      This video is misleading. Police do not have the same immunity as states and judges, which is absolute. Qualified immunity is necessary for police and police and municipalities can be sued. This video is misleading.

      They don't have Qualified Immunity and/or Absolute Immunity when they started violating a person's Rights BEFORE they became a Police Officer, Judges, etc. They don't have Qualified Immunity and/or Absolute Immunity when they willfully, knowingly and intentionally ILLEGALLY gain their Positions of Authorities through Fraud and Nepotism, which has in fact, happened. Qualified Immunity and/or Absolute Immunity shouldn't exist. Constitutional violations are harder to prosecute, but not impossible.

      That's why it baffles me that we still have governments. But that's what happens when you deal with humans. Very limited brain capacity, therefore they can't see another way. Governments do no work, but let's keep giving them more and more of our money & power.

      Government officials/public servants are still citizens and need to be held accountable for their crimes. Only criminals need qualified immunity. If you're not breaking the law, the law will protect you.

      Stare & Federal legislators need to do this, again, the legislators are failing to do their jobs and people sit home, watch TV and do nothing. People need to demand this from their representatives. The court just enforce laws. Laws must be determined to be unconstitutional, and it can take decades to get to the Supreme Court, if ever.

    Anyone in government, whether a cop, judge, prosecutor, mayor, or any public official, needs to be punished whenever they break the law, abuse the powers of their office or commit any act that would get the average citizen fined, imprisoned or punished in any way. They should lose their jobs and be barred from ever holding a public service position. They should face the same punishment as any other American would face.

    If the Constitution was actually 'The Supreme Law of the Land' as we were taught growing up, there would be penalties for any government agent who violated it. At this point in our history, it is just another old piece of paper in a museum. Very sad...

    18 USC 242 Deprivation of Rights allows you to file criminal charges against any government official who Deprived you of a Right. there's no immunity from criminal charges only lawsuits.

    Government officials should be held to a much higher standard! Instead, they protect each other, and make laws to protect themselves even more, so they pretty much can do whatever they want, and it's still we the people that pay the price. How convenient.

      The road to where we are started about 40 years before the USSR even existed. It actually started with the civil war and ramped into full gear after. Congress debated on doing something to expand the power of the federal government after the civil war. Since that power was limited by The Constitution, this means they literally debated on how to violate it and it's on Congressional record. The thing I left out was that they were debating on creating the DOJ. Some crafty politicians had realized they needed to write laws in order to create power, and they needed people to prosecute those laws. The US Marshalls wouldn't do it, so they used Secret Service agents for the LE side of things for about 10 years. Then, they created the FBI to provide the armed services necessary to properly violate our rights. The way they promoted acceptance of violation of our rights on a local level wasn't much better. They did things like glorify brutal murderers like Wyatt Earpe and his friends. Of course they had dirty judges willing to let their buddies and political allies get away with crimes.

    I came from the Soviet Union too and boy was I surprised when I realized that a village ordinance can override Constitutional rights. Even more surprising was the fact that everybody seemed to be okay with creating laws that fly in the face of the most sacred document in the nation.

      An ordinance is a local law adopted with all the legal formality of a statute. The STATE Constitution allows a county or city to make and enforce within its limits all local, police, sanitary, and other ordinances and regulations that do NOT conflict with the state's own general laws.

    The problem is that this is a good intention gone off the rails, and an honest mistake is generally forgivable and should be something we permit our government officials to do, because after all they are only human. But so many of these cases are cases where the officials should have known better or should have taken additional steps to ensure they were doing things correctly and this seems more like willful or reckless behavior instead of simply an honest mistake.
    This kind of behavior should not be so readily forgiven

      Honest mistakes are one thing. Most government officials and court officials do not make honest mistakes, they do intentionally evil things and egregious abuses of power and malicious targeting of anyone they have an agenda against or just to get their rocks off by feeling powerful.

    If any officer or jury member unlawfully applies qualified immunity to shield an offending officer from prosecution, they can be sued and charged for obstruction, abuse of discretion, and/or sedition. Let me know if this happens to you.

    Doctors hospital nursinghomes. It's almost impossible to Sue those people as well. I lost a leg due to a nursing homes negligence. And if I didn't have a doctors appointment I probably would have died. That's what my vascular surgery doctor told me.

    The issue I can see, is that if you get enough simple clamor. Which is not unheard of. You can falsely hold good judges accountable. You point out that Constitutional cases are hard to win. I’d like to see the numbers on that before I give too much to this. Though QI needs to go for sure.

    I care they face consequences, fired, reputations damaged, can never hold a gov post again, prosecuted where it applies.
