As for Julian he was not even born when Crispus died so he had no reason to feel attachment for him and honor his memory and with the end of that dynasty whomever took power next had even less reason to care about that issue.
Apart from the evidence you mention about theory number one. It is also the favorite Roman go to myth, of the evil step mother plotting to get her kin on the throne. So seducing his son and outright plotting against Constantine wouldn't be surprising. It certainly wouldn't be the first bitter empress pressed into a loveless political marriage.
