Why article 31 was abolished? I’m not able to understand clearly. Article 31 says no person shall be deprived of his property except by the authority of law. That means govt can still deprived land under this article with an amount of compensation. And also there is no difference in meaning between article 300A and 31.
The intention ought to be highlighted. Iaws are made not to protect but infringe fundamental rights which cannot be challenged will lead to tyranny and failure of democracy. Parliament ought to introduce laws under the garb of Article 31 which are contrary to the spirit of the constitution. In this case Article 31 ought to be reviewed and provisions which are tyrannical struck down. The responsibility of Parliament and to maintain supremacy of the Constitution ought to be with the President who can seek opinion of the CJI. Or, voting ought to take place even on the objections or option of the opposition parties to check introduction of articles and laws which are contrary to democracy and welfare . Maintain Checks and Balances .
thanks sir. In case of liquor ban in some states put DPSP before FRs. In Art 31C it is mentioned that in application Art 39(b),(c) FR Art 14 and 19 can be compromised...than why for liquor ban which is also mentioned in DPSP Art 47 we compromise with FRs?
Hello Lakshyajyoti, we can say that it is compromising FR, but for larger social good, it is and can be compromised. Actually this matter has been brought before Bihar HC, Where the larger perspective has been observed. Secondly, This starts with executive order and later accepted as usual case.
