Pakistan Establishment take my home by using this act. In 2004 they acquired 4 acurs agricultural land for APS School play ground and included our home (4 house 5 marlah each) in this land without any notice and didn’t payed any money and notices to us we connect to court but they dismissed because of time barred then high court as well as supreme court dismissed our cases in 2023. Our objection was that our land is a residential not a agricultural so rate should be accordingly to them which is situated on main GT road. And we demand housing material cost which they need to pay but no one cares and now finally we are near to leave our home that time they give us 10k per marhal rate that was also not a feasible rate now the worth of my house is more than 1cror its commercial area and army build a market near my home. This is black act which was used by British to takeout land of subcontinent where they think have minerals or some other things. Very disappointed

Sir as you mentioned that they build a market, you can sue them, as they took your property for APS school play ground, not for market. As per section 42 of land acquisition act the land can be taken back if it is used against its purpose.
So you can sue them.!
