    I think we need to focus on the non-revocability of OGL 1.0a. They have no legal right to withdraw it & its licenced content from use. They can't kill it unless we let them.

    • @HH-hd7nd
      @HH-hd7nd Рік тому +3

      Maybe not, but they can still drag people to court nonetheless. And in contrast to them most people (aka the small publishers) simply don't have the money to fight that kind of legal battle even if they'd win eventually.
      Even worse - all the current discussions about what can and cannot be copyrighted is actually missing context:
      They are all focused on US law and US law alone. That's a big problem when talking about releasing content on the internet that can end up in other countries because US copyright law doesn't mean anything in other countries. Copyright laws differ by country. Even if WotC cannot win a legal battle in the USA are you really sure that they cannot win it anywhere on the planet? Without knowing the exact copyright laws of all 200+ countries?
      Not to mention that the same is also true for the OGL itself - even if it is non-revocable in the USA (which is likely but in the end still unclear according to several lawyers commenting on the topic) doesn't mean that this is also the case in every other jurisdiction.
      All in all it might really be the better option to just walk away from D&D and publish stuff for other games that are supporting the new ORC once it is finalized.

    • @simontmn
      @simontmn Рік тому +6

      @@HH-hd7nd It's actually a Contract issue not a copyright issue. I teach Contract & Copyright in England, but I think US Contract Law (really the Laws of the 50 States) is likely just about the most favourable to WoTC they could hope for. They definitely don't want to be sueing in a Civil Law jurisdiction where their bad faith conduct would count much more heavily against them.

    • @growingsage
      @growingsage Рік тому

      @@HH-hd7nd 9(e) The license and all matters relating to its interpretation and enforcement will be governed by the laws of the State of Washington, and any disputes arising out of or relating to this license will be resolved solely and exclusively through individual litigation in the state or federal courts located in the country I which Wizards (or any successor) has its headquarters, and the parties expressly consent to the jurisdiction of such courts. Each party hereto irrevocably waives the right to participate in any class, collective pr other joint action with respect to such a dispute.
      Sounds like they're trying to nip that in the bud by saying you HAVE to go by Washington State law. Also, giving themselves wiggle room to move to a more corporate friendly state if at any time the judges decide against them.

    • @HH-hd7nd
      @HH-hd7nd Рік тому

      @@growingsage That's impossible. It might be referring to the laws of different state laws within the USA, however US laws have no relevance at all in other countries.

To me, he's put out some of the best DnD content over the past year or so and he has definitely been one of the best and important voices over the past month with everything going on. Did he put out information that might be incorrect to some degree? Seems like it and he apologized for it. But in the grand scheme, what he put out there was pretty harmless and is nothing compared to the blatant and egregious lies that WotC have put out recently. Until the new OGL is finalized and we see everything is writing, I do not and will not believe a single word that WotC says.

    Exactly correct. Divide and conquer is an ages old management technique. WOTC would love nothing more than to split the opposition, and won’t miss any opportunity to do so. People just need to ask themselves which is more likely; WOTC really cares about its players, or views them exclusively as wallets. Keep in mind they are owned by Hasbro, a major corporation. That should help keep minds focused, because the answer is obvious. Don’t fall for WOTCs “poor me” protestations.

    Given that Linda Codega only quoted WOTC in their coverage of ogl 1.2 lately, and is saying on Twitter we should give up on 1.0a and if we engage with WOTC bargain in good faith (even tho WOTC isn't), it is dangerous to only limit ourselves to only that info which has a name or an established news source attached to it. We have a situation when WOTC has numerous advantages over information, and people who are new to this sort of thing are only now starting to learn how to assess leaks and how to report information. The abuse and vilification of DnD Shorts i have seen online, when by all accounts he was transparent throughout, gives WOTC, which has no transparency, more ability to control the conversation and flow of information.
    So that's why I have stood up against the vilification of DND shorts, in the interest of supporting unity among everyone fighting wotc right now, and for everyone to continue to be skeptical about what we hear, including statements from designers who to date have been silent on the ogl issue.

    This is what I predicted about a week ago, when Critical Roll published their stance on the whole drama and it wasnt confrontational enough for the DND comm in general. The statement of CR was shred to peaces by a big chunk of the comm. And now a lot of players also jump on DND shorts... Wizards got exactly what they aimed for when they started to buy time first with radio silence and now by beating around the bush with halfassed apologies and twisted and torn new setups for a new ogl... They aimed for the comm to get somehow distracted or loos interest of the whole ogl drama so Wizards can implement what they initially wanted.
    A very big part of the community seems to just not care for the actual ogl problem, but just for the shitshow and drama itself and if they smell an opportunity to prolonge the drama by aiming at channels/people like DND shorts, they absolutely will do that. A disgustingly big part of this community is just a big bunch of posers that ride the trend-train which DND became over the last 5 years due to a lot of ttrpg-channels getting really big on Yt and of course Critical Roll.

    Kickstarter made a deal with WotC to reduce the compensation from 25% down to 20%. You do not sign a contract that is a draft, you do when it is fully completed document and with lawyers. On record WotC declared D&D as under monetized, and the new OGL spelled that out.
    WotC tried a similar, though slimmed down version for 4th Edition. This got enough backlash that it pretty much created their own competition in Paizo’s Pathfinder. Technically, their new OGL in its original form would have had sweeping access to 5e material. One D&D (6th edition) was to have this new OGL baked in.
    Whether they walk back on what they started, stand their ground, make some concessions or not, WotC past, current, and future plans are spelled out. Lets also point out that each of these drafts/real legal documents ALL contain language that allows them to make future changes.
    I simply can’t, in good faith, support the company anymore. And I do feel sorry for the devs who mast likely had no say or control in the matter. This completely reeks of corporate, not truly understand understanding the product, lay down the new rules.

We already knew Wizards looked at the surveys to determine satisfaction levels, they almost certainly have a system for screening comments, and it's entirely possible that any comments not directly related to the material/questions being posed is ignored. It's actually not hard to imagine scenarios where everybody is telling the truth from a certain point of view.
    It's possible that the leaks about subscription prices, AI DMs, removal of homebrew, etc are more of an executive wishlist than a to-do list or a cohesive plan. Or it could all be a lie for any number of reasons, but none of it changes the fact that Wizards already tipped their hand and have clear nefarious intent. They are trying to lure and fool people into voluntarily giving up their ability to use OGL 1.0a because Wizards can't get rid of it otherwise.

    I definitely feel like you're one of the people the community needs most now. Your ability to look at things objectively when dotting "i"s and crossing "t"s is super refreshing. I click on your videos because I feel like I'm less likely to stumble on misinformation. Love love love your content.

    The DnD Shorts thing was, odd. Reddit especially went on a bit of crusade against him in the comments sections of several posts, bad enough that the guy should rename his channel DnD Robespierre for a bit.
    That joke aside, there's an oddity in the "irrevocable" part of OGL 1.2. One of the clauses states that if any part of the License is found to be unenforceable, WOTC can strip that provision, or null the entire license outright. Sooooo not so irrevocable is it?
    The VTT stuff is just wrong. Not just from a control perspective, but they completely misunderstand their purpose while aligning them with Video Games - which VTTs are clearly not.
    Also, the license-back language is gone, but the spirit and intent is 100% still there. You own your content, but if WOTC happens to "borrow it" the burden of proof falls to you to pursue only monetary damages, not retraction, yet you also wave your right to jury trial, class-action lawsuits, and may only pursue them in the state of WA. So yea, you own it, but WOTC can come out with something similar, and their defense is "crabs and typewriters ya know?"
    1.2 has better language, and a softer tone. It's better written and shows fairly standard contract clauses - it just happens to be as bad as 1.1 and no one should consider signing it. They haven't backpeddled, only changed the language.

    well *I* feel attacked. :D But all kidding aside I have gathered information as I can, stuff from twitter, emails, etc. And apparently people have appreciated it. I don't mean just the uptick in subs on my channel which is still pretty microscopic compared to oh, say, a really popular channel where there is a discourse about wargaming miniatures, but, also folks thanking me for keeping them informed.
    One thing: I absolutely agree with you is D&D is best when it's one person's vision (or a small group) Gary & Dave on OD&D, Gary with AD&D...

    I’ve always been a fan of giving my opinion and then sit back to see what happens. Wild speculation is pointless. Now is the time to sit back and watch and see what Wizards does. I don’t think they will rise up and more likely dig themselves into a grave. Till they do what they do, I am just planning on moving forward elsewhere that has nothing to do with them.

    I think the reason you saw the dev team come our about surveys is because they are involved with that. The ogl is comming from the execs so the actual dev team probably has very little to no access to that process where as they do for the surveys.
