Someone should have to pick up any attorney's fees she generates as well. Just getting dismissed from a lawsuit where you're not at fault can cost you $5K and this is in Hawaii, so she may have to travel to appear...
Still needs to be named so a judge can fix it she’ll get whatever she paid in taxes back and how much it would cost to return the lot to original

Correct cause.. the county inspector would of had to inspect the construction of this house multiple times. During different phases of construction.

And it would of bin inspected by county inspector multiple times throughout the build phases... if they can spot a missing nail.. or wrong type of nail in any given piece of required hardware.. wich they can.. they most certainly would of noticed the error. The developer did not want to pay for a surveyor, this is the stupidest part of this.
A survey would have cost a few hundred dollars. This will end up costing a several hundred thousand.
The property had to be mapped with an APN, so no survey needed. Survey would helped. Whoever pulled the permit and issued the permit are at fault, possibly along with whoever drew the plans. The developer has no choice but to let a judge figure it out since no one willing to settle.

@@richardnassano623 So, was the wrong APN supplied by the developer or did the contractor build on the wrong lot? That should be sufficient to determine who was at fault. Even if the contractor blew it, I should think the developer might have some due diligence to ensure that the work was being done properly. I should hope that the developer is found responsible for any costs the landowner incurs because of the suit.

I'm more concerned about the agent, he sold the house knowing the developers didn't own the land. That's a straight forward case of fraud.

I've seen this before. They sue, actually, as a measure to preemptively make a determination. That determination then will force a chain of other activities, like insurance claims, etcetera. If the plaintiffs have to wait for another party to initiate a lawsuit, then things may drag on. And this may mess with their bottom line, because the construction was probably leveraged with daily compounding interest. So, they basically sue to get out of limbo.
That's what happens when they double down on their mistake and will now lose the whole thing.

How can one build without a survey. The county approved the building permits without verification of ownership. Sue the building department for negligence also.

On the blueprints the property line is clearly displayed and that’s why we always hire a surveyor. They wanted to save $2,400 😂😂 now they took a 500k hit and the costs keeps rising
Exactly! Everyone who works in Real Estate (as a professional) knows that you need a survey and title search done. It is literally the first thing that they teach you. This company tried to save the upfront money and now it is going to bite them.

If someone has a title and applies for permits to build on that property, there really isn't anything for the county or municipality to do. Building inspectors are going to inspect the house that is where they are told to look - and if it's the only house where they are looking, they aren't going to bother looking for other houses.
It’s not HER mistake…and she shouldn’t have to pay for anything. The construction company should have to remove the house and pay her money for the damage caused to her once beautiful property.
They are pressuring her, she either agrees to something or she has to pay an attorney tens of thousands of dollars to represent her and she will get 0 dollars for fees and costs. Hopefully she has title insurance, that may come to play as they have to defend her ownership of the lot.

It probably would cost more money to move the house or tear it down then it's worth probably, I would say it's built on a concrete pad. Probably be cheaper just to give it to her. If they tear it down they have to haul it off to a landfill and then fix the lot. Would cost thousands of dollars.
Whomever approved to build on her land is the one at fault and I hope she gets everything back as she deserves. You guys just tarnished your reputations. This is one unbelievable screw-up.
Can't say Hawaii does this, however most jurisdictions don't send a survey crew out to establish the plot of land is actually owned by the person applying for the permit. It's a simple, are the plans stamped by a PE, and that the structure doesn't exceed "X" size for the plot of land.Oh, and give us money.
The judge can't order the woman to sell or swap the property as she has a deed. The builder will make a sweetheart deal to have her take the house, otherwise, it's coming down. The builder is also going to eat the increase in the tax bill until this is resolved, otherwise "lightning" will strike the structure. Oh, and the builder will be required to restore the property back to pre-build condition.

I've seen permits issued before that after the completion of the job, it was found that the house was too close to the property line. Plans were approved showing the exact location, but government screwed the pooch, and required the house to be torn down.
The family that relied on the approved plan, ended up having to remove the offending encroachment. Government worker, was just fine.
@@hughjaanus6680 I wouldn't think so, if I or a contractor go down to get a permit to build something on my land then it's all good it's not the counties or cities fault they just issue a permit just as if you were just going to build a deck or porch, so that's the builders fault!
If they let the developer win any part of this it will send a signal that all developers need to do in the future is just find the lot they like and build on it.
Remove the house, grade it back to what it was and plant replacement trees. Make her whole.
No the best thing would be to let her keep the house. That probably would be the cheapest for the builder and she could use the house for her project for free. But she needs to pay those taxes that proves ownership.

I’m guessing there is something that hasn’t come out yet about the lot next door that they wanted to give her instead of fixing the problem. Otherwise why don’t they just jack up the house and move it next door.

Was there no title guarantee company? She should take the developer for all they got for lying and trying to strong arm her.

If the land owner doesn’t want the house there then the developer needs to remove the house and restore the land to a state satisfactory to the land owner. I’m no lawyer but if somebody builds on your land, you own whatever is built and can keep it, sell it or burn it at your discretion. It’s not her fault so she should bear no responsibility. I would counter sue those idiots for harassment.

If I was her, Id sue for the cost to return the property to its pre home state (including trees, bushes, etc) than sue for that, plus interest, plus costs of property tax increases over a couple of years, plus cleaning and upgrades like fencing and cleaning from the people who squatted, and lawyers fees, and some pain and suffering as well.
Keep the free house and sell it. She will make more than she would with her guru scam.

No, not required. My client's father has a similar situation but in California. He contracted a company to build a house. The contractor put the house on the wrong lot. A big difference is the other property owner lives in the area and watched the home built. After the house was complete the other property owner contact my client's father to say he gets to keep the house.
If - as reported - this is a numbered lot within a subdivision, there was almost certainly a survey done when the land was subdivided. The developer and builders evidently were quite careless about checking existing record before starting work. They deserve what they're gonna get (read: lose).
There is no unravelling. She now owns a brand new home or the developer makes the property whole again with penalties for damages.
The should remove the building & replant what they removed.
The developer should have to pay to refund whoever the house was "sold" to, demolish the house, and replace trees and foliage to return the lot to the condition it was in before they bulldozed it - with the property owner's video as evidence of what condition the lot must be restored to, as well as pay any and all court costs and attorney's fees arising from this incident (some of which will be from the people who purchased the illegally-built house) AND punitive damages to the property owner. The developer should then be subject to sanctions levied by whatever professional licensing board(s) cover their activities. End of.

Can the county also be blamed for not checking if it was built on the lot specified in the permit? It's a big mess they all should have settled out of court.

The county inspector isn’t responsible for this screw up. Their job and only job is to make sure all build codes is followed. The builder or the realtor is at fault. Personally I blame the builders. I’ve been doing construction for 19 years and 10 of the 19 years on the big island. Built 150 homes for Hawaiian homes. We hired a surveyor for all 150 lots. The onus is on the builder to make sure we’re building on the right property.

They never do... County finaled a home in Volcano Golf & Country Club that was not only IN the set backs but just feet from the property line. It's on the owner and if the next person has a survey done, THEN they find out and the owner has to go back to the county to beg for a variance

"Wrong lot" incidents hare part of Puna's history. The lots are so narrow and the streets are so long, it's easy to find yourself close, but not on the lot you want to be. I've seen cases where the owner/developer finds the right stakes in the front of the property, but gets one stake off on the backside, resulting in property being developed and built on, "half on, half off" the correct lot. This is by no means a unique case. I'm surprised there isn't an established court remedy by now.

She should charge the builder monthly rent. Also, have you ever heard of tree laws? People that intentionally cut down their neighbors trees to get a better view can be liable for the cost to replace them at the mature price which can be tens of thousands per tree.
Also, it's not the county building departments job to determine whether or not the lot is the appropriate lot. Their job is only to review the plans and insure that they are up to code.

I don’t know law but I have a a strong belief in what I believe is right or wrong. This should have taken about 10 minutes in any court with the judge saying anything she wants let her have it’s the incompetence of the builder and the land should have home removed property replanted to original and any monies she had to spend repaid to her including lawyers fees extra taxes. So the owner has every right to have the house demolished. After all, it's HER land. That would settle that problem real fast and leave those developers in a big bind, then, her property taxes would go back down. 😊
Demolished and the costs billed to the developer. And then turn the landscapers loose to return it to the original condition. And the developer is also billed for expenses, fencing and taxes to start with.
Or, the developer cuts her a check for 375k. No strings. And that breaks down to 250k for the land and 125k for paying the income taxes and expenses.

UNDO what’s done! The landowner doesn’t want to sell, doesn’t want the stupid house there. The developer/builders fxxked up, they should have insurance to cover this mistake. The landowner should sue for the damage in time and stress this caused. Also, her property tax bill went from few hundred to thousands bc of this unwanted “improvement” on her land! This is an expense that she will have to pay for as long as she owns the property. She needs to be made whole!!!!!!

What happened to the idea of "Company Due Diligence", the neglect of actually reading building permits & consents or just doing their jobs right is unbelievable, it just goes to show that EVERYONE involved was just concerned about doing the absolute minimum amount of work they were required to do them she gets hit with the bygone company philosophy of "Quality & Satisfaction Guaranteed" as none of this is evident in the "Not Our Fault" responses. Even when it is resolved she has lost the 'Land' she wanted with all the 'Spiritual' valve destroyed by the bulldozing of the section.
The builder & developer need to remove the house, return the land to its natural vegetation, and pay the increase on the property tax PLUs this poor woman's attorney fees and other costs. She should not be responsible for their incompetence.
The developers the architectures the engineers all failed to appropriately create plans accordingly to code
They did not utilize survey markers to divide property lines for accurate development
The landowner is at zero liability and someone needs to pay up, but I guarantee it will not be her

She needs to stop paying taxes, change her phone #, address, and only let her lawyer know her wherabouts. She'll lose her property to back taxes. Then not pay her lawyer.

Owner is only at fault if they know it's happening during the process and say nothing.

They need to remove the house and replant the property to her specifications as well as pay all of her attorney fees and whatever a jury or experts determine she is owed for the damage to her original land. Fact and bottom line . Either that or be forced to buy the lot at its original native forested value as well as emotional bs values.
At the end it should be the developer who should pay for this stuff-up.
