      All that these verdicts prove is that Trump is the cleanest businessman in NY history. Show me another major businessman that has a multi decade career in NY and not a long list of serious crimes and violations!

      I am also not a lawyer - but I do have access to a good former Professor of Harvard at the Dershow!
      Malicious prosecution refers to the filing of a lawsuit for an improper purpose, without proper grounds or probable cause. This can occur in either civil or criminal cases. To address an act of malicious prosecution, an alleged victim can file a malicious prosecution action. In California, for instance, to prove malicious prosecution, the plaintiff must demonstrate the following elements:
      1. The defendant actively participated in bringing or continuing the lawsuit.
      2. The lawsuit ended in the plaintiff’s favor.
      3. No reasonable person in the defendant’s circumstances would have believed there were reasonable grounds to bring the lawsuit against the plaintiff.
      4. The defendant acted primarily for a purpose other than succeeding on the merits of the claim.
      5. The plaintiff suffered harm.
      6. The defendant’s conduct was a substantial factor in causing the plaintiff’s harm.
      Keep in mind that malicious prosecution is a civil action, and the remedy typically involves damages for the consequences of the previous legal action. While there is no federal cause of action for malicious prosecution, it can still be pursued under state tort claims in federal cases. Some jurisdictions use the term “malicious prosecution” for both prior criminal and civil proceedings, while others differentiate it from “vexatious litigation,” which is based on prior civil proceedings.
      Perverting the course of justice is a common-law offense, which means its origins are based on case law rather than statute.
      In the United States, the concept is more broadly covered by the offense of obstruction of justice.
      Obstruction of justice encompasses various acts that unduly influence, impede, or interfere with the justice system. These acts may include perjury, making false statements to officials, witness tampering, jury tampering, destruction of evidence, and more.
      We suspect that Cohen perjured himself in the case. We also know that the Judge refused to allow the FEC official to give exculpatory evidence which would have removed any attempt to conjoin the misdemeanors with a Federal Elections violation in violation of President Trump's 6th Amendment Rights.
      We know that Jack Smith tampered with evidence. We also know that the Obama PITC memo which Jack Smith was aware of means that President Trump could not have been indicted for destroying evidence as it was all recorded by the DoD.

      Medical schools in America teach that addiction is a symptom of PTSD. Dr. Lonny Shavelson in his book "Heroin" said that 70% of female heroin addicts had been sexually abused in childhood.       I agree. Especially given the Supremacy Clause and Article II section 2 where presidents have unlimited pardon power over federal crimes.
      So all a state now has to do to undermine those 2 federal constitutional concepts is to steal jurisdiction from the federal government stick it into a state statute as an “element” of the “state crime” thereby nullifying concepts such as supremacy m or preemption or even to remove what is supposed to be the “unlimited power” of a president to pardon a federal crime.
      So a president can pardon a federal criminal conviction under federal election law but if a state uses that federal law as a jury instruction instead of its legislature creating a “state crime” then suddenly the president’s power is no longer unlimited?
      Makes absolutely no logical sense
      The Supreme Court must step in to stop the slippery slope of states trying to undermine supremacy or preemption by absurd acts such as just sticking federal laws in jury instructions as a new unnoticed element to support conviction 🙄
      It’s such a Gordian knot. It would be hard to stay within the page restrictions on the briefs…

    I'm a small internet merchant. Over the years, about 12% of my business has been with New Yorkers. Recently, I've watched the New York legal system descend to Third World standards. Because New York now makes up the rules as they go along, I can no longer trust New Yorkers. You people are dangerous. I will no longer do retail business with citizens of that state. I've moved my bank and retirement accounts from New York institutions. Hopefully, what passes for New York jurisprudence can't reach me if I remain totally hands-off with the state.

    I understand how the Supreme Court doesn’t like to get involved in politics. We are not talking about politics here. We are talking about how 1 judge, 12 jurors and one DA can hold America hostage and potentially decide the outcome of an election. Okay , if this were not a fabricated crime, and it was concrete that he committed a crime, I wouldn’t feel this way. But I say if the highest court in the land is going to let this stand, then I don’t even want us to have a system. Because the system they are creating is not one I want to be a part of.

    I was a banker (late 1960 through 1970s) in dealing mostly in jumbo loans with the then 3rd largest American bank. I cannot remember any loan application where I and/or the appraisal department agreed with the customer stated asset values. The responsibility for valuation lies with the loan officer. Also the bank did not let the loan officer off the hook if he took the bank's own appraisal department's value which turned out to be wrong.

    Merchan's jury instructions:
    "Under our law, although the People must prove an intent
    to commit another crime or to aid or conceal the commission
    thereof, they need not prove that the other crime was in fact
    committed, aided, or concealed."
    So, prosecutors were able to hold Trump liable for federal election law violations without having to prove it. Ordinarily 175.10 is filed with a charge of the underlying crime but in this case it wasn't so (1) Bragg didn't have to prove the underlying crime and (2) FECA is outside his jurisdiction. This ruling must be repealed, and in fact this statute revised. It should be elevated to a felony only when coupled with some other provable crime. Otherwise the defendant is being punished for a crime that they are otherwise innocent (in this case FECA). The fact that this obscure statute was used to convict a former POTUS is inexcusable. Bragg/Merhcan should be disbarred.

    Professor Dershowitz, when hearing you point out the injustice of the charges against Trump, the thought came to mind of John Adams' defense of the British soldiers on trial for the Boston massacre. Namely, the legal principles of equal justice under the law, due process, and the right of the accused to a fair trial. Adams stood up for these principles, and defended the British soldiers charged with murder at some risk to himself.
    I see you as defending our legal system and constitutional rights, regardless of whether the abuse of the law is directed against Trump or another. For that, you deserve the thanks of all Americans, but you also suffer the blame of many who can't see past their partisan political interests.

      Guaranteed he motions for prison. Merchan has no choice now but to take this "all they way" for his supporters. Merchan now must "be right." He won't be able to reason at this point as he has already done "unreason" throughout the trial. It would make no sense to go back to reason. This is generally how the "human mind" operates and will do anything to prevent wrongness as wrongness is a harmonic of death in fact. Ultimate wrongness would be death at the bottom of a scale of right and wrong. So, I agree. He will sentence to prison and will also work to prevent appeal and has probably already telephoned the appealate court justices some. Must have.

    Supreme Court is dropping the ball here. Supreme Court should step in and deal with a heavy hand to uphold USA Judicial System. Restoring USA Citizens confidence that the Judicial system works as their forefathers intended. How many more frivolous cases before too much is too much. I am disgusted.

    Bragg started with a misdemeanor that didn't happen, then bumped it up to a felony by claiming the misdemeanor was carried out to conceal a crime that Bragg only intimated and never specified. One of the possible unspecified crimes Bragg suggested, and the one the prosecution seemed to settle on as their favored accusation (involving a violation of New York State election law) is itself only a crime if it is connected to another crime, and the prosecution were entitely silent about what this unspecified third crime was meant to have been. There, have i understood it correctly?

    How the judge could sit there and not dismiss this case is easy to see, in my opinion. It is to protect his daughter. I have no doubt that if the judge had done what is right and went against the DA then his daughter would never work in D.C. again. It would explain his moodiness too. His guilt and inner conflict were perhaps causing him to sabotage his own proceedings?

      Don’t think it’s to,protect the daughter, if that’s the case, he could excuse himself from the case. the judge was hand picked to find Trump guilty based on the feed backs of those in the court daily that the judge was unfair , pro prosecution by sustaining lots of objections n denied defence witness.

    Alan is making money here while being morally and ethically conflicted with his political support. He has cognitive dissonance with identifying and rejecting democrat corruption, while continuing to politically support it “ideologically” as if he can just pick and choose what the democrat party represents and still remain honorable.     Cyrus Vance a former NY DA doesn’t think the trial was fair but publicly stated that the underlying crime under NY law in cases like this doesn’t have to have actually been committed. Vance said that the intent of the law was not to be used like in the Trump case but was to be used in cases when a burglar breaks into someplace and is caught before being able to get away with their intended theft. The law used against Trump is then applied to assume the burglar had intended to commit theft or worse. Thus turning one crime of breaking and entering into multiple crimes, I.e., grand larceny, attempted extortion, etc. Essentially Vance was saying the law used to “get Trump” by Alvin Bragg was bastardized and contorted for other than its intended purpose.

      That's a good explanation of how they managed to get him, but the thing is that New York has two different laws pertaining to the Falsification of business records: 2nd degree charge which is a Class A misdemeanor and then a 1st degree charge which is the Class E felony. The Class E being the one with the added caveat of needing to have that intent to commit or hide another crime. Why does NY have that Class E and has it ever been used prior to the Trump case?

      Sounds like a bad law. Essentially you could say that a speeding drive was speeding in order to distance himself from the scene of crime without the necessity of even showing a crime took place. I guess this what happens to black Americans.

    Alan, I tell why the judge did not dismiss this case. Because they (the democrats) do this bluntly, for political purposes, and even distinguish professors/attorneys LIKE YOU ARE STILL VOTING DEMOCRAT. All the other reasons that make you vote Democrat (abortion, gun rights, etc) SHOULD SUCCUMB in face of these dangerous attacks to our democracy! By continuing to vote Democrat, you and Democrats like you) convey the idea that this is not as dangerous as it may seem.

    I think this is a problem with the legal system. It's too easy to live by "show me the man and I'll find you the crime." It's worse when they come out and say they will do this. Once you believe that's okay, you can fabricate said crimes.
    This is probably an unpopular opinion, but…one could argue this is not remotely new. It's probably happened to minorities throughout this government's tenure, and it seems to have happened to Al Capone. In my mind, the fact that it was acceptable for Al Capone's conviction made it acceptable for others. It really is emblematic of the old maxim that 10 guilty man should go free such that 1 innocent man not be found guilty.
    Now we reap the fruits of allowing the ends to justify the means.
    Perhaps the biggest defect in the constitution is the lack of provision to punish the politicians and bureaucrats effectively for corruption.
    PS: I'm thankful we have people with integrity such as Alan Dershowitz, who are willing to cite the truth, even when it favors those who are not his favorite people (to say the least.)
