    Having a guardian robs you of living your life independently especially if your disability isn't hindering you from living your life without restrictions.

    If a person regardless of disability wants to be his/her own guardian then they should get that chance. This is coming from a cognitive disabled person who is their own guardian

      I 100% agree with you, I made my own comment on this. I'm also a cognitive disabled person who is their own guardian and I'm a registered voter and I have my drivers license.

      @@mariofannick5001 I personally think that even if they don't have a job as long as they have government assistance and could manage there own fixed income are reasonably competent and are capable of performing common task around there house then I don't think they need a legal gaurdian however I also think a job coach who is qualified to work with people who have disabilities would help alot.

      Same here! When i turned 18 i was still a child because a guardian decided everything and we often fight because i wanted to be adult like everyone of my peers and now i'm 29 years old and i live alone in an apartment and i work but i'm still very sad to never have been a young adult i went from child to 26 years old 😥😥

      I am being forced into a group home because of my congive disability, I am high functioning, I am being forced to have a legal gaurdain because my family consider me Incompetent ,unable to handle my basic needs this isn't true .

      @@lrowerowe7207 I wish I lived in the same and country as you because I would advocate on your behalf. Do you have some kind of a support system that can help you? I am so sorry that you are going through this! To tell you the truth depending on the group home whether you share a room or are solo they are not that bad. I would have a talk with your family because you are not your own guardian that you should be able to have a say on what you want. Depending on the country and city you live there are many different living options that are open for you to choose from. For me I live totally on my own but with supports, which one option another is 24 hour care but in your home and another is a roommate companion! The roommate companion where I live is probably the most popular because you have a choice of living with either single or a married couple or a family. Unlike a group home you have more freedom in living with a roommate companion who often treats you like family 🙂. I hope everything works out for you and that you will be able to stand up and make your own choice

    my brother has abused my mother by neglect but the judge felt confortable in granting this guardianship cause he got the money, for them ,,,curruption level 1 they don't care about the person.

      of course I already Appealed the Judge Ruling but we''ll see the BX County clerk was already suspended for corruption ,,now waiting to see if he send my note to the appellate court but will check ,that's how you get cough again..

    Depends on the circumstances like if they are getting in trouble a lot absolutely. If they are aware of what is right and what is wrong and follow that then no. If they can live in their own with no problems then absolutely not

      Even if there on social security have a disability and can't seem to hold down a job, I still think that as long as said person is cabable of managing there own fixed income paying there own rent and doing the common task that need to be done around there house and are reasonably competent to make decisions then I don't think that they necessarily need a legal gaurdian even though they could most likely still benefit from an employment agent who works with disabled adults.

    Even if they are on social security have a disability and don't currently have a job as long as they know how to buy there own stuff manage task around there house and can manage there own fixed income and are mentally competent enougth to make reasonable discisions then I don't think that they necessarily need a legal gaurdian.

    We are going through this now that my dad passed away 06/04/20. My adult sister is 58 years old has lived with us for two years I'm her sister). She loves her day program and friends. Our sister wants to stay here. All of us agree. But it still costing $4000 with attorney fees. You need to be bonded $400 and court appointed. What about families that can't afford that?

    Abuse happen when Social security disability says that you can only work 1280 hours a month and the disabled person can work more . The goverment says that all disabled acted like children and you have a representive payee who make all your decision.

    My son is 28 and has the mind of a 5 year old. He is on the severe level, and I just lost guardianship.

    I believe I live under a secret adult guardianship, I am not allowed to know I am under one due to the age I was while placed.

    No. Its as simple as that. As much as you may not like it, they do have unalienable rights as guaranteed by the bill of rights.

    There is a major conflict with Probate Court (Guardianship) and Family Court. There was a case where both parents had joint legal custody in family court; however, the mother went to probate court and a judge in Essex County New Jersey created an order that conflicted with the order in family court. Although the child was 18, the child was still in school which technically gave family court jurisdiction. So in Essex Famoly Court both parents had the right to make legal, educational, financial, and medical decisions for the child while in probate court only the mother had the right to make legal, educational, financial, and medical decisions for the child.

    My criminal brother has my father and my self and other honest brother tied up in court. Trying to get guardianship of my 95 year old father who has a sharp mind and passes every mental test they throw at him. Who still has a drivers license and has had to take a drivers driving test every year too keep his license state law. Just recently diagnosed with Congestive heart failure and severe arthritis of hip and knee and sold his car gave up driving. Reason he wants Guardianship is to steal his money and farms. Believes because he is oldest son he is intitled. My father now saids pretty bad when your oldest son is your worst enemy. Has spent thousands of dollars in lawyer fees to stop this insanity. He lied to one county and said my father was living with him and snuck it through. Had to hire a lawyer to get that removed. Then now he went to the county my dad lives in and is trying to get it back. The lawyers both sides and maybe even the court system just drag it out to line there pockets.
