Its my first time hearing Wael. I absolutely 💯 ♥️ him and concur with his understanding of modernity. Its a strong pivot from where we are But what we're doing now is only destroying humanity and our world.
We need to hear more from him and introduce him to many others. Thanks for doing interview.

I wouldn’t call it “Sharia law”. From my understanding, one of the points of his works is highlighting how language is weaponized, and how the understanding of Sharia was reduced to being just a source of legal rulings. It’s called Sharia not Sharia law, as Sharia is a vast discipline covering the discursive practice where the social, political, economic etc. intersect with the moral and epistemological.
And then jurisprudence and rulings out of that is called fiqh, as you know.
Glad you brought Hallaq on :)

I love Hallaq’s uncompromising style. It’s impossible to miss the moral implications of his political analysis. He reunites fact and value, to put it in his terms.

the Islamic state is impossible for certain reasons but the choice to chose being ethical is eternal and almost personal, a practice that offers what a islamic state stands for.

Brilliant interview and amazing intellect. If (like me) you need the books broken down a little to understand them better, you might like the series on the Blogging Theology channel with Tom Facchine who has a very good take on Dr Hallaq's works.

Dr. Hallaq says that "we can live without states without living in anarchy", this may just be a semantic misalignment, however what most social anarchists ( contrasted with individualist anarchists ) would advocate for is exactly what Dr. Hallaq says in that quote, a form of collective stateless living with a strong focus on ethics and values other then profit ( the modernist capitalist episteme ). Anarchy is commonly derided and semantically confused with chaos as opposed to a legitimate political orientation that has existed for thousands of years alongside the development of what would eventually dialectically synthesize into the modern nation state form. I think that there is a surprising amount of overlap between anarchy and islam, the notion of non state polycentric law is evidently appealing.

Loved how @afikra pried on the question: How is modern state different from empires? Historically speaking, one can argue that societies were more exploitative and more violent in medieval and ancient world than the modern state.
Emperors ruled the empire like they owned it taxing farmers to death and enslaving people who couldn't pay taxes. I did not see convincing answer to the question about how the past was NOT "bad". If someone is criticizing modern state system, then we cannot the escape the question whether the past was really that great and peaceful? Looking forward for part-2!

I wanted to learn particularly about the Middle-East Arab's general view on Modernism, I was excited that he touched upon it in the beginning while defining Modernism but I think it then became general. In Sha Allah, next time, I would to learn more about that as an outsider.

This is NOT a critique of Dr. Hallaq, but people in a position to impact a change will NOT read a 400-page book (the new book he's working on). I hope it will include a summary chapter "For National Leaders" (For Dummies).

Modernity includes many components: science, technology, philosophy, secularism, democracy, geopolitics etc.
For Muslims , science and technology are to be taken back , while others are just references and most of them to be discarded into trash bin.
That means modern Muslims have to hold full Islam and assimilate modern science to build up independence and strength to bring justice and peace and prosperity to the humanity!

Allaah has condemned theft and decreed an appropriate punishment for it. The hadd punishment for a thief is to cut off his hand. Allaah says (interpretation of the meaning):
“And (as for) the male thief and the female thief, cut off (from the wrist joint) their (right) hands as a recompense for that which they committed, a punishment by way of example from Allaah. And Allaah is All Powerful, All Wise” [al-Maa’idah 5:38]
The Prophet (peace and blessings of Allaah be upon him) said: “The hand should be cut off for (the theft of) a quarter of a dinar or more.” (Narrated by al-Bukhaari, al-Hudood, 6291)
This Shariya punishment for theft must be implemented in America, for all Muslims of America, under the able guidance of the professor of Columbia University
