The problem with that is the contract that the previous board made with Phillips prevents him from being fired, even with cause. The previous board tied the current board's hands and then all but two of were voted out of office. It is also the previous board that generated all of the legal fees for their antics prior to being voted off the board. There are still two of the original board on this board. One has to wonder what they're thinking now.
