      I hope more people see this. I've already seen suggestions that others go threaten these people. That's never going to solve anything and will only come back on this channel. Hopefully those toxic commenters come to their senses before anything happens.

      I probably would have mentioned this in the video itself. Just checking the numbers, I’d guess you have at least twice the audience of your “opponent”, and my first thought was that Karen is likely to receive a deluge of hate mail from outraged fans of yours.

      While there is nothing to write publicly regarding this situation that will change it, I do want to say Feli that you have already done the difficult part and I and the other 299,999+ other followers will stay with Feli from Germany. Your channels former title will just become an empty shell that Karen and Kevin can sit in and listen to the echoes of their own voices (except for when their attorney calls for his/her money). You built the momentum behind your brand and it goes with you. For what it's worth from a follower in the American southwest, I am happy you can move forward now.

    I’m a trademark attorney, and I really didn’t expect that world to collide with this one today! You did a great job talking about the different kinds of trademarks, and I totally agree: I don’t understand why the USPTO approved their application without a descriptiveness refusal. And two weeks to rebrand after so many years of coexistence is ridiculous, shame on the other side for that. Anyway, this is hopefully for the best, and I’ll keep watching!

      That's what I was thinking, it's a descriptive name and its copyright is at least arguable. Also the fact that they had previous friendly communications doesn't help their case.
      But it's probably less headache a legal cost to just rebrand. I'm not a lawyer but I don't see how they can sue her for mentioning her old channel name.

      @@tonymouannes If she signed an agreement then she has to follow the terms of that agreement. That's now contract law instead of trademark law.

      @@burke615 that's true, but she could have rejected the contract. I personally think she should have negotiated it at least. She gave up everything from her own will. Probably 8n regard to not having to modify old content, being able to use a similar name (like US instead of America) and non having to censure her use of the name. For example her being able to say that german girl in america within context not as the channel's name or mentioning the previous name as being a previous name. Also she should have asked for more time.
      But it's probably too late now. Also that way is less stressful than fighting the whole thing.

      @stanley Yeah, not legal advice and i'm not a lawyer, but have definitely learned in many classis with subunits in trademark law that products in different fields and have little chance of confusion have no right to request the other stop using it... Maybe her lawyer felt that they were similar enough that it may be hard to argue...

      Feli is way BETTER. It is so incredible you had to do this. It shows how much that other person was jealous of your brand. But in all truthfulness, the title, German Girl blah blah, is not very unique anyways. Feli from Germany or whatever is way more relaxed and unique. Feli is a cool name. I mean, Karen is like the worst name to have right now, and that other German girl, she did the most Karen thing a Karen could do! Sorry but that's total loserville, in my opinion.

    As an American, I am embarrassed by how this was handled by the other party. Why does everything have to be so contentious? You are so gracious and sweet for how you handled this, and I have a lot of respect for you. Shame on the other person for their behavior.       I would not blame the other party personally. She's probably a nice person, too. But lawyers have a way of winding people up because it is to their (financial) advantage. We are one of the most litigious nations on Earth, because anyone can try to sue anyone for basically any reason. I know this wasn't a lawsuit, but it's the same mindset. When lawyers get involved, they often smell blood and all reason and courtesy goes right out the window. It's a shame.

      Everything becomes contentious for two reasons, both intertwined.
      Attorneys and money.
      I'm aware of one case that was portrayed in the press of one business using their surname as the business name and the press reporting it as litigation to force another unrelated person with the same surname to change their surname and business name. Obviously, it was far more complex and simple than that, but that's what you get when only journalism majors cover a story, rather than seeking advice from professionals involved in the story - half-baked coverage.
      Otherwise, the Johnson family would all lose their surname because of Howard Johnson's and obviously that never happened, as that was my wife's maiden name.
      For that matter, we'd have to change terms in various card games, as Donald Trump owns a trademark on "Trump", again, were that true, chaos would ensue.
      That's why descriptiveness is usually included in a trademark and "German girl living in America" is descriptive of literally hundreds of thousands of people, for just those with German citizenship, of which I doubt that the conceded trademark is.

      As an American, you are making this ridiculously personal and being overly dramatic. Please stop bashing your fellow countrymen for the behavior of a small minority (or in this case one or two individuals). This is just the business of branding. Branding is big business wherever you hail from. Feli is clearly not worked up about it. She's found a way to move forward that is both acceptable and good for her. Yes, she is being a little passive-aggressive with her language, thereby manipulating your emotions, since she knows that she has no legal recourse. What is your excuse for acting like a child?

      I always say this, you make your name, your name doesn't make you. The other woman can be German Girl In America, and not have any viewers or sponsorships. Feli can be Feli In America and have lots of viewers and sponsorships.

    More accurately, Karen is an American woman, with German ethnicity, born and raised in the US…With German traditions at home, but immersed in American culture and lifestyle all day/everyday outside of her house, and throughout her entire life and childhood…There is definitely a distinction between that and “German girl in America”.

      At least she's only a 2nd-generation immigrant. Not like if I tried to claim to be "German in America" as a 6th-generation immigrant German American where my most recent ancestors from Germany moved to the U.S. in the late 1860s.

I don’t care what your channel is called, I will be here for it. As an American old lady who lived in Germany for 10 years before moving to Sweden, I enjoy your content and perspectives enormously.       I moved from California to Northern Germany as a result of a dream I had as a teenager. I yearned to experience a different culture from WITHIN the culture and not as an observer on the outside. I first lived in Paris for three months while waiting for the completion of the paperwork required for my job in Northern Germany. It was awful for me - talk about culture shock! But it helped prepare me for Germany and in the end I came to truly appreciate Paris. I turned 38 two days after arriving in Paris. It took all those years in between to finally fulfill my dream. If you find Europe “old and boring”, I suggest that you focus your energy on creating and fulfilling a dream for yourself that lights your life. Good luck and happiness to you!

    Feli from Germany - a brand name that represents everything kind, gracious, entertaining, and wholesome about German language and culture. It's sad to see what you've had to go through, but it's you and your effervescent presence that makes your channel worth watching. Your old name just made it a little easier for newcomers to find you; it's now up to us devoted fans to make sure your success grows by sharing your videos with our friends. Quite honestly, your channel is not just informative and entertaining, it brightens my days and has helped me feel better connected to my German cousins in Hessen.
    I would welcome you re-releasing old videos with your new branding. Let's face it, North Americans love watching reruns of old television shows, so why not reruns of Feli from Germany? And as I think about it, some of those old television shows are rerun with updated openings segments because the producers changed them over the seasons that the show ran. ("Petticoat Junction" comes to mind in this regard.) So go for it!
    You might also want to do a new episode "Crazy American Laws!" to complement your "Crazy German Laws!" episode. Your perspectives on U.S. copyright and trademark law are spot on. Sadly, it's often not creators and artists who are most protected by America's laws in this regard, but rather those who often trade in the creativity of others.

      Luckily, just existing with a name is enough to mark your territory generally in US copyright law. Notice that the other girl from Germany didn't copyright it till 2020 this year - but their case still had merit because they could prove that they existed long before that. I'm sure Kari and her team checked that they would be the first to use this name.

    I'm really astonished that "the other channel" actually managed to trademark a rather generic term that's a common way to denote a person. Especially since it's not even a true statement on her being a proper American, not a German in the US.

      I'm shocked about that too. Also this Karen person is mostly blogging about Bavarian (where Feli is from) things when her family isn't even from that area or culture at all. Her ancestors are from Schlesien, Preußen and NRW as she claims herself. So she's not only claiming to be German when she's American but also appropriating another culture that isn't hers. Seemingly all for the money, that should be clear after a move like that

      Yeah, I didn't realize one could trademark or patent a generic phrase like that. I remember some court cases back when Microsoft sued for the name "Windows", when it was already commonly used across the computing and programming world even before Microsoft named their OS such.

      My wife is a first generation American with both parents born and lived in Germany but she doesn't consider herself a German girl in America but an American. If this Karen woman has only visited Germany a few times I wouldn't consider her a German girl in America.

    My Dad, who is 90 years old, was just here for a visit and couldn't wait to show me your videos! So I found your channel after you changed it to "Feli from Germany" and think it's a great name too! It was so much fun to watch them with him! My brother speaks German very well so he and my Dad have been to Germany a few times and loved it! Thank you for making your videos, I love them too!

    Long time listener, first time caller. You are doing exactly what you need to be doing! For 30+ years I've owned and operated a business (200+ employees) -- trademarks, patents, lawsuits -- everything. One day the fire department wants to shut you down for an illegal extension cord, the next day you're dealing with employee theft, the day after that you get sued for trademark infringement. Every day there is something that makes it nearly impossible to focus on the business plan, any yet, that's what you have to do. Onwards and upwards, Feli from Germany!

      That's what I thought to because to a lot of Germans Karen wouldn't be considered as German as Feli.
      Karen is an US American woman first because she was born there, raised in that culture and still lives there and then a German second because her parents are. Feli on the other hand, born and raised in Germany and an immigrant to the US. That is a difference.

    I was curious about this other channel with the copyright. So I went over to see what it was. Outside of political content, I don't think I have seen so many "unliked" videos. It is good that Feli is such a good person and just moves on.

    Feli, my father is a retired defense attorney. By the end of his career, he hated plaintiff's lawyers with a passion. I wouldn't be surprised if Karen had very little to do with this...that her lawyers saw an opportunity to make money if you decided to fight back, and might even be a bit disappointed you folded.
    The algorithm has been sending me your videos off and on for more than a year now, and I've been interested, but I admit never enough to subscribe. But I've been in the background of enough meetings to completely share my father's opinion, and so that changes NOW. Liked and subscribed.

      @@craigkowald3055 Many times. My father was involved in some pretty dirty cases, and as you can imagine as a defense attorney he was often on the "wrong" side. (Knowing the real story behind these cases and how complicated they were has made me extremely cynical). Even in these, he found that as the way plaintiff attorneys were paid changed the cases became less and less about the actual client and more and more how much the attorneys could milk it. He'd probably tell you that there are very few plaintiff attorneys who aren't ambulance chasers anymore.
      I'm glad Feli is still able to smile. It's a beautiful smile.

      Yes. I was shocked and thought that something horrible must have happened to give up such a great and (I think) successful channel. I was relieved when it was just a name change then got angry again cause it was trouble from such an insignificant, not even German woman with a website so outdated that it could have been hosted on Geocities and a youtube channel with so few views that she does not even exist. If it was a giant corporation... Yes. That would make sense but this tiny Karen person.

    1: a girl born and raised in California is not a German girl. No matter where the parents came from.
    2: you are a German girl who lives in America. That means you ARE a German girl in America and THAT means that YOU are the German girl in America.

      Why do people on this video have such a hard time understanding dual citizenship. If she was born to German parents, she is German (as well as American if she was born in the US). Most of the people upset about her being German would be up in arms if they had a child born abroad and their child didn’t get their citizenship.

      @@laurie7689 “We use geographic citizenship here.” This is false. Geographic citizenship, or jus solis, is just one way to have American citizenship. Children of US citizens born abroad also have rights to American citizenship under the specific rules in place at their time of their birth. This is citizenship through jus sanguinis, or blood.
      But either way, what would US citizenship laws have to do with someone’s German citizenship? German law determines German citizenship. That’s it.

If you aren't born or raised in German or have lived there for a good amount of time and therefor have nothing to do with German (besides just your parents) nothing qualities you to call yourself a German.       I don't mean to offend any Karens, but acting like that and demanding a 6 figure compensation to "use her name" just emphasizes her name, and proves she is American and not the "German" she claims. She was born and raised in California, so she is just an American with German parents. A website and UA-cam are different things.

    As a first generation German-American, I was mildly interested in checking out Karen’s channel when you first described it, but by the end of the video I had lost all interest in supporting them in any way. I’m so sorry you have had to go through this but I am happy you are going to continue to make videos and I will keep watching.

      This. It's way too similar to some of the stuff I've seen authors doing with copyright enforcement. I agree theft is bad, but being able to trademark something so purely descriptive is ridiculous. And their behavior enforcing it was deceptive at best.

      They could have helped each other's brands but the way Karen handled this, it could harm hers. There are people who react to music and a lot of bands see how this can help people find their music. Some bands though don't see it that way and have the videos taken down. It's kind of the same idea here where they could have hyped each others content every once in a while and maybe even made videos together every now and then or Karen could have interviewed Feli for her blog. They could have had cross platform material that could have helped them both and it would have been interesting. But now Karen shot her self in the foot.

    Seems to me that Karen was just butthurt that you are more popular and definitely a better person. I'm not sure I could have handled this situation with such grace and poise.       One way to help handle this situation is protest against the following but without sending hate:
      *Karen registering the name 'German Girl in America' as a trademark after Feli started her channel.
      *A lawyer telling Feli that Karen told her to stop using that trademark, which Feli denies Karen told her.
      *The U.S trademark and patent office regarding the name 'German Girl in America' to be "distinctive" rather than a descriptive mark.

    First, I am delighted that “the end” only meant a name change, which is one of the reasons I “liked” the video. Second, I think you explain the situation well and demonstrate the gracious nature of Germans in your handling of the situation. Third, I like the new name. Fourth, I would appreciate it, when the dust settles, if you re-branded your old videos about language, correct German pronunciation, and about Oktoberfest/beer culture as these are the ones I rewatch and share with others. Although I also enjoy your reaction videos and explanations of German politics/elections in a non-partisan way.

    My wife and I share your shock at the absurdity of the situation in which you found yourself. We truly hope it has worked out OK for you.
    From our perspective ...
    We were in Hamburg many years ago a few times for quite an accumulation of time ... and enjoy reliving that - even if only vicariously through you. They were some of the best times of our lives.
    We traveled all over Germany back then - literally every region. St Perer-Ording, Berlin, Heidelberg, Frankfurt, Munchen (sorry about the spelling with US keyboard), etc.. Each location, and the people were absolutely amazing.
    Much like your time, we are sure, in the USA has been.
    Thank you for what you are doing. You are helping us relive so many wonderful memories.

    Karen could learn something from the craft brewing community and the story between Avery Brewing and Russian River Brewing. Without knowing about each other, they both named a beer Salvation. When they found out about it, they not only decided to leave each other be, but some time later they created a blend of both beers to highlight the best qualities in each. They named the new beer: Collaboration, not litigation Ale.

    US Copyright laws can be daunting to deal with, I am glad that yourself and your friends have been able to work through the rebranding. I do not really see much of a need to release videos again personally, the blurring out etc doesnt really bother me much and of course that is something that as new people subscribe they will see that as merely another way that you have shared how you have experienced living in the United States. Thank you for the great content and look forward to much more in the future Feli. Best wishes moving forward :)

      Trademark law, not copyright law. Copyright law is pretty much the same in all countries that signed onto the Berne Convention.

      @@shannonrundquist2706 Karen has been operating under that brand for 7 years. Feli for 3. Feli would lose that fight since "the internet" is considered to be one place. It's not like having a AAAA Auto Repair in Philadelphia getting bent out of shape because someone else is AAAA Auto Repair in Albuquerque. They aren't going to be confused.
      edit: I should point out one aspect of trademark law that a lot of people don't take into account. In order to keep a trade mark, you have to vigorously defend it. If you let someone else move in on your mark, you could lose it.

    I've been subscribed to you for about a year now. I've never heard of this other "German" girl, but now I will be sure to *not* go find her. The Petty Patty in me says you should go make a "Feli from Germany" blog and Facebook page on German traditions in America. I'd subscribe to that, too. ;) Good job handling this whole situation with as much poise and grace as you have. You are a kind soul.

    It may help in future to also be aware that in many cases if a person registers a trademark, brand, or business name which you have been using prior to their registration you may be permitted to continue using the associated name and may even be able to appeal their registration of the trademark. Due to the nature of trademarks, if it is already in use by more people than the one trying to register it the trademark becomes invalid.
    For example, from what I can see Karen Carlson did not file to register the trademark until August 31, 2020 and the trademark was not granted until September 28, 2021.
    If I were in your situation, I would have lodged an appeal to the trademark office to de-register her trademark as you were already using it prior to her application. Furthermore, I would have ignored the letter. A cease and desist is just a threat from a lawyer, or individual, that if you do not stop what you are doing then they will take legal action. For example, the companies that I own have to issue quite a few cease and desist letters every year to people that try to impersonate us and while they generally comply, if they choose not to then that letter holds no real enforcement power and we would need to take them to court and attempt to get a court order from a Judge.
    Of course, I do not know your full situation, though my companies have been through similar problems, and there may be extenuating circumstances such as business registrations, company name filings, etc, that would need to be considered as well.

    Of all the Toobers I've been exposed to over the years, you have the most natural camera presence. Your diction, tonality and pacing is flawless, and what little is left of your accent only provides added interest. I think you have larger worlds to conquer than UA-cam.
