Unfortunately, the jury will think about Trump not testifying. It does play a part. Either way, Trump is toast.
If the jurors heard Trump’s public comments about how he would testify then doesn’t I would think this would have a negative effect on Trump.
The prosecutors will, during redirect or closing, point out that he refused to testify before the court and that the jurors are PERMITTED to draw any conclusion, including a negative one, from that choice. It's a civil suit and it's allowed.

It'd be really hard, as a juror, not to draw a negative inference if someone took the fifth and refused to testify even when instructed not to.
In a civil suit, you certainly MAY draw in adverse inference if the defendant won't testify. And we will. As will the jury. Only in criminal proceedings is the jury prohibited from drawing an adverse inference by the invocation of the fifth amendment protections. This is a civil suit.

I think the defense brought up the argument that trump is good at golf while they were questioning Stormy Daniels.
What’s interesting is that the defense had only two people to testify for Trump and one was Costello who made a fool of himself. Where were all the other pro Trump witnesses?

Complaining about begin under a gag order is not similar to testimony in open court, under oath. Judge Merchan should ask Trump before instructing the Jury about the evidence presented in court, "Mr. Trump, will you add a statement here in your trial?"

Exactly zero need to negatively inferr anything because tRump did not testify.
But if as a juror in the case one can and should accept that evidence presented and not refuted by the defendant is factual evidence. Contradictory "points of veiw" about the evidence can be sifted theough and corroboration can be lined up on evidence, but any evidence that the defendent did not refute, that should be seen as unrefuted fact.

The truth of the matter is that Trump is so undisciplined not only couldn't he survive cross examination, he would not be able to truthfully answer the softball questions his own lawyer would offer him. Look at how he has performed in the last three months with the softball interviews he has agreed to do.

Judge Merchan can always instruct the jury that it's ok to draw an adverse inference from Trump's refusal to testify. In fact, this instruction needs to become standard in all cases involving Trump.
Apparently, a judge asks the defendant whether he wants to testify, not his defence team. So....... so far no word that Judge Marchan asked Donald Trump if he wanted to testify, and Donald, himself, said no.
