The national fire protection association standards actually have a specific procedure and checklist for obtaining permission and conducting training exercises on real facilities that are donated to you. While it is not law, just wait till his attorneys lay that out in front of them and I asked them to explain what processes they used and why they didn't follow the national standards

Judge should award full damages, attorney fees as well as punitive damages against the city and for the plaintiff. The city should go after the fraudulent owner for misleading them and fraudulently signing a document as owner of the property.

Demo work can be pulling out cabinets,guttinh for remodeling,removing structure for additions,or complete removal of structure. My bet is that the demolition contractor probably collects a finder fee from the fire department to get the houses. He probably has been doing this without his customers knowing it for years and he kicks back money to the fire chief to look the other way. The demolition guy probably was desperate to get a house so hey can get his fee before the end of the year and the budget money the fire department has gets taken back. So he skipped the paperwork or who knows was drunk and convinced himself that he got an agreement to demo the place. So the reporters should check the signatures on the prior auths and I bet its the same guy with the same fire officials signing off on it. Pure simple corruption

Just because he was considering demolition, doesn't mean he was going to demolish it. His actions/intent show that. Despite having a number of bids, he hadn't made that decision yet. He hadn't signed any contracts. The idea that because he was considering it made it okay for the firefighters to go in and demolish the property makes no sense whatsoever. I would immediately motion to freeze Mark Powell's assets because that guy is already shady enough that you know he's going to hide whatever he can so he doesn't have to pay out. I would also subpoena the city records to see if they have a pattern of reckless behavior when it comes to contracts. I really believe that the homeowner is in the right here, and the city is in trouble.
At the end of the day, it isn’t going to matter what the condition the house was in or what, if anything, the property owner was going to do with it. The property owner is saying he was doing due diligence and weighing his options. The first question is: does the signature on the City’s release belong to the property owner. Apparently, the answer is no. Second question is: Is there a signed contract between the property owner and the demolition company? Was the request for an estimate made in writing? What do those documents say? Just out of curiosity, how much did the City pay the demolition company? Assuming, the demolition company got a contract to demolish the house, are they receiving a full demolition fee from the property owner AND a fee from the city? The demolition company isn’t out of the woods on this. There should be more paperwork behind that release/authorization verifying the signer’s authorization to sign the document, like something related to the title. It will be interesting to see what happens.

Amateur non professionally trained firefighter playing fire chief. I did not see any notarization on any of those agreements either. Not even a first year paralegal would authorize such legal documents without notarization........ City attorneys bar license needs to be held accountable as well because if they didn't review these documents nor if the City attorney did not establish a written policy of procedure for such agreements there are some real issue here!

What does the condition the property was in have to do with the fact that you have illegally torn the house apart and you have no system in place to check the paperwork that a legal owner must sign off on? there are no abandoned property's for this type of training there is no fire fighter school where this training can take place i know when i was in the military we used the property the government owned to do training on

To a much lesser extent than this man’s woes...., I’ve had police show up at my house, 5 of them at first, at 5am. I actually startled the cop by stepping out my back door right as the cop opened it. I run my own concrete construction company so early starts we’re common. But just that quick I was shoved against the wall of my house, cuffed, and forced to the ground. The cops intent? To go inside, search for, and apprehend ... someone that has NEVER lived at my home! Only thing that prevented the cops from just barging in was they could hear the horrific ruckus my 150lb old English bulldog was making (good girl 😁). I refused to give consent for them to enter, as they had a bad address and my family was inside sleeping. After 15-20 minutes they show me a photo of ‘the guy’. Sure enough, I had met the guy. 3 times total! Originally at a friends BBQ. Then because he got my phone number from the friend to call me about repairs to his vehicle. So he came to the backlane of my house, never the front and never inside, only in my garage. He leaves the car, I fix it, he returns 2-3 days later to pickup his vehicle. END OF CONTACT. Yet this clown was able to use my address on his release from police lockup? So when he failed to go to court, the police believe that he lives at my address? Even threatening me with charges because I wouldn’t allow the police entree into my home (it was an arrest warrant not a search warrant). 45 minutes, most of in cuffs! All because the government doesn’t verify info prior?
Had a somewhat similar situation years ago, but not as harsh. Was woke up in the wee hours of the morning, doorbell ringing like crazy. Went to the door, cop lights flashing in the windows. Cops and what I think was a detective at my front door stating they needed to get upstairs pronto due to a violent domestic situation in my duplex. I found this unlikely as the previous tenants who were very quiet had moved out about a month before and the upstairs was empty with just a stepladder and some painting supplies. Found out the got the right house number but the wrong street, it was one block over. They found out, apologized and left to find out a block over what was probably a murder scene by now. The next day I had to explain to the neighbors what happened, fortunately they knew us and didn’t think we had a crime scene upstairs. Really think the police should look at the street signs before they wake people up at the wrong address….

For anyone talking about suing the demo guy: he is not the one who demolished the house. He is not the one who failed to have paperwork for his actions. He defrauded the city. Not the owner. The fact that the city is lying about the house “being in disrepair” and the demo guy being his agent via verbal contract or him being present tells a lot. This is the type of legal nonsense used to stall and confuse matters. Make absurd big lies that can’t be proven and ask the other guy to prove a negative. Even if the court believe 10%, it’s 100% more than they should have. Also, the fact that city failed to do paperworks for the 6 previous houses is nails in the coffin. St Louis county Missouri is not cutting edge and I've been able to look up tax records online showing the owner of any property in the country in about 2 minutes for over a decade.

There was no mistake here. That contractor knew exactly what he was doing for whatever reason. I don't care what anyone is claiming, ultimately it is the responsibility of the contractor regardless. It doesn't matter that the property owner may have been contemplating having the home torn down, if his signature isn't on the line, then he should be payed.

Contractor knew the guy was deciding between renovations and build new and decided to force the decision. The only way he could legally sign for this is with a signed contract for demolition of the house.

What is sad is in the first days of fire company's you had to pay for the insurance otherwise they would let it burn down unless it was attached or next to one with it. And the reasons they got there so fast was because whoever was first got paid the most.

Something smells fishy here. The house was worth $1.4 Million yet he wanted to get a bid on how much it would cost to demo the house? Who in their right mind would do that? The only thing I can think of is that the house was already worthless and it’s the property that’s worth all the money. Yes this could have been a total mistake on the city’s side or it could also be a case of fraud in which the owner is trying to get a free house out of it. Definitely interested in seeing how this plays out.
It plans on your plans for your home and how much work needs to be done on it in general. Sadly, many homes are not fully built up to codes or having aging infrastructure that needs to be addressed that factor into decisions and plans. I know someone that does wall/ceiling repair and painting and there is some projects they do that final cost excessive $100,000(I think he told me one project was like $700,000) because the amount of work needed to be done.
Even if the homeowner hired the demo contractor, that doesn't make the demo contractor the homeowner so the original contract for the city to come in and demo is null and void, even if the homeowner was there when the fire department was destroying his home doesn't make it legal, and of course the fire department won't be paying out for the law suit it will be the tax payers money who will pay and nothing will happen to the department either maybe a slap on the wrist and the chief will probably ended up with a paid vacation (paid administrative leave) for it all and will be found in internal investigation not guilty of any wrong doing.

Another example of why i'm in favor of Vigilantism. The law fails at every turn and a slap on the wrist isn't enough but a good ole fashioned beating in the middle of the night to correct the issue serves justice. Those who would say violence never solved anything did not use enough violence. Tired of hearing the phrase "we were just doing our job" or the city bs run around with delay tactics. Someone screwed up and someone needs to wake up in the ICU to serve as a lesson to other city officials to make sure they have their information correct.

Amateur non professionally trained firefighter playing fire chief. I did not see any notarization on any of those agreements either. Not even a first year paralegal would authorize such legal documents without notarization........ City attorneys bar license needs to be held accountable as well because if they didn't review these documents nor if the City attorney did not establish a written policy of procedure for such agreements there are some real issue here!

To a much lesser extent than this man’s woes...., I’ve had police show up at my house, 5 of them at first, at 5am. I actually startled the cop by stepping out my back door right as the cop opened it.
I run my own concrete construction company so early starts we’re common.
But just that quick I was shoved against the wall of my house, cuffed, and forced to the ground.
The cops intent? To go inside, search for, and apprehend ... someone that has NEVER lived at my home! Only thing that prevented the cops from just barging in was they could hear the horrific ruckus my 150lb old English bulldog was making (good girl 😁).
I refused to give consent for them to enter, as they had a bad address and my family was inside sleeping.
After 15-20 minutes they show me a photo of ‘the guy’. Sure enough, I had met the guy. 3 times total! Originally at a friends BBQ. Then because he got my phone number from the friend to call me about repairs to his vehicle. So he came to the backlane of my house, never the front and never inside, only in my garage. He leaves the car, I fix it, he returns 2-3 days later to pickup his vehicle. END OF CONTACT.
Yet this clown was able to use my address on his release from police lockup? So when he failed to go to court, the police believe that he lives at my address? Even threatening me with charges because I wouldn’t allow the police entree into my home (it was an arrest warrant not a search warrant). 45 minutes, most of in cuffs! All because the government doesn’t verify info prior?
Had a somewhat similar situation years ago, but not as harsh. Was woke up in the wee hours of the morning, doorbell ringing like crazy. Went to the door, cop lights flashing in the windows. Cops and what I think was a detective at my front door stating they needed to get upstairs pronto due to a violent domestic situation in my duplex. I found this unlikely as the previous tenants who were very quiet had moved out about a month before and the upstairs was empty with just a stepladder and some painting supplies. Found out the got the right house number but the wrong street, it was one block over. They found out, apologized and left to find out a block over what was probably a murder scene by now. The next day I had to explain to the neighbors what happened, fortunately they knew us and didn’t think we had a crime scene upstairs. Really think the police should look at the street signs before they wake people up at the wrong address….

For anyone talking about suing the demo guy: he is not the one who demolished the house. He is not the one who failed to have paperwork for his actions. He defrauded the city. Not the owner.
The fact that the city is lying about the house “being in disrepair” and the demo guy being his agent via verbal contract or him being present tells a lot. This is the type of legal nonsense used to stall and confuse matters. Make absurd big lies that can’t be proven and ask the other guy to prove a negative. Even if the court believe 10%, it’s 100% more than they should have. Also, the fact that city failed to do paperworks for the 6 previous houses is nails in the coffin.
What I think happened is the fire department knew the city was playing loose with property laws. He probably warned them. And was told that “legal” is not his job. He was told to mind his business. He is covered. He has the paperwork. That smirk screams malicious compliance. “Legal” screwed up. Someone in city halls took bribes. Someone in city halls paid the demo guy. And now the city is on the hook for over a million in damages and the fire fighting captain is going to throw the city under the bus.
Fun fact, as part of the purchase, the owner has a fully documented records with pictures of the house state prior to the event.

This is what is so disgusting about how our government at all levels handles taking responsibility. Rather than just admit to making a huge blunder and then suing the demo company that misrepresented themselves as the owner, the counter sue the owner himself and deny that there is any issue with how they conducted themselves even as they openly admit to having acted ridiculously negligent failing to even check city records to ensure that the person who signed the waiver actually owned the home! Disgusting…I hope he gets all he is owed and then some and this demo company gets sued by the city not to mention there must be some criminal liability for fraud for misrepresenting himself as the owner of a property he doesn’t own!

St Louis county Missouri is not cutting edge and I've been able to look up tax records online showing the owner of any property in the country in about 2 minutes for over a decade.

There was no mistake here. That contractor knew exactly what he was doing for whatever reason. I don't care what anyone is claiming, ultimately it is the responsibility of the contractor regardless. It doesn't matter that the property owner may have been contemplating having the home torn down, if his signature isn't on the line, then he should be payed.

Contractor knew the guy was deciding between renovations and build new and decided to force the decision. The only way he could legally sign for this is with a signed contract for demolition of the house.

What is sad is in the first days of fire company's you had to pay for the insurance otherwise they would let it burn down unless it was attached or next to one with it. And the reasons they got there so fast was because whoever was first got paid the most.

Something smells fishy here. The house was worth $1.4 Million yet he wanted to get a bid on how much it would cost to demo the house? Who in their right mind would do that? The only thing I can think of is that the house was already worthless and it’s the property that’s worth all the money. Yes this could have been a total mistake on the city’s side or it could also be a case of fraud in which the owner is trying to get a free house out of it. Definitely interested in seeing how this plays out.
That's pretty common, really. He says in the video that he was trying to figure out if he was gonna remodel or flatten and build something new.
Very rarely is the price of a house based mainly off of the actual building, the land instead.
It plans on your plans for your home and how much work needs to be done on it in general. Sadly, many homes are not fully built up to codes or having aging infrastructure that needs to be addressed that factor into decisions and plans. I know someone that does wall/ceiling repair and painting and there is some projects they do that final cost excessive $100,000(I think he told me one project was like $700,000) because the amount of work needed to be done.

Even if the homeowner hired the demo contractor, that doesn't make the demo contractor the homeowner so the original contract for the city to come in and demo is null and void, even if the homeowner was there when the fire department was destroying his home doesn't make it legal, and of course the fire department won't be paying out for the law suit it will be the tax payers money who will pay and nothing will happen to the department either maybe a slap on the wrist and the chief will probably ended up with a paid vacation (paid administrative leave) for it all and will be found in internal investigation not guilty of any wrong doing.
