    I watched A video of lawyers that said a patent cost from $5,000 to $10,000 and I got scared and almost stopped searching and didn't want to really do my invention anymore thank you I'm going to keep watching you guys

      Those figures ARE scary! There are so, so many important steps you should take before even considering whether or not you want to file for a patent. In fact part of Stephen's strategy is getting companies to license your idea from you when you've only protected it with a provisional patent application, which will cost you $65 if you are classified as a 'small entity.'     I was so lost now I've found u guys thanks so much i have a invention and i had no idea were to even start i called company's such as patent office and a manufacturer company they wanted me to send them a detailed but short written of my product and if they felt its good enough to manufacture it and sell it all they would want is 25 to 30% of royalty but i never written any thing i didn't want my idea out to no one an til i had it protected but i found u guys

    *Just a word of warning to inventors out there;* a PPA provides perceived ownership which is important as *the field is saturated with scam-artists who will take your idea in half a second if given the opportunity.*
    There's an entire movement of these scam-artists and the reason there are is that 95% of businesses fail in the first 5 years. 5% persist. That's 1 in 20. If any potential inventor is attending a meeting that is private and unofficial to "help" inventors startup.. from the scam-artists' perspective, 20 people attending = 1 potential valid product/business model for them to steal.
    Stick with trusted sources: InventRight, Government and professional corporate groups, etc. *Do NOT trust people at some random private meetup. Do NOT talk about your idea(s) openly except in the most general sense and apply for a PPA* as this video describes, to give you at the _least_ perceived ownership. 👍

      A few years ago, after reading Stephen Key's book I was inspired to try get a patent and bring some ideas to market.. Sold my flat and looked to do just that.
      Unfortunately I met many unscrupulous individuals on the way who were happy to listen but quick to claim that ideas are "worthless", that patents are "impossible" to get.

      In the U.S. first to disclose is very important. Prior-art which _you have disclosed_ does not count as 'prior-art' for the preceding 12-months before _your_ patent application filing date.

    So glad to find you. I have a great idea. I know it is good because I have wanted this for years and would have 2 by now if they were out there. I talked to several patent help, or inventor help companies and it looks like they start at $1000 to get just a patent search, and then upwards of $14,000 to get my idea pitched. I was going to quit, but I am going to go forward with your advice and info. Thanks

    You guys make it look so easy. I am scared to patent my ideas because sometimes I send a money order with my form. They take and dump the money order, then send me a letter that my patent pending can not be file under the date it was received because I didn’t pay the fee. I think this is a very dirty trick done by some of the workers at the PTO. The first thing I think about is some on is trying to steal my idea.
    Even if I have the idea on a patent pending status, a company might reject yours and try to work around your idea, and you never get a cent for it!

    I have been looking into doing this for a while... I am moving forward and have found that there is a lot of studying to do... Plan to be a student real soon!
    Thank you for all you put out there.. Also, I have read both books and they are very good read... I should have purchased hard copies instead of e-books because then I could have marked and highlighted places. Still may purchase them.

    It is true what is said about everything in due time. My wife came up with an idea of repurposing a companies product which spark my interest.     I hold a provisional patent on a three component plastic product. I am looking at filing for a utility patent next, am I protected to take my invention to a tool manufacturer for example (without a utility patent pending?)

    Fantastic! Thank you! Question - I'm a newbie. But I have a killer idea for a product. However, I would need to contact a manufacturing company to see if their current product can be made in a potable way. Currently, it has only been applied through machines in a factory rather than available to customers to buy and apply themselves. I'm concerned that if I ask these questions, they could just develop it on there end and sell it directly to the obvious industry. Should I get the PPA first before I make the inquiry? If it is not doable, I guess I have only wasted $65. Or are they likely not to go that route? ie- take my idea?

    Outstanding video! Thank you. I have been researching PPAs and found this somewhat daunting language on the Nolo website referring to PPA. Can you help me understand or correct the statement that they make here:
    You can still file a regular patent and acquire patent rights to
    your invention, as long as you did not publish information about your invention or
    offer it for sale before you filed the patent application
    This is the context of their statement:
    If you want a patent, you will have to file a regular application within a year after you file your provisional application. You won’t automatically lose patent rights if you fail to file a regular patent application within a year after you file the provisional application. But you will lose the benefits we describe in this guide-for example, the earlier filing date and the right to claim “patent pending” status. You can still file a regular patent and acquire patent rights to your invention, as long as you did not publish information about your invention or offer it for sale before you filed the patent application.
    Are they saying what it appears? That a Provisional Patent does not allow the inventor to market their product prior to obtaining a full patent?

    Say the year is almost up and you haven’t found somebody to license your product to can you just re-file another provisional patent or do you only have one year and then once that years gone someone else can take your idea or do whatever? I think if I understand correctly you can file again before the year runs out?

    On a PPA, how in depth or "patent-speak" specific does the "detailed description of the invention" need to be? Articulating the particular mechanics of my idea is proving a little frustrating and I'm wondering (due to this being a PPA and not the actual patent application), if I'm wasting my time.     What should you do if you want to take a past patent of someone else....(which is no longer a patent that shows up in the data base of the patent office(I am assuming they stopped paying the patent fees and did not renew or maintain .......and further that idea and manufacture that item? thanks

    Is all your advice only applicable to the US? I mean regarding rules and regulations such as filing a PPA? Or sending out your designs to a US company etc? Im living outside the US. Can i send my designs to a company in the US and what will protect my idea if i want a lisencing deal?

    It's so useful information you are injecting Stephen please continue as we are learning more and more, I have a couple of questions:1-Lets say the 1 year is over and PPA expired you didn't get any deal, can any company use your idea legally after 1 year and do you still have the right to sue them or its out of date means you are out.
    2-How do you control the company amount of production, lets say you have 5% of the production how do you know they are producing for example 1million items while they are producing 2 million items, how to control the amount of production as your payment depends on it.

      If your PPA expires after one year your invention is in the public domain, you have no right to sue. To give yourself more time you technically have one-year grace period in which to show your product to companies, which then you could file a PPA. So this would give you two years. Second question... Contract/Licensing agreement will have a audit clause, to keep them honest.

    Ok I love your video, I have a patent pending since 8/14 and still waiting, I continue receiving letters of is incorrect and had to break it down to claims and abstract and so on, and more money, honestly you are right is my first Idea i try to patent and is been a roller coaster ride. I am frustrated and want my product out and is impossible to do. No experience so yes is harder for people like me to know what to do with an idea. I have many others but I don't know what to do to get them out in the market, will like some advice if you can. thank you

    So if you license your idea to a company and then they get a patent on it then you can’t license your idea to several companies at once? I’m just wondering if when we talk about licensing that means you can take your idea and approach several different companies and have them all sell it and then all of them will give you your percentage or whatever on the licensing deals for every package of your product that’s sold? Is that how it works? Or once you license it to one company that’s it you’re going to be locked in with that company? Lots of questions sorry about that but if anybody knows I’d appreciate it. I am now about to file for a provisional patent but I am stuck with the description. I looked on Manny patent descriptions it looks so complicated to understand or in my case to write.     Good content 9n the provisional, unfortunately I've found most companies like Nike or Disney, 2 of which I would like to solicite for my product, want utility patents. Any suggestions on how to pitch to these guys on a provisional since I can't afford the 10k on the utility. Like everyone else I think this is a home run idea but funding beyond the provisional and prototype stages hinders me. I've also not had much luck on the soo called angel investor side of things but haven't hit that market hard either. Thanks

    Hi Stephen! I came across this video cause I need some advise how to patent and idea. Im getting my degree in Manufacturing Engineering Technology and for one of our classes we had to work with a local company to provide ideas on how to improve a process. Anyhow, I designed and built and Automated system that was able to cut their production time from 15 mins to only 3 secs. Not only that but with this idea they'll reduce material waste, increase production, reduce effort from the operator, not to mention all the money they're going to save on this process.
    I need an advice on what steps to take to get a patent on this idea, Im not sure where to start since this is my first time doing something like this.

    Hi guys!- A few questions: After filing a PPA, will the USPTO reject other patents that are very similar or nearly identical to your product or invention?
    During the 1 year it is in effect,...Does a PPA give you legal grounds to take action against someone who replicates your product during the one 1 year it is in effect ?
    2) What should be inventor's priorty during the year after PPA is granted?: Marketing /pitching to company's? or finding a low-cost manufacture to produce mass quantities of the item?

    hi I'm from canada , is it the same here to get papa, my i idea is simple no moving parts and is just 1 piece. i am talking to a patent lawyer now. i have had a graphic patent designer do a 10 page lay out of my idea. so do i forget the illustration patent and just do the papa ??     I have a product idea related to icing on electric power lines. I've done a (legally uninformed) 'Bing search' and see some ideas for that but, not really 'my' idea. I do not want to try to make this but, would like to pitch it to a company (or power utility). What I don't want is to pitch the idea and then discover that their claim that it's already their idea (if it's real then it's real...if it's a loophole, I'm a babe in the woods and have no way to fight their claim). How do you give yourself some protection when you pitch it. How much protection would the filing discussed in the video give me? And, what's a good approach if I've gotten the provisional thing?

      Johanna King You don't. There are no formal requirements for a PPA. I suggest you pay someone to do some nice line drawings on a web site like Fiverr.com. This will create a professional appearance for your PPA. -Andrew

    Thanks for the videos, very helpful.I have one question. I have an invention, a new use of an existing product....The problem I have found, no one is selling it but other people have discussed the same thing on an internet forum. Does that mean the invention has already been publicly disclosed and a patent or provisional patent cannot be granted?

      +BradK Yes, that is public disclosure. You may or may not be able to file IP. Are there any aspects of the prior art that can be worked around to carve out your point of uniqueness? Maybe something was missed. IP is always about thinking creatively and strategically. (There aren't any black and whites.)

    Hi guys.I filed a patent over 10 years ago I'm embarrassed to admire this cause I didn't do anything with it due to the high cost of completing the whole process and I've been told by a patent attorney that because it's now in the public domain it's unprotected.Anyway I've been studying an FBA amazon coarse and it got me thinking about my product,it still solves a problem for people even after 10years .I cant find anything like it out there 'google image search' etc.and I've now made more improvements to the product.My question is if I can get it manufactured in China and get the marketing right - Facebook,instagram would it be more profitable to sell it on amazon or hand over to a company and collect royalties? Or I'm I just dreaming? Can you help?

    what happens at the end of the provisional i.e. after a year, are you then obliged to pay for a full patent or can one extend the provisional OR does at least perceived ownership continue in your name after the provisional?

    Great video. We have a great prototype made but we have 2 different forms of it and 3 different sizes. The 2 different forms change the products functioning purposes but it still looks the same. Do you have to file 2 different PPA's in this case or can we just mention the 2 different forms and 3 different sizes? We have engineered drawings of both. Also, you wouldn't recommend any non-disclosure agreements to be signed when presenting it? I know you emphasized perceived ownership (stating patent pending) but just wanted to clarify. Thank you for your time

      You can file both variations in one PPA. You can also file them separately.. So you now have patents pending. Filing strong perceived ownership is extremely important. Read as much as you can.     Great video @inventRightTV! I totally agree, that pursuing litigation is a time consuming energy draining process! I am very new to business, but I went from just reading about it once a day (8 months ago) to weeks from beginning sales of my product.
    I was wondering, if I did not invent a product, but am the first to sell in America and there is no patent for it, should I still patent it?

    After the year expires on a provisional patent, How many more times can you file for it? Is it only a one stop shop?

      TJ, James had a similar question - if you haven't shared your invention with anyone, you can resubmit your PPA. You can also file another PPA if you have made changes to your invention. Again, I'm not an attorney, and I'm not giving legal advice.

    Are used to be a nurse for a man that had a few inventions and he said he talked to a successful inventor and the inventor told him don’t bother with Pat and your design. He said naked, hurry up and make as much money as you can because by the time you pay the attorneys go after Your idea it’s better just hurry up and make money off. People are gonna chase them. That’ll cost you money so it’s better just to get your invention out there and make a ton of money off or whatever you can 😊

    I have no idea what im doing i came up with an idea i email my idea to united patent research i then received a call from a guy who said he would do a patent search for me a couple of days later he called me back saying there is nothing like it on the market and that i could something good he went on to day that it might able to patented in c
    hina and that i would own the patent for 20 year he also said that he had a team of people that would every and that they will walk me through everything and he was send me a kit in the mail and to not fill out anything he would walk me through it i really have no idea whats going on with any of this but after watching your videos i see things a little different can i please get some help or advice with what i should do next please help me some body please help me

    wow your videos are great. I used to have a lot of ideas back in the early 90's late 80's but because of technology wasn't there at that time I couldn't do anything about it One was a magnetic shock for automobiles, the other was a watch locator for children which now is GPS and the other was an automatic lug wrench that held all the lugs in one magazine. I have an idea now that believe will be a big hit based on my last concepts in the past and I'm working on a prototype. Do you think I should go on a show like shark tanks to get notoriety or should I do everything on my own??

      Hi Oja. No. The process Stephen is describing is licensing. When you license an idea, you do not manufacture products yourself. You seek out a relationship with a company that is already in business to see if they are interested in bringing your idea to market for you.
