    Brian... your videos are great and informative... My priest said something awesome this weekend when I was talking to him... Asked him what he thought of gay marriage and he said "two people of any sex, committed to each other can only strengthen marriage... divorce is the only thing that destroys it." I was so proud to hear someone within that institution say that. Maybe there is hope even there. Great Vid!

    I feel you on the 2-hour commute. I also commute 2 hours every day to work. It's rough, but fortunately I take a train most of the way so I can sleep or read a book or whatever.

    I for sure hope that you are right about Florida. As I live here and it affects not only my life but the lives of many of my friends. I think that we need to get rid of a lot of our current government first.

    In this scenario, the previous ruling on Prop 8 made by a lower federal court would be upheld, meaning Prop 8 is overturned.
    In any case, great video, Brian. Looking forward to more vlogs on interesting topics this month.

    Hope and empathy from Canada. I've never fully understood (and still don't) how your government works. I find it conflicting how they claim to be the leaders of the civilized world and yet they fail to adopt basic human rights equally for everyone. Chin up though, it sucks you have to struggle, but you'll get there! Times keep changing and thanks to Vloggers like you, Dan, Davy, Russ & Matt, and all the others awareness and acceptance will keep growing for you guys :)

    Thanks for making this video, Brian! So many people I've discussed this topic with have a misunderstanding of the basic facts and I'm glad you presented them unbiasedly. I live in California and I've found that the conversations I've had with people in the past few years about gay marriage have been more favorable than not, which reflects the bit you said about how the "tide is changing" (and thank God!). I think those who actively oppose gay marriage are fighting a battle that's already won! :)

    The only thing I think you did not mention in your options for the rulings on Prop 8 is that the SCOTUS may rule that the people appealing the case lack standing to appeal the case, which brings all kinds of options into the mix that will be further down the road.

    I got married to my husband in San Francisco in 2008 before Prop 8 was passed and was heartbroken when it came to be.

    Well done for an informative video. Very interesting for those of us across the pond in the UK. The tide also seems to have turned for same sex marriage here as well after our MPs voted in favour of the change in the law. We should be able to get married at some point in 2014! Its interesting to see this trend emerging in the western world as a whole.

    The thing is, the Supreme Court would be upholding the decision of the Ninth Circuit Court in your predicted scenario-so it would potentially have an effect on the states which are under the ninth circuit's jurisdiction (if a state in the ninth circuit enacts civil unions).

    @mochatmh i agree with you on the most likely outcome plus this will allow justice Kennedy and possibly Roberts to toss the case without setting precedence. they can rule it unconstitutional with the only applying to California by rolling the proposition is unconstitutional for marriage issues and can only be enacted by state legislation and governors signature or though state constitutional amendment. this would only effect California and north Carolina.

    In Prop. 8, the scope of the case is just the proposition so it would only affect California. The constitutionality of the proposition would have implications for other states, but it would never make marriage equality the law of the land.

    This past January, my now husband and I were married in Rochester, New York, however, we live in Ohio, which of course has its own DOMA law. Well, I am praying that I am praying, that if federal DOMA is lifted, that our legal NY marriage will still qualify us for Federal benefits. This is a possibility, but it is also dependent on how the Supreme Court rules. Despite DOMA, I was able to use our marriage certificate to have my last name legally changed as I took his name.

    Yeah, you're probably right. I have a feeling the Court won't want to actually rule on marriage equality because then you'd have to assume they would have to enforce the ruling across all states which they're clearly hesitant to do. But if like you say, they'll both be struck down (the prop 8 case reaffirming the lower court's decision) it'll have the same effect as I predicted in the video. I was tired, I forgot the whole jurisdictional part of it.

    I'm so glad we're finally getting somewhere with marriage equality in this country. I live in NJ and did Youth in Government my junior year and it was scary how many people my age opposed same-sex marriage. Most of the times for made up reasons. I kid you not "Rome fell out of power because of homosexuals". Yea real argument that was used by a otherwise intelligent person. Great seeing you doing VEDA! Your schedule sounds crazy, but live seeing that you're dedicated :)

    The Supreme Court could still abstain from ruling on the Prop 8 case based on the fact the presenters had no standing to bring the case. They sure dwelled on that point during the arguments.

    In Puerto Rico we have the same debate, as part of E.U.A. for many years, any decition made by the E.U. Supreme Court is gonna impact in us as well. The opinion from the people is not what really matters. Here we have exactly the same system. We also have our own Supreme Court, but let me said that our Supreme Court do not have more " power " than the E.U. Supreme Court. Is just like any state. NO MATTER WHAT OUR GOVERMENT OR HOUSE OF REPRESENTATIVE OR SENATE RULES, The U.S.A. Supreme Court..

    Very good info, my wife and I did an equality video (two parts due to a snafu with transferring video) and we're still new to youtube as well, it's all good.     There is actually 5 ways prop 8 can be decided not 3. The 3 you mentioned along with they can rule that the people bringing the case aka the pro prop 8 people have no standing to bring the case which would dismiss the case on grounds but not find it unconstitutional but would leave the appeals court ruling that it is so therefore allowing marriage.. but when California gets a republican governor they can take the case back with proper standing and prop 8 can be reinstated.

    Hi Brian, i think i found a loophole in "marriage." Generally in America a marriage is conducted by a Christian officiant. But say someone was of a different religion and wanted to have their own officiant conduct their marriage. To put this in my situation: Buddhism views on gays is entirely up to how monks want to teach that subject. And to put that in a marriage situation: The thought of a gay wedding would have to be brought to the attention of a monk if he wanted to conduct it or not.

    According to the full faith and credit clause, part of the US constitution, it is unconstitutional for our "legal marriage" from NY not to be honored in OH. If the US Supreme Court allows us to marry in a state where it is legal, and still gain access to the federal benefits regardless of which state we reside in, there will be countless gay Americans running to those states where marriage is legal....

    Ultimately this is the most likely outcome. You only have to have 4 judges to accept the case but if the other 5 after arguments say the case should've never been granted on standing it will be tossed. This will allow marriage in only California without making a precedence for a future case. The last option is they can find the law unconditional for based on equal protection of separate not equal as California still allowed civil unions.

    The word you are looking for, in regards to religion, and "unions" is Matrimony. Holy Matrimony is the religious joining of two people (generally a male and a female). Marriage, is the Civil contract joining two people (also, generally a male and female, but as is evident now, THAT is changing.)

    Be honest, but gentle. You love who you love, and you shouldn't be coerced into anything you don't feel. Explain that you care for him, as a friend, but just don't see him in that way. If he's a good friend, he'll understand, and it will make your friendship stronger. If not, you'll be better off w/o him in your life. Neither of you need that kind of drama.     Many are not lead by a church leader. A judge can marry, justice of the peace, even a ship captain at sea. Proponents of same sex marriage pretty much unanimously agree that religious leaders would never be forced to perform marriages that are against his or her faith. Christians and Buddhists would be free to continue their same practices uninterrupted. Besides, as an atheist, I didn't want a priest presiding over my marriage anyway.

    I also could make the argument that NOT allowing marriage equality is a violation of a religion which accepts it, If Buddhists believe gas should be allowed the marry and the government says we can not, that is discrimination.
    The bottom line is, marriage is a CIVIL non secular contract, If a priest performs a ceremony it does NOT make it a legal marriage until they are licensed by the state.

    The 1st amendment to the US Constitution specifically prohibits the government from passing any law respecting religion. In 1947 the Supreme Court ruled that this applied to States as well. So while the argument against same-sex marriage is largely driven by the religion right and their discomfort with the idea of two guys pounding each other, they can't legally argue that. Instead they use BS rhetoric like "marriage is an institution to create children" which is obviously nonsense.

    Minority rights shouldn't be up to discussion by the general population. All these ballot questions about whether gays should be "allowed" to marry are appalling. It's like I wake up tomorrow and want to debate whether Jews should be allowed to use the same toilets as Gentiles. Let's have a referendum about that!
