JSC responds to criticism about Chief Justice interview process

- While the Judicial Service Commission's recommended candidate for the country's Chief Justice, it's the process of getting to the recommendation that has also stolen the spotlight.
The Helen Suzman Foundation says it's still deciding whether or not to approach the court to set this process aside.
While some say the interviews were sexist, displayed political bias and disrespect at times. Some say that this does not mean the commission should go easy on the candidates but say it should be fair and relevant.
So how does the JSC think it fared during the interviews? SABC News speaks to Adv Dali Mpofu who speaks for the JSC.

Questions seemed to be targeting specific candidate. Unprofessional behavior by some commissioners. Dissapointed such a high office. Political campaign not interviews.
Zondo is a politician as he holds a view on political expressions and he went as far as to intervene on political discourse. Mlambo held it together up until the question of sexual harrassment allegations that he himself confirmed the knowledge of the said allegations. He went as far as criticizing his own colleagues calling them back stabbers and schemers to the point that Adv. Dianne Kohler Barnard cautioned him from sweeping statements like that. Madlanga lost it at the end on transformation issues. All candidates were asked consistently by Malema about transformation to his credit and all have answered the question and Maya went on and told them not to pick her because of being a woman but through her track record.
Whether we like it or not.....what happens in there is all politics as it still continues to be even now... politicians are going to play all kind of tricks on our minds,so they get to have Thier way and people support them
Who does Suzman Foundation represent, who are its officials,. who elected these officials, were the elections held in public, how many persons participated and how diverse, what percentage of the country do they represent. who funds them, how many people sit to make decisions at the Foundation, are their meetings public

The very people who blindly support the political polarization of the JSE will one day rue the day when the courts become entirely dysfunctional. Mpofu is a complete and utter moron with clear political motivation. The very same guy who tried to get Ramaphosa to speed up his arrogant quest for silk with the moral compass of a stone shouldn’t be anywhere near this process. And then there is Malema who is trying as hard as possible to dodge the court cases coming his way for corruption. Despicable in the extreme. I think people are not questioning Maya being the preferred. She is an inspirational and deserves because of her credentials. The issue being raised is the process on all candidates. That is something which need to be scrutinised. Not the candidates. But those interviewing most of them leaves a lot to be desired.

Please go read the constitution, the power to appoint the CJ is given to President not the JSC. Why is it easy for the people to chase the wind or other people's shadows. Even Dali Mpofu himself said it clearly at the announcement of Mandisa Maya that their recommendations is not binding on the President to appoint the CJ yet some of you are talking as if the JSC is legally obliged to appoint a CJ. Some of these illiterate people who can't ascertain facts and laws are an embarrassment to themselves. JSC commissioners or panelists were given a courtesy by the President to run the interview process and brief the President about the entire process and their proposals not to recommend a specific candidate because that's not their mandate neither is their terrain because by the law the only person allowed to appoint the CJ is the President only.
Can someone please balance me here, how can an advocate who has cases pending from the constitutional court as well as Appeals Court be tusked to decide who the next CJ or a judge for that matter and this advocate lost many cases from these judges he is supposed to interview without any prejudice???? It can only happen is South Africa. The other one a leader of a political party and he himself is having criminal cases pending on his name, no we far from being serious.

I do not know which interview did people watch but on the one I watched the question was " are you aware of the sexual accusations labelled against you ?" Mlambo replied "yes" and "Are you aware of the brown envelopes allegations against " again Mlambo replied " yes" and the same Mpofu said "of course JP I for one believe these to be unfounded allegations that still have to come to the public domain" of which Mlambo again said yes commissioner I concur and that was the end of it so where and how did Mpofu accuse Mlambo of sexual harrassment ?? C'mon guys c'mon you need to grow up maan, it's true too that Mogoeng interview was way more rigorous than these interviews, but hey he was a Zuma appointee which is why no one said nothing about him

JSC was very bias towards male candidates.
Dali Mpofu is a disgrace to the black professional lawyers. This guy knows very well that by law it is not the JSC position to recommend a specific candidate to the President but here's is all over the place defending the nonsense and the mess they did. The JSC like organs are there to advice the President on the processes of assessing candidates not to recommend a specific individual candidate that's assuming the role that does not belong to them. Malema and Dali Mpofu are the most deceitful and political opportunists. It is a shame that the likes of Malema think we're stupid and doesn't know that they are tried the JSC platform to assume the role of the President to advance their wishful political agenda. I think you understand what was the role of the JSC in this process. The JSC was only suppose to screen test all the candidates present the outcome those interviews so that the President the President as the only empowered by the constitution to appoint the CJ looks at the results of all candidates, ascertain their credentials and apply his mind as to who he odd to appoint, but unfortunately the JSC did not do that instead they shut out the candidates and indirectly assume the mandate that belongs to the President by saying only Mandisa Maya should be appointed which is wrong because that is taking away power from the President as the main appointing authority. What it means is that should justice Maya be appointed it means she would regarded as being appointed by the JSC but not by the President and that's unconstitutional. In simple terms the JSC has unceremoniously prejudiced candidates by restricting the President from looking at other candidates equally,

My understanding is that the JSC was only supposed to help the President by scrutinizing all candidates credentials so that he(the President) and the nation could see which which candidate deserves the position but not for the JSC to eliminate anyone out of the race but I owe you respect for your views though🙏🙏
@@nyanisonzama2999 - the JSC are the ones who gives the President the recommendations, no other professional bodies.
According to the constitution, after the interviews have been conducted the JSC goes to deliberate and the decisions are made privately. They then send their recommendations to the President who then makes the final decision and publicly announces it.
The JSC should not be giving recommendations now in the process or publicly. They should only form a recommendation once the PRIVATE deliberations have been done.
So there is grounds for misconduct.

To be honest I am black and did not bother about who would have been chosen. As a female I am proud that there is a possibility of Maya taking the post. But also the quality of the interviewing its self does leave a lot to be desired. The interviewers some lack decorum and emotional intelligence. I would feel degraded being interviewed for such a role by some of those so called commissioners.

There are a lot of prominent figures who visited zuma house in Jhb whiles Mohlanthe was holding the forth for him as the president. Some could not protect him ( zuma ) others left office before their date of retirement, Kamphepe had to hold the forth for CJ MM. Zondo compromised himself by attending those meetings. We all know those meetings were only about making sure zuma is not to be prosecuted. The PP also visited Zuma's house. Unfortunately their plan failed now the whole country knows. Dali spent the whole night studying for exams with Mandisa Maya, so this simply means mpofu will now ask for favours or expect her to favour him on her judgements. I suggest that Zondo Act for 2 years and then a CJ can be appointed then, or else sisenjeni straight.

It was clear that people was under an scheme by submitting objections proven to be without credible evidences! Instead of dismissing these objections they used against the candidates. JSC should explain its choice...! I think the PR should request advise on dismissing all JSC, appoint new members and repeat the interviews. ZONDO is doing well with other Judges and can still hold the position as action CJ, even for months.

According to my personal opinion as a citizen that watched the interviews. Questions posed were all touching on transformation of the judiciary and wet pro-feminist agenda. I recall when commissioner Malema asked JP Mlambo a question about his perceptions about the country having not had a female CJ since the dawn of democracy. This was clear that they were looking for a female CJ.
Mlambo was to me, the strongest,well experienced and most innovative and not easy to bully. He would according to my own personal judgement been the best to head the judiciary.
I also think the composition of the JSC should also be reviewed.
Unfortunately it's not up to the people who think it should be reviewed. Secondly, JSC cannot be reviewed wildly nolly on subjective critism. Like Adv Mpofu said, it's a democratic right for people to criticize the JSC.

Professional code of conduct has been broken so my statement was made to what the law says. I did. There is no need to rerun a chosen process, no matter the outcome. We all live with outcomes of other flawed processes in our country that are not perfect and nobody dies. People who are often favoured by outcomes other biased processes are feeling the pain of accepting less than perfect outcomes and having to live with it.
I beg to differ, there are plenty of people who have died all because of politicians who fail to recognise that this is a constitutional democracy and must abide by the laws of our constitution which thus far they have not. There should be zero interference by politicians in the choosing of judges for the constitutional court. You can't fix something by ignoring it - plain and simple.

@@maryduplessis2510 You are missing my point completely. I am not talking about the merits or demerits of this process. All I am saying is that, since the process was chosen, it must be allowed to run its course and yield an outcome, desirable or not. Should the need arise to change the process as you suggest, it should not affect the outcome of this particular session because changing the rules as you go is the same as engineering the outcome before hand.
Rules are never changed halfway through the game. The losers must be strong and endure defeat and then lobby for changes of the rules for the next game, without necessarily trying to annul the outcome of the game that was just played. Like I said before, some people are so used to having favourable outcomes that they cannot live with an adverse outcome.
The irony of it all is that liberals are scared of democracy and they will hide behind processes to get their way. We see this everyday in SA, when certain minorities don't get their way in democratic political processes they run to the courts to overturn the outcome of a democratically determined outcome, all in the name of constitutionalism based on our "flawed" constitution. Even the outcry about the process we are discussing now is prompted by inability to accept a democratically determined outcome.

Casac and Helen susman thing they represent all South Africans and they are the angels of democracy. It can only support their process and outcomes that they will approve. The JSC did a great job. Casac and Helen susman including their supporters are disappointed by outcome. President wanted advice on whom to appoint and JSC has delivered.
