferred, but never touch it with their own hand, and that's ludicrous. All they have to do is find where he purchased a KBAR knife and it's done. I'm sure they have more evidence than that, though.

Since the GJ only hears the prosecution’s case, and does not hear anything from the defense, it makes sense to me that the GJ should believe the prosecution has enough evidence to prove guilt BRD because they need to prove their case BRD to get a conviction. If the GJ listened to the prosecution’s case without it being challenged by the defense and felt they had enough evidence to meet the probable cause standard, but not BRD, it makes no sense to proceed straight to trial and bypass a preliminary hearing because the GJ was basically not convinced they can get a conviction even when the prosecution’s case is unchallenged.
Every case proceeds to trial on that basis.. Why do you think this case should be any different than any other cases? A preliminary trial wouldn't change anything

This case just hearts my heart. Those kids should be alive, they shouldn't be dead, and victims of a horrifying murder. It's evil that someone could do it makes me cry each time I think about how these kids were stabbed to death..... some kind if evil rat snuck into their home in the middle of the night and stabbed these kids to death.... and for what?!?! Why them? I don't see how folks could kill someone so easily, I dread the day I even have to kill for the sake of self-defense. it is "touch DNA" . You guys need to research what that really means, as it is clear you misunderstand. Further you should research how many (innocent) ways touch DNA from Bryan could have arrived upon that sheath snap. So far the prosecution has introduced nothing but subjective and circumstantial evidence; and this case is therefore subject to an immediate dismissal (unless the prosecution is surreptitiously withholding evidence).

When he did that, he wiped the DNA from Brian's hand shake into the underside of the button, then went to kill the kids in the house, all while never taking the gloves off. BOOM! Ez pz /s

It was touch dna , not blood or sweat or semen. Touch dna can be found on items you never actually touched. And, it was not the only unidentified male dna found at the scene. He may well be guilty, but the evidence needs to be strong if you are wanting to convict someone of mass murder.

What you're correctly saying is that touch DNA can be transferred from person to person, but tell me, how astronomical would the chances have to be for someone else to have transferred Kohberger's dna to a knife sheath that just happens to be found at the murder scene where so many other elements of the case point directly at Kohberger? Touch DNA is not any less reliable in terms of it matching Kohberger's DNA, but the jury will have to decide if it seems likely that this "coincidental transfer" occurred, or if the touch DNA was left by Kohberger himself. I think a conviction will depend largely on the presentation of the prosecution, including whatever other evidence we have not been made aware of to date. The defense has been left with nothing to work with beyond praying they can find some type of errors in the prosecutions case. I'd bet my pension that the defense will be extremely disappointed at tomorrows hearing when the Grand Jury indictment is upheld. Anne Taylor's desperate arguments to have the indictment dismissed will no doubt be viewed as "less than compelling".

He had many weeks to clean his car professionally. Nov 13th murders - arrest came in mid December - thats a long time to clean up and it took a long time to get the evidence processed. He didn't get home in Pullman for hours but he went back to the killing house at 9 am to see what was going on. Guilty as charged. And Maddie rejected him on Instagram, never answering him ever!

Yes! Thank you! That is a giant bur under my saddle. There may be perfectly legitimate reasons why the glove, etc, were apparently disregarded completely (although I don’t see how), but none of the reports ever brings them up at all, anymore. To me, that’s a giant, red, reasonable doubt flag until when and if all of them are satisfactorily explained - which I don’t see how they can be. If I were on the jury, I couldn’t vote guilty. I sure hope the defense doesn’t overlook them.

Why do people think that "well, there is hardly any DNA at the scene...." is a good point of argument or any argument at all? SOMEONE did this so someone barely left any DNA. Well, if you’re gonna go off the knowledge of his background, he would know better to not bring his own car, maybe not have his hands full. And for the fact that he did bring his own car and there was no DNA for such a messy crime scene. And you don’t know that that was his car because we haven’t seen any footage. We don’t even know there is any footage because you know it’s all hidden so we don’t know if they actually have any other evidence besides the DNA that they somehow got and processed.

It's much more stringent than, probable cause, like a warrant, or most States for holding someone for murder. If it was federal court, it would be the lower standard. There's plenty of evidence for a grand jury to still find beyond reasonable doubt, so they should just reconvene, and follow their own laws. It might get overturned later, on this point. 🤔

Having his DNA in the house, on the sheath that probably carried the murder weapon, and his phone placing him at the crime scene over 10 times, once a couple hours before the murders, and a few hours after. Hardly lacking in evidence I’d say.
Unless the prosecution has more evidence they haven't released yet, as it stands now, if I was on a jury I could not consider him guilty beyond reasonable doubt. There are too many questionable things how the police have handled the whole case. And police timeline doesn't truly align. There is more hard evidence in this case than most. People are convicted on circumstantial evidence all the time. You don't even need "hard" (I suppose you mean DIRECT) evidence.

@@Heather4_B-SINNo. When Kohberger was arrested she filed a motionto preserve the scene because it was on the process of being cleaned up. Later when it was disclosed the owner gifted the property to the university the defense stated they had no objection to its destruction.

Unless the video footage of his *no-front-license plate Elantra* isn't what we expect, he arguably puts himself in the immediate vicinity of the crime scene with his non-alibi alibi. He takes himself out of his apartment and puts himself in that car. He has all but conceded that *_it is his car_* on camera, leaving Pullman, headed to Moscow, and followed in detail from there.

I watched the judge’s response in his courtroom and am glad he did the right thing dismissing the motion but a few of his nonsensical apologetic comments seemed sympathetic to the defense lawyer’s crazy filing.

Grand Juries do not use a "beyond reasonable doubt" standard. They use probable cause which is a much lower standard and just indicates "yeah there's enough to proceed to the next phase. The defence is trying (and will fail) to argue that the standard SHOULD be BRD.

There have been tons of cases where there was no DNA and people got convicted...
To convict someone on touch dna is terrible for our justice systems. Anyone can shake your hand and commit a crime and you show up. To give death penalty to someone over that evidence is crazy.

Except the touch DNA was on the underside of the button, the part that's on the inside of the flap, and no other DNA was found anywhere on it besides his, and I assume Maddie's. Also, they'd have to have shaken his hand and then touched the knife for it to be transferred, but never touch it with their own hand, and that's ludicrous. All they have to do is find where he purchased a KBAR knife and it's done. I'm sure they have more evidence than that, though.

Since the GJ only hears the prosecution’s case, and does not hear anything from the defense, it makes sense to me that the GJ should believe the prosecution has enough evidence to prove guilt BRD because they need to prove their case BRD to get a conviction. If the GJ listened to the prosecution’s case without it being challenged by the defense and felt they had enough evidence to meet the probable cause standard, but not BRD, it makes no sense to proceed straight to trial and bypass a preliminary hearing because the GJ was basically not convinced they can get a conviction even when the prosecution’s case is unchallenged.
Every case proceeds to trial on that basis.. Why do you think this case should be any different than any other cases? A preliminary trial wouldn't change anything

This case just hearts my heart. Those kids should be alive, they shouldn't be dead, and victims of a horrifying murder. It's evil that someone could do it makes me cry each time I think about how these kids were stabbed to death..... some kind if evil rat snuck into their home in the middle of the night and stabbed these kids to death.... and for what?!?! Why them? I don't see how folks could kill someone so easily, I dread the day I even have to kill for the sake of self-defense. Those kids should be alive right now with the rest of their lives ahead of them, this just hurts my heart.
it is "touch DNA" . You guys need to research what that really means, as it is clear you misunderstand. Further you should research how many (innocent) ways touch DNA from Bryan could have arrived upon that sheath snap. So far the prosecution has introduced nothing but subjective and circumstantial evidence; and this case is therefore subject to an immediate dismissal (unless the prosecution is surreptitiously withholding evidence).

When he did that, he wiped the DNA from Brian's hand shake into the underside of the button, then went to kill the kids in the house, all while never taking the gloves off. BOOM! Ez pz /s

@@mandymae100It is not stated that there was no blood on the sheath, but that there was a single source of MALE DNA. The victims where the sheath was found are females. Sex can be determined by looking at the chromosomes under a microscope. No need for DNA analysis to determine that.
