The VERY fact that Pigeon Forge knew this property was for sale 2 years prior and never said a word is down right dirty!!! We all know it takes YEARS of planning to build new roads. Why a sudden change of direction? Why didn’t the city buy the house/land when up for sale? Why not imminent domain then? Just dirty in my opinion and I will never be visiting the area again.
Because the mayor's brother, from what I've read, has part interest in the campground that was bought, where the road was originally supposed to go.
It's the government. You don't expect them to be honest!
The buyer needed to His due diligence which he didnt
@@adamsilberman9377ohhh so its the buyers fault they got their home taken away like this. Are you related to the mayor. How much did they pay you to comment on here.

They are so much more to this story that is talked about on this little news clip. Through the fault of the realtor, they did not know they were going to put the road through their property. They spent a ton of money, renovating the property. The mayor of pigeon Forge watch this all go down literally from his front porch. Years before these people bought this property that road was going through an abandoned campground next door. It was changed because a group of people bought the abandoned campground. One of those people was the mayor’s brother. Again, it is all a big mess. The mayor was called out during a council meeting. The mayor said he had no moral obligation to tell those people to stop renovating the house because a road was going through there. The mayor lived on a hill above these people!
They should have excepted the money

The Mayor of Pigeon Forge has people blocked from commenting on his social media pages too! Also, the mayor owns adjacent property to the Race family.
The only right thing to do is sue the mayor for his property.

Eminent domain is how pigeon forge became a tourist attraction. 💯 My ancestors were given $400.00 to vacate their homesteads in Cades Cove so that they could let strangers drive around.
I know someone who gets $3,500 a month from power company for having their lines on his property, I know it’s terrible, you get paid for someone to use your property. 😂
@@TheMW2informer hopefully they're saving that 3500 a month because when the time comes, the payments will stop and the power company will be claiming ownership.
It is NOT theft. This is a lesson in NOT doing your due diligence as a buyer.

Anyone who thinks they actually own their land in America is just silly.
I agree. No one will ever own their own land. The government, the tyranny thereof, own everything. No matter how much you pay, no matter how much you work, no matter what you do... Just ask the indians
I said this same thing to the woman this story is about! She has a UA-cam channel BTW
You are right if we don't pay property taxes that when you find out who owns the property.
Just ask the indigenous people!!!
For most people an ownership in any type of property is subject to a negotiated price, few being stubborn enough to refuse a fair price. Though a long settled owner's residence in a location they are well happy with and with long developed landscaping, gardens and outbuildings (and maybe a few faithful pets buried there) and the desire to stay there forever more; then nearly any price may 'seem' too little to trade.
These people were deliberately lied to and misled, and this guy is smiling??? I hope this family sues and wins BIG time.
They want 3 million for the home. I hope they get their 500k and stay out of Tennessee, they are just plain greedy and so is the city. The entirety of Sevier is just gross from over development.
The smiling guy has nothing to do with this case. He was just giving information.

I've been following this story and Pigeon Forge did NOT pay them a red cent because of the mis-characterization of the zoning-the Race home is zoned C-6, not residential as the appraisal indicated, a big discrepancy that allows the city to give them much less value on the house, but because the Races balked at that, they've received NADA. The road went through their house because one of the men on the council owns the camp ground next to the Race's home and the city took out a family's home instead of the camp ground, simple political chicanery and favoritism. The Races spent thousands and thousands renovating that house, other than the purchase price, plus the zoning in the city's appraisal being mis-characterized as residential when it is C-6, commercial, and would have netted the city a hefty sum over time as a business, but values the home as less than it is worth in C-6. But, oh, no, the city literally stole their house. They knew they would be taking that house and watched the family renovate it, said nothing to them. They were completely kept out of the loop so that it would be a surprise and they'd not have time to fight it properly. Eminent domain is government theft. Common good is a myth. What about the family's good? It's the worst thing ever sanctioned in our government. The fat slob sitting there ignoring a family's pain is disgusting.
It was cheaper to buy a single house than a campground
Here’s a few facts Mrs. Race never mentions in her social media posts;
The city approved the route in November 22, 2021. The Races bought the 1047SF home for $306,000 on August 17, 2022 nine months after the route was approved. If they would’ve had a survey done, which everyone should do when buying a property, the survey would’ve clearly marked the right of way. The city offered them $490,000 for the property in October 2023. The Races counter offered with $3 million. The city then offered them $539,000, a figure that represents $514 per square foot. The Races counter offered with $1.5 million. The Races have never presented any appraisals or documentation to the court in support of their $3 million valuation or their latest valuation of $1.5 million. The city did offer to allow them to rent the house out until is was demolished however the Races never made any effort to rent it. The mortgage was paid off from funds held in escrow by the city.
I’ve done appraisals in eminent domain cases and courts don’t award valuation based on what ifs. Courts award money according to the value of the property or properties like it the day it was condemned. The court is not going to award them money based on income they claim the property might make for their children and grandchildren in the future. That’s ridiculous.
@@wasidanatsali6374 My first thought was they should have taken the 500k and been done with it and used that money to find another "dream" house. Your post validates that thought. Maybe I would have a different opinion if the property would have been in the families for decades.
@@adamsilberman9377maybe? Maybe not?

And he laughs.
He’s a demon.
Eminent domain is used and abused by municipalities, county, state and fed governments every day. If the case is still pending in court I’m surprised the house has already been torn down.
That is how dirty this deal is.
Small town politics is ruthless.
Welcome to Murika.
You'd think the city and mayor (isn't he the mayor from Dukes of Hazard? He's a stereotype) would need an order forcing the property owner to accept a price before demolishing the place.
The tyranny is neverending.
Yes, I'm sure all those people in Pidgeon Forge are dedicated Republicans.
What Tyranny??? Seriously, this is a much needed road for safety and the benefit of those that actually live in this community.
Doesn't the local community have rights?
so Wait, they are offering 500,000 when the house was purchased for 320,000?. Take it from other people who have had the same fight... it never goes the way of the home owner. Agree to the money before the pull the offer back and offer less and cut your losses. The only thing that is going to happen if you don't are vast legal bills.
Yep same thing happened to a property owner in my hometown. The state was expanding a road which needed the property their old mom and pop gas station sat on. Mind you they were old and should have been retired. The state offered a million dollars and they turned it down. Welp the state took it under eminent domain and gave them market value of 125k for the property and building. So this family is fortunate that they are gonna make dang near 200k. Take the 500k pay off the loan and use the rest to put towards a new home. But they want to be greedy and try to get rich when they gonna end up with the loan paid and no extra to put towards a new house.
Been following this since day 1 on UA-cam. Eminent domain sucks. My grandparents property was taken this way. Glad they're fighting back and finally getting some media coverage.
Cant fight back. Theyre just looking for a bigger pay day
Its not right... but they paid 300,000 and the city offered 500,000. The house is already gone. Take the money and move on. Lawsuits take time and money. Ultimately, the lawyers get 1/2. Which will put you back to the original offer YEARS LATER.
I get the whole “ they were screwed by the mayor and City “
But? They were offered a good amount! I would have took it and ran!!!!😂
I would have just jogged. I did the whole running thing for about 20 years!
Our men only care about money. No wonder we're enslaved.
Eminent domain is a complete scam period!!!!!! on so many many levels its pathetic!!!
But of course neither should a community's future progress be held back by some person desiring to hold it back by spite, revenge or for an excessive profit.

@fivespeed3026 governments only pay fair market value when forced by a court, otherwise they will low ball you every time
Yes, eminent domain is a very difficult and controversial issue. But remember, the land was not “taken,” insinuating they got nothing. They purchased the property for $306k a few years ago as a vacation home/investment property. The municipality offered $500k, which sounds appropriate for the amount of insane inflation (an entirely separate conversation), and the owner refused. This sounds to me like sheer greed under the guise of “the government is taking our family land.” What a joke. They’ve only owned it a few years!
Thank you! They countered the $500,00 with 3 Million. Totally ridiculous for a second house which is an investment property. They won't get more money.
@@lisadaisey1464Probably added the revenue they thought they would get from the house. I understand they put time and effort in the house but I just can’t think it’s the same as losing a house/ property that’s been in your family for years. They’re not having to move and uproot their whole lives because it’s not their main house. Can’t fight the eminent domain unfortunately, it’s been around for years, just look back on how many lost when TVA came in and Oak Ridge. I know a lot of good things happened but many people and families were destroyed because they were never able to overcome losing their farms, houses, businesses and communities. The government has the time, money and courts. They’re making themselves miserable and I’m sure the time and effort they’re putting into this is also costing plenty of money.
It sucks to be screwed over by the government but you definitely let them win if you’re letting it dominate your life and drive you crazy!

Hubby and I went to Pidgeon Forge, it was so built up and crowded we changed plans and went to Cumberland Gap area in Tennessee. Best decision we could have made.
That’s why it’s best for Libs to just stay in the states that they are in and deal with what they voted for instead of moving to the south and ruining the south too.
The crowds and traffic are why they want to build that road.
Eminent domain should pay you twice of what your property is worth to ease some of the burden caused by them.
How can the city demolish the home if no offer was accepted? Isn't that illegal because they don't own the property yet?
If the parties cannot agree on compensation, the municipality can put its last offer in escrow. It can then take the property in question, leaving the former owner to either take the money offered or take the case to court to get more compensation. Years ago, I actually saw an auction where the buyer begged the former owner to let him move the house to the back of the lot so he could still live there. The man refused, so the buyer took the house apart and reassembled it elsewhere. That lot is still vacant.
No they will give them the last offer but now they think they should get 3 Million for there $300,000 property & suing. They won't get anymore money & they will spend more on legal fees. They could had payed the mortgage off & had money in there pocket to find something else. Facts are they were in negotiations since March 2023. They approved the road 3 months before they bought the property. The sellers probably knew & the realtor should have made them aware. It sucks but it also help the people who live here full time. Most of us can't get to work to serve the tourists because roads are backed up. This road will help.

These Ohio folks demanded 3 million bucks, have reduced the demand to 1.5 million.... sorry about a road going through a place you bought as a rental 2vyears ago, but greed is not a good look. The city has offered them just shy of $200,000 dollars more than they paid for the house 2 yrs ago and they don't think that is fair? I get they had plans but seriously they only had the house for 2 years and the city is offering avery fair price. They can go find another home to have in the family for generations.
Oh grow the hell up. It’s a second home they owned for two years and made a $200,000 profit on. They need to just shut up and stop wasting everyone’s time.
This is why imminent domain should be outlawed or HEAVILY controlled. People in power abuse this. The city I currently live in tried to take half my dad's property WITHOUT paying for it and installed a drain pipe that let the water and runoff from the nearby gas station flood our backyard. My sister couldn't go out back for months because the runoff gave her sensitive skin rashes. The city eventually gave my dad the property back and removed the pipe after being threatened with a lawsuit.
Second home?! Investment property?! Who cares. No sympathy. You get paid for eminent domain,so buy another one.
I think it was a strategic mistake for the property owner to say they might rent the property when they weren't using it themself - that surely implies a commercial intention and hence as an investment property making the eminent domain acquisition appear more acceptable (of course with the house itself leveled it's not easy to go back). And that crude map shown sure puts the property smack dab in the new roadway's path (so a defense saying it's arbitrary doesn't seem helpful to negotiations).
That's more than fair value. Stop being pains about it.
We’re from Ohio, after seeing this I’ve cancelled our reservations we won’t be bringing anything from our house into Pigeon Forge.
ok 😂😂
Thank God. Stay home
What do you want to bet that the previous owners had inside info about the new road being put in and ditched the property while they could.
I have been following that for a while, the mayor watched them renovate the home, from his home above them, the new road was moved from going through a empty field, in favor of a campground being constructed in the field. And it took that family's home. The city of pigeon forge has some sleazy government, and that town attorney, looks so crooked, I'd almost bet he sells used cars too.
I'll be glad when God takes all his land back
They are just greedy and holding out for more money. Their house is gone. It can’t come back. They would just take the money unless they wanted to try to sue for more and more money. They can’t sue for the home back. It’s a money grab. They bought that house to air b&b. If it was their primary home I’d feel for them. She even had her daughter sit for the camera and not say anything. What was the purpose of that if not to play the victim card.
Guarantee: the seller sold the property _because_ they knew about the plans for the road.
Caveat emptor.
You can go to the city and find out if there are future plans for that property and its neighborhood. Or if it's sitting on top of a worked out mine vein or toxic waste dump.
You should always do that.
Yes cause the mayor owns property beside it he new what he was doing

They'll come for your houses next 😂😂😂😂 are you joking ?? Or just slow?
Why is the road needed? Because of all the people buying up properties in the area and contributing to the congestion.
$500,000 was a fair offer. Makes you just want to stay up North right? If you and your friends stay home in Ohio then we won't need more roads thru peoples houses. You could be saving somebody else from this.
Whatcha wanna bet the person they bought it from knew what was coming and dumped it on them
Good ol boy govt in pf
Obvious
Yes this happens. You can buy the land back at a higher price than they were paid when the road plans change.
She bought it knowing it would happen . She bought it thinking the city would pay more for it if she had a loan on the property.
Exactly that road project has been going for 4 years already.
Bingo.. Greedy family wants 3 million for a property they paid 300 K for.
@@CreekSide1779 Pigeon Forge did pay,....they want more, 3 million they asked for. This is all public record and published in many news papers and on the Towns web site.
She is the one who refused to cash a check, that was over 200,000 over the sale and appraised prices,...the Town was more than compensating her for her "troubles"
IN FACT IF YOU WERE TO GO AND PURCHASE PROPERTIES THAT WERE BEING SUBJECT TO EMINENT DOMAIN,...YOU COULD MAKE A TIDY PROFIT JUST BECAUSE MOST CITIES AND TOWNS PAY MORE THAN THE PROPERTIES ARE WORTH,..?????????? MAKES ME WONDER??????
We will never again spend a dime there.
Why didn't the city but it when it went up for sale if they only had it for a few months?
They are just greedy and seeking attention.
Oh an investment property. Meh I don't feel bad for them
The big problem is to get a replacement is going to cost more just in interest of a new mortgage.
This is so sad. I hope the family wins.
the US Government needs to pass a law the prohibit any city from claiming eminent domain and they should sue them
Bald guy is just as bad as Pigeon Forge. I would have sat on my property and defended it when they came to tear it down.
He is an attorney commenting on imminent domain, not connected to the dispute. Watch the video again.
“If you don’t like the road you’re walking, start paving another one.”
-Dolly Parton
I don't believe they will win this one. If it was a Walmart going in, they would have a good fight. Reducing traffic issues for the general public is within the spirit of what eminent domain was meant for.
Now if the general public rallied around this family, the city may back down.
why? so they can get more tax dollars than the property is worth?
We wont rally around more outta state investors making our peaceful neighborhoods into party zones for tourists.
Why didn't they buy the house when up for sale.
I had wondered that too. If the city already knew it was part of the eminent domain plan, why didn't they buy it for $300,000 from the original owner instead of offering $500k to these Ohio people?
You have freedoms until you don't - George Carlin
You have "temporary privileges" he said.
@@EattheApple666 Arnold got it right when he said screw your freedoms
Pigeon Forge will win this one. Eminent Domain should only be used for building schools, roads, and other things that benefit the greater good of the people of that state. Just take the half a million dollars and buy something nicer out in the middle of nowhere.
The family paid $306,000 and want 3 million😂😂😂. They're shooting for the stars!! And the daughter says "it's not about money". 😆
The government should have to pay 10 times the value of the property and allow the owner to use a third party appraiser.
It was a vacation home. Not exactly a sob story
I live in Chattanooga ,I will never spend another single cent anywhere near there ever again.
Sad I have watched this since the day it started and the house is gone and the couple still owes on the house.
That's why you have title insurance, to protect the mortgage lender.
@@jannibal9273 Title insurance is to provide remedy. Its highly likely the company would defer the lender to petition the court for access to the money that the city has put into escrow as the only logical remedy.
Totally unsolicited opinion on how this is going to end. They were offered, after negotiations, fair market value which in my opinion would cover the purchase price, renovations, and increase in value over the short timespan of their ownership. Their train went off the tracks when they turned down the fair market offer and demanded millions.
That is greed and is just as disgusting and wrong as eminent domain. It doesn't matter what was disclosed by the previous owner who may not, and probably didn't know there was a road planned through the property. As such, they could not disclose it, these things happen. The shadiness of the whole mayor, campground owner, good ol' boy thang goin on notwithstanding, they just don't have a legal leg to stand on.
They will sue the city, they will spend FAR more in legal fees than they would have made on the house had they taken the negotiated offer of over half a million for that shack, and they will lose.
This lady claims to be a christian and as such should pray about her motives and have God search her heart so that SHE does the right thing. It's hard, but that is just. You can't fight city hall especially in one filled with nepotism.
Those people are ridiculous..they think they are privileged..They have no family ties of heritage to it so stop crying..if they have enough money to buy a second home consider themselves fortunate..It's not like they were living there.
Her website says she's the first millionaire in her family. 😭😭😭
They also own a investment property in the Outer Banks.
Eminent domain is for the government to build roads and bridges, not for private businesses to strong-arm property owners into selling their property for a song. This is a textbook case of government corruption.
Just take the half a million and move on! It’s a $300,000 house. I say that’s a nice profit.Dont try to make it a bigger payday. There are many beautiful houses out there. Buy another.
exactly even zillow only valued the property at 369,000
@@rebeccalynn7795 Zillow valuations are worth ZERO dollars and maybe 12 cents.
They should take the money. $200k return on $300k investment is a good deal. Take that and buy a place that won’t be next to a major highway or in the middle of that Pigeon Forge sprawl
Half a Million is fair, I don't see a problem with this. There are plenty of homes and land to build on. Owners need to get out of their feelings and just move on. I have a home on English Mountain please build a road through my home and let me get off this mountain with dirty brown city water that costs more than it should.
Seller knew, realtor knew, county register knew, bank knew, appraiser knew, they were all in knowing it was an out of state buyer.
