UK HGV weight limits are a bit of a minefield. Max weights for different HGVs depend on the vehicle type and number of axles (and specifically what weight is placed on said axles). If we ignore oversized or specialised transport, the max gross weight under Authorised Weight Regulations of an articulated vehicle is 44,000kg in the UK. Or 44 metric tonnes. Not 40. But in this specific case the Mercedes Actros was a 4x2 tractor unit, so the maximum permissible GTW for this is lowered to 40 tonnes, even though the trailer had 3 axles. However, the weight of the HGV isn’t the real issue is it? It’s the notion that “grassing someone up” could conceivably be likened to informing the police if you thought for a single moment a driver could be unfit to drive through alcohol or drugs. Could have been pizza delivery on a scooter, it would still be the right thing to do.

Just passed my HGV license and during exam i was loaded with only 8t... guys you don't really want to know how it feels braking these machines with 30t of load.. good on them for reporting if he was found to be drunk then that could be a potentially life saved
I passed my class 1 recently as well. Can't say I would be angry if someone called the police on me because they thought that. Better to be safe than sorry. I don't drink in any case.

If information comes through that a lorry driver is drunk it will be a blue light response. The driver has had at least a whole month of driver training to drive on blue lights. It’s what the public expect.
I used to work on a coppers headquarters and would baffle me how some coppers would spend 1 min tying shoe laces, get in the car, spend 2 min adjusting mirrors, etc. then turn the blues and speed off ( the call was made before they tied their shoe laces etc) The 2 ladies were very polite.

AB I love your work, but I have a big concern about this video. I get that you don't legally need to, but I think it would have been appropriate to pixelate the driver's face. In this case it appears that he was innocent of any wrong doing, but nonetheless he's got a reputation to maintain. Even an accusation that an HGV driver was intoxicated could potentially hinder his/her career prospects. I know you meant well and it's too late to re edit this video, but just for future reference.

Very very good point, although AB, may have thought because he is innocent then it's all good, or the fact that cos he is in public he is fair game, and it could affect his driving career because I'm not saying he is a 'drink-driver' but he is a drinker and he is a driver as apparently he smelt of booze, so it might only be a matter of time where him drinking, and then driving, becomes 'drink - driving' but then to that logic, AB has potentially done the right thing by leaving his identity visible because it may only be a matter of time, so future companies that hire him can just pay a little more attention to his general behaviour and therefore.. again.. potentially stop a 'drink driver' from getting behind the wheel..... very interesting though isn't it..... because with all this in mind.... should his face be blurred out or left in.... 🤔

Excellent community support officers, pleasant, helpful, open and with a smile. Very good! The officer could have said hi how are you but i think they maybe a bit sceptical of a camera now considering how they get themselves in trouble when one is on them, so i wouldn't mark him down for not making contact, in fact he done pretty well avoiding eye contact.
Nothing to do with grassing up!!! It's protecting innocent people, children etc from the possibility of a potential tragedy occuring....well done to the staff for handling a situation that could have resulted in someone's death.
I cut the grass at Clacket Lane Services and you would be shocked and stunned at the empty bottles of whisky and vodka and rum and gin and cans and cans of beer all in the shrubs and hedges right next to where all the HGV's are parked, and 90% of them park there for the maximum 'free' stay of 3 hours, and then you get the ones that pay the £25 for 24hrs of parking, so the alcohol being consumed by those HGV drivers are 10% staying the night which is bad but not as bad, but 90% of them are consuming large quantities of alcohol just in the 3hr window..... you would be shocked at how much the lorry drivers all have a drinking problem..... 'IT IS A LOT...!!'

A bit of a shame on this one AB. The officer doesn't need any proof that he's drunk. An officer can take a preliminary sample of breath for testing if you are in charge of a motor vehicle and failing to do so is a criminal offence. Company definitely didn't "grass him up" just had a reasonable concern about him and others.
I suppose the argument there is the 'being in charge'..... Just having keys with you should not be enough to prove the charge, because if it did you could be sitting at home downing a few beers with the car keys on the table beside you, and the Police could roll up and test you on the basis that you had the opportunity to drive the vehicle or had driven it earlier..... I am no supporter of driving while being affected by alcohol, but 'in charge' is quite a technical area in legal terms.

For example, if a Constable suspects you have been driving, or were attempting to drive whilst under the influence and they believe you are still under the influence, they can require a specimen of breath, which is likely what we see in the video. @@COUNT_C0IN , they can certainly suspect that you were driving, however a breath analysis does not prove that a person had been driving or was about to drive, so they would first have to establish that that person had driven a vehicle on a road. That is why 'in charge' is used, but as I wrote it can be a very technical area and open to interpretation. The other matter is that being 'under the influence' is an actual specified thing and just because someone has been drinking it does not automatically follow that they are under the influence of alcohol. I know that the UK has different ways of measuring blood alcohol content, but in Australia .15% is deemed to be drunk.

Driving, attempting to drive and in charge are all separate, so it’s not that ‘in charge’ is used, they are all terms to describe someone in relation to the vehicle under the law. I also didn’t say a preliminary breath analysis proves someone was driving, it isn’t even sufficient in court to prove someone was drinking. I’m talking about the circumstances in which a constable can require someone to provide a specimen of breath for analysis at the roadside. So in the video the power the constable would have used was under S6 RTA subsection 3 - that they suspected the man was under the influence of alcohol when he was driving the motor vehicle and that he was still under the influence when required to provide a sample. The uk standard is 35 micrograms per 100ml of breath but whether or not the sample comes back over is irrelevant, the Constable only needs the suspicion they could be impaired by alcohol to require the preliminary breath sample. Evidently the guy came back under as he was free to go. I’ll grant to you that ‘in charge’ has no legal definition in the uk but the example you gave of having car keys on you at home clearly both isn’t applicable here and wouldn’t stand up in court if a pc tried to test someone randomly in their home just for having car keys. As we learn in the video the man who was breathalysed is driving a truck for work and was either in a vehicle when the pc got there or he was in the locality and pointed out by the other employees as having driven it or was attempting to drive it. This is why arguing on what ‘in charge’ means in relation to this incident is irrelevant - As 6 RTA covers ‘was driving’ and ‘attempting to drive’ then that would fit and whether or not ‘in charge’ fits doesn’t matter.

Auditing to expose bad practice is fine but in this circumstance I think it's wrong to post a video of a civilian in a moment of shame. AB definitely handled the situation well but I don't think every video he films needs to be posted because the man may have addiction issues or maybe he doesn't , he wasn't charged with anything and it could be written off as "a bad day" but now it's on UA-cam for potentially 100k+ people to see this may cause alot of stress for the man and his family. Filming in public is fine, but I think posting such a private matter like this could potentially be harmful.

At the end of the day AB was just in his normal mode of not trusting the Police, and suspecting there was potentially some wrong doing by the Police rather than thinking rationally about the Ramifications of a driver having had a drink..... think of how many times AB has walked up on a situation where the Police or Civil enforcement officers are acting unlawfully or abusing their powers, and AB automatically just assumed the same thing was potentially going on here..... and I don't blame him, and the Police only have themselves to blame...... that is exactly what went on in this video simple as that.... I'm sure later on AB realised that actually if the driver was drunk then that is not by any means an ideal situation, but primarily AB suspected the Police to be acting outside their powers yet again which is why he filmed it in the first place.... and I'm with him 100%

My father, (RIP) used to drink drive and we had many a fall out when I would confiscate his keys and call him a taxi. NOT convinced that this required BLUE lights, THE suspect is held by 2pcso's, HOWEVER, I did hear "he was ok to drive", NO doubt he will not be required, to deliver to the same site, I don't know the law in other countries, but I suspect he will be nominated other companies, but, that's not to say he just didn't have a really bad day...sounds to me he drank the night before, and obviously tooooooo much.

In this case it appears that he was innocent of any wrong doing, but nonetheless he's got a reputation to maintain. Even an accusation that an HGV driver was intoxicated could potentially hinder his/her career prospects.

Very very good point, although AB, may have thought because he is innocent then it's all good, or the fact that cos he is in public he is fair game, and it could affect his driving career because I'm not saying he is a 'drink-driver' but he is a drinker and he is a driver as apparently he smelt of booze, so it might only be a matter of time where him drinking, and then driving, becomes 'drink - driving' but then to that logic, AB has potentially done the right thing by leaving his identity visible because it may only be a matter of time, so future companies that hire him can just pay a little more attention to his general behaviour and therefore.. again.. potentially stop a 'drink driver' from getting behind the wheel..... very interesting though isn't it..... because with all this in mind.... should his face be blurred out or left in.... 🤔

What would you say if you thought someone was drunk and not doing anything about it then finding out they plough thought a load of school kids.

The officer could have said hi how are you but i think they maybe a bit sceptical of a camera now considering how they get themselves in trouble when one is on them, so i wouldn't mark him down for not making contact, in fact he done pretty well avoiding eye contact.

I cut the grass at Clacket Lane Services and you would be shocked and stunned at the empty bottles of whisky and vodka and rum and gin and cans and cans of beer all in the shrubs and hedges right next to where all the HGV's are parked, and 90% of them park there for the maximum 'free' stay of 3 hours, and then you get the ones that pay the £25 for 24hrs of parking, so the alcohol being consumed by those HGV drivers are 10% staying the night which is bad but not as bad, but 90% of them are consuming large quantities of alcohol just in the 3hr window..... you would be shocked at how much the lorry drivers all have a drinking problem..... 'IT IS A LOT...!!'

A bit of a shame on this one AB. The officer doesn't need any proof that he's drunk. An officer can take a preliminary sample of breath for testing if you are in charge of a motor vehicle and failing to do so is a criminal offence. Company definitely didn't "grass him up" just had a reasonable concern about him and others.
I suppose the argument there is the 'being in charge'..... Just having keys with you should not be enough to prove the charge, because if it did you could be sitting at home downing a few beers with the car keys on the table beside you, and the Police could roll up and test you on the basis that you had the opportunity to drive the vehicle or had driven it earlier.....
I am no supporter of driving while being affected by alcohol, but 'in charge' is quite a technical area in legal terms.

For example, if a Constable suspects you have been driving, or were attempting to drive whilst under the influence and they believe you are still under the influence, they can require a specimen of breath, which is likely what we see in the video. The full list of powers is s6 of the road traffic act
@@COUNT_C0IN , they can certainly suspect that you were driving, however a breath analysis does not prove that a person had been driving or was about to drive, so they would first have to establish that that person had driven a vehicle on a road. That is why 'in charge' is used, but as I wrote it can be a very technical area and open to interpretation. The other matter is that being 'under the influence' is an actual specified thing and just because someone has been drinking it does not automatically follow that they are under the influence of alcohol. I know that the UK has different ways of measuring blood alcohol content, but in Australia .15% is deemed to be drunk.
@@johnvienta7622 no no, read the actual law, Section 6 road traffic act, it’s not even a 2 minute read. Driving, attempting to drive and in charge are all separate, so it’s not that ‘in charge’ is used, they are all terms to describe someone in relation to the vehicle under the law. I also didn’t say a preliminary breath analysis proves someone was driving, it isn’t even sufficient in court to prove someone was drinking. I’m talking about the circumstances in which a constable can require someone to provide a specimen of breath for analysis at the roadside. So in the video the power the constable would have used was under S6 RTA subsection 3 - that they suspected the man was under the influence of alcohol when he was driving the motor vehicle and that he was still under the influence when required to provide a sample. The uk standard is 35 micrograms per 100ml of breath but whether or not the sample comes back over is irrelevant, the Constable only needs the suspicion they could be impaired by alcohol to require the preliminary breath sample. Evidently the guy came back under as he was free to go.
I’ll grant to you that ‘in charge’ has no legal definition in the uk but the example you gave of having car keys on you at home clearly both isn’t applicable here and wouldn’t stand up in court if a pc tried to test someone randomly in their home just for having car keys. As we learn in the video the man who was breathalysed is driving a truck for work and was either in a vehicle when the pc got there or he was in the locality and pointed out by the other employees as having driven it or was attempting to drive it. This is why arguing on what ‘in charge’ means in relation to this incident is irrelevant - As 6 RTA covers ‘was driving’ and ‘attempting to drive’ then that would fit and whether or not ‘in charge’ fits doesn’t matter.

Auditing to expose bad practice is fine but in this circumstance I think it's wrong to post a video of a civilian in a moment of shame. AB definitely handled the situation well but I don't think every video he films needs to be posted because the man may have addiction issues or maybe he doesn't , he wasn't charged with anything and it could be written off as "a bad day" but now it's on UA-cam for potentially 100k+ people to see this may cause alot of stress for the man and his family. Filming in public is fine, but I think posting such a private matter like this could potentially be harmful.

At the end of the day AB was just in his normal mode of not trusting the Police, and suspecting there was potentially some wrong doing by the Police rather than thinking rationally about the Ramifications of a driver having had a drink..... think of how many times AB has walked up on a situation where the Police or Civil enforcement officers are acting unlawfully or abusing their powers, and AB automatically just assumed the same thing was potentially going on here..... and I don't blame him, and the Police only have themselves to blame...... that is exactly what went on in this video simple as that.... I'm sure later on AB realised that actually if the driver was drunk then that is not by any means an ideal situation, but primarily AB suspected the Police to be acting outside their powers yet again which is why he filmed it in the first place.... and I'm with him 100%

You can pass the breathalyser and still be shaking badly from the amount and kind of drink you had the night before which is just as dangerous
Generally if you are still shaking and smelling the day after a night of drinking then very often you will in fact still be very much over the drink-drive limit

Love what you do AB, however I have to agree with the majority on here. If I thought or knew someone was drink driving I’d have to report it. My father, (RIP) used to drink drive and we had many a fall out when I would confiscate his keys and call him a taxi. At least my conscience is clear and I can live with myself knowing that I did the right thing.

NOT convinced that this required BLUE lights, THE suspect is held by 2pcso's, HOWEVER, I did hear "he was ok to drive", NO doubt he will not be required, to deliver to the same site, I don't know the law in other countries, but I suspect he will be nominated other companies, but, that's not to say he just didn't have a really bad day...sounds to me he drank the night before, and obviously tooooooo much.
