Sir.. kindly, reply me for the following question. 1. My AS is going on at Dindigul, principal sub court... The case was filed appealed by the appellants in 2015. And in 2017, the case was dismissed for the dismiss for the default.. the case was restored in 2020. Later, my case was delayed on due to corona, and absence of sub judge as he transferred, and hence additional sub judge has taken incharge.. In 2021, the high court has appointment the principal sub judge.. My Advocate has already filed written argument, and Oral too, i 2021 itself. Still now they haven't done the argument either orally or written.. The final hearing has come on 16th of August, 2022.. on that day, the appellants has filed an adjournment petition in which my Advocate has strongly opposed... Later, the adjournment petition was dismissed and again the case was disposed on dismiss for the default, and that's the 2nd time.... Again, they have filed an IA petition to restore the AS.. What should I do now, sir? Kindly, give your valuable tips and suggestions so that I could share that to my advocate... Waiting for your reply, sir..
மேல் முறையீடு வழக்கில் தரப்பினர்களில் ஒரு தரப்பினர் வாதம் செய்ய முன்வரவில்லை என்ற போதிலும் அது குறித்து முறையாக டாக்கெட் சீட்டில் பதிவு செய்து வழக்கினை பரிசீலனை செய்து உரிய தீர்ப்பு பகர்வதற்கு நீதிமன்றத்திற்கு அதிகாரம் உள்ளது அதை விடுத்து தள்ளுபடி செய்ய வேண்டியது அவசியமற்றது
பிரதிவாதி பெயர் தவறாக உள்ள நிலையில் சம்மன் சார்வு செய்யப்பட்டது எப்படி என்று தெரியவில்லை. இருப்பினும் வழக்கில் பிரதிவாதியின் பெயர் தவறாக உள்ளது அல்லது வேறு பெயர் அவருக்கு உள்ளது என்று கூறி திருத்தம் மேற்கொள்ளலாம்
