Can you explain when evidence is admissible in a civil custody case if it was never shown in the first trial (domestic violence charges against parent to the other parent) Even though it’s evidence dated before the date of the last order, can it be admissible if it’s showing a pattern of behavior, danger of a child and behavior is continuing.
Can you tell me when the Brady violation stands in a dv case where the witnesses lied so much that we demanded the video surveillance but the surveillance only shows the husband slapping wife once and the rest of the video where the wife was hitting husband was completely missing from the video that was received we are in trial waiting to be seen right now as I text please somebody help just need advice pkease😢
Hello I really hope that you can take the time to answer a few questions or basically lead me in the direction as to how to handle defending against domestic violence between husband and wife where there were no physical injuries at all the wife never said that her husband hit her but two witnesses gave corroborating statements that video evidence proves that their statements were completely made up and exaggerated but the problem with this case is that the public defender is doing nothing and has been telling my friends that he’s guilty and to just take a deal when the PD got the video and finally watched it he was like it was nearly as bad as the witnesses made it out to be but he keeps stopping hisself from completing his comments meaning he knows the man is innocent and he’s not doing anything to show that the wife was assaulting him and that he never even put hands on her he got in her face and put his hand around her neck for about 3 secs and the PD says that they’re not budging on his sentencing that he has to take 52 weeks of domestic violence classes pay fines lose gun rights etc for something that should never have happened if it weren’t for those statements they would’ve never taken him to jail! Please please anyone that reads Thai if you can help me they go back to court on the 19th if this month the day after tomorrow
