If this guy trademarked and trade named this phrase and he copyrighted it, then it doesn’t matter who used it before if they never filed the proper paperwork to claim ownership. He’s going to get paid. If he’s smart, he will license this to them and just get paid a large percentage of it. They’ll be able to pay him more money with a licensing deal instead of suing them, and they might let him into the fold because he decided to do business instead of taking them to court. That’s what a smart man would do.
