      I've been in the construction business for fifty years here's how I did it. Example of the contract, customer pays 25% the day the contractor shows up with a substantial amount of materials and Manpower. The customer pays 25% at 50% completion. The customer pays 40% upon completion. 10% is held in escrow for 30 days or until both parties sign off. If your contractor can't perform to the standard don't hire him.

    Bankruptcy to wipe out civil liabilities seems so bogus. If you want to declare bankruptcy, fine, but they should liquidate literally EVERYTHING you own to make the creditors whole again. Abusing bankruptcy like this should be criminal to even attempt. How is it ok to steal $129k from someone just to have the court say "its fine! Don't worry about paying a dime of that back!"

    I think in these situations, instead of having to pay the customer back (since they never do), the law should just have the police should just force them to do all the work promised and paid for at gun point. But do just as much free work. So the scumbag that bailed out on the $29,000 job would be forced to do another $29,000 worth of work (if the customer wanted it) and there would be a 10 year warranty he had to fix for free, rather he liked it or not. Watch how this kinda shit would not happen anymore.

    • @centerice
      @centerice 2 роки тому +4

      GREAT IDEA! That is an IDEAL remedy. It gives the customer the value for which they paid. It keeps another non-dangerous guy out of our absurdly and dangerously overcrowded prisons we are all footing the astronomical bill for, and would, IMHO, return some self-esteem and personal empowerment to Felons, a vast majority of whom want to be able to stand on their own feet, but are TRULY against nearly insurmountable hurdles when they get out of Prison. Your idea benefits every party involved!!! Take that idea to your local government! I do not think your idea is really that far-fetched. Seriously, Andrew, you may actually change our society.

    “Country Trust…Goes Country Bust.”
    This is so true. I moved from Honolulu to a small town in Alabama. Only about 15k people. I live in a fairly nice place for the area but wanted some changes and upgrades made. So I used the contract who I saw working on the neighbors house which is even nicer than mine. I figured if he had been bad.. they would have fired him long time ago.
    Well, that is the last time I try going with “Country Trust,” every job that he did was sub par, from the garage floor pealing in less than 2 weeks to the attic doors being uneven and unpainted. It also took 11 months and he always treated my job like an afterthought to any work he did on the neighbors house. After giving him so much time and hearing sob story after sob story… I finally had to bust out the legalleze on him and threaten to sue him if he did not finish the jobs he was paid for. That got him to do a half ass job “finishing” the work, but honestly I just wanted closure one way or the other rather than being pissed off every time he would pass my house to work on the neighbors house and just leave without saying anything or working on my place.
    I can definitely understand, doing a little Country trust in a small town where you literally only have just a few options. But NEVER AGAIN!!!
    Worse part… I was at the neighbors 4th of July party… and we were all playing cards on the back covered deck and it started raining and the roof started leaking (N this is in a very nice lakehouse) and the neighbor said “aww that good old Br{+^’s work for ya!!!” And every started laughing. Then he was like aw I saw he did some work for you and he asked how that turned out…
    My literally response was …”no comment” and every one started laughing even louder… then I asked if he was family? They all said no and then started saying that they have all had work done by him and it was bad or their husband had to go back and fix things after he was done. I was shocked and angry and blown away… Why Would every one have used him if everyone knows he is so bad!!!! Either country politeness or literally very few choices due to it being a small town.. either way he traumatized me and I have zero Country trust left in me for contractors in a small town.

  • @centerice
    @centerice 2 роки тому +5

    The common thread in most of these corrupt contractor stories, is that these guys cannot get other, plain vanilla, "punch a time clock" style jobs. They really do have great difficulty getting hired. He mentioned Home Depot for example. Home Depot participates in the "ban the box" program whereby they do not have any question on their application about previous criminal convictions. However, they will ask about it verbally in the interview and then oftentimes not hire the applicant. So with such difficulty surviving once a felony is on your record, these individuals frequently end up depressed, back on drugs, back inside the bottle, and can't get it together. With almost no options, they experience overwhelming temptation to return to crime to survive. This is a societal problem, and we should look eastward to Europe for advice and suggestions because their system functions MUCH better for their society.

    She hired him to do 1 simple job
    To order top soil worth of 300$ and when delivery will come of top soil. All the holes on her yard needed to be filled. He took 300$ up front for top soil. And for job she was supposed to pay him 300$.
    He showed up next day and said top soil will arrive next day in the morning.
    Next morning he showed up at her house while waiting for top soil he asked her to give him other half of the money. I don’t why the hell she gave him the money. But she did. He hang out outside for an hour waited till she went inside just for 1 sec and disappeared. When I text him and ask him why did he left. He said he got to pick up a trailer for no reason. Then his trailer got flat tire. That moment I knew she got scammed. ( btw I wasn’t there at the time. I was at work. She called me and told what have happened)
    Later I found out that he was her friend’s son. I went to police station filled out paperwork. And now they looking for his ars lol. He begged me not to press charges. But I can’t do that. If conned my old mother and she was his mothers friend that means he will/did conned some one else.

      Well people here aren't exactly helping themselves. No one thought to ask for contractors licence or refused him work when he couldn't produce it. Second, every time I've employed a contractor who come onto my land to carry out work I want to sight and take a copy of their ID - 99% of the time that a drivers licence - that a requirement often of a lot of home insurance polices in case there's an accident or something. Running a criminal check on someone isn't hard, and hell if you put this guys name into a basic google search it highly likely so many red flag warnings would show up.
      The big issue is I suspect the guys quoting massively less than the legit, legal and competent contractors in the area, quote and the clients just get blinded by the so called "savings" they will make and so don't take account of huge risk they are running.
      Its the old saying, when its too good to be true... it isn't true.
      A Cheap job isn't very often a good job.

    After seeing so many videos like this one of Rob checking these guys out, at this point I think the first question you need to ask to sort out shady contractors in Michigan is "Do you have a valid drivers license?" before you even mention a contracting license.

      What happened is they likely have a legal lien on the guys property (house, vehicles any equipment) so if he try to transfer, sell or mortgage it the debt has to be settled first. I'm pretty sure one of the documents shown with $129k figure was an approved lien issued against the guy. There a difference between not having any physical contact and getting the legal systems to enforce a debt. The people owed the large amount have done everything correctly by look of it.

    The guy is a rip-off artist but that doesn't excuse customers allowing themselves to be ripped off like this. Here's how I did it for 40 years successfully. The customer pays 25% when I show up with a substantial amount of the materials and Manpower. The customer pays 25% when the job is 50% complete. The customer pays 40% upon completion. 10% is held in escrow until both parties sign off. If your contractor cannot perform to this standard don't hire him. Never pay in advance for services not yet rendered!. Stop getting yourself ripped off oh, it makes it really hard on honest contractors.

    whats the point on going to court and winning a judgement if the other person is still not gonna pay. the courts should have access to your bank account and award the money to the winning party, and if that person doesnt have the money the court can sell ur assets to cover the cost
