When I was a young man, the local police were much different than they are today. We knew them. They handled situations on a case by case basis instead of just walking a hard line. If they knew a mill worker was prone to have too many beers after his shift, they followed him.home and made sure everyone was safe. They didn't advocate driving impaired but like I said, they considered all the facts. These police were decent, honest men who were part of the community. We had some run-ins but we respected them.
They've been replaced with young, egotistical kids who enjoy power. I think this is probably the case in towns and cities all over.
Punishment doesn't make someone want to be better. But help and support might.

I dont need a defence..the officer has accused me of an offence and its up to him to present evidence to prove me guilty beyond a reasonable doubt.. I would suggest the officer new presents his video or other proof of the offence..I have 11 witnesses...case dismissed.

I went along with a young man who was going to court, he isn’t a bad person, he has many problems in his life. We managed to avoid conviction just a fine, good outcome. What saddened me the most on the day as we sat in court was the complete lack of compassion the system has for so many who are so disadvantaged. You are spot on. Here in the States it’s not just punishment. It’s punishment AND PROFIT. A lot of private prisons who contract with the state. Here it’s called the Department of Corrections but it’s Department of Punishment. They are not correcting anything. A young man gets busted for drugs and gets a felony conviction. He pays his debt to society but can never get a decent job again because for the rest of his life there a big fat F for FELON on his back. It never goes away. That is not justice nor is it correcting. It’s a life sentence. It’s wrong. But the the lawyers get rich and the state gets more money to misappropriate. Corrupt. We’ve all screwed up only some were lucky enough to not get caught. Great video.

I’m pretty passionate about the state of the legal system and our laws. It has recently been alleged that I was speeding (101 in a 60 zone). This was on a 400m stretch of straight road way out of town in the middle of a mountain road drive. I have gps tracking that gives location and time but no speed. It’s pretty easy to work out though. I was averaging 62 on that stretch of road. I spoke to several lawyers and they said just pay the fine and apply for a special hardship order. In Queensland 40+ over is a 6 month suspension. The SHO grants me permission to drive for work under strict conditions. That will cost me just shy of $3,000 on top of the $1650 fine. If my car or bike was registered to a business, the fine would be 5 times that amount.
Now the thing that really burns my piss is they say it’s a road safety camera, but let’s be real, it’s not about safety. That camera did not change my riding habits at all on the day. In fact, it was 2 or 3 weeks before I got the horrid letter in the mail. If what I was doing was so bad, why not stop me and give me a ticket on the spot. It would have absolutely changed how I rode.
Now the other part of this is I asked for the calibration certificate and was told I would have to lodge a freedom of information request to get that. It’s absolute madness.

They know they can catch people on that road (the cop had to be doing his best American sniper impression hiding up in the bushes where nobody would see him). At the risk of getting shot down, I was a police officer in the UK for 30 years and whilst I do agree that the justice system and the way it is implemented is very wrong, I would say it is perhaps idealistic to expect “certain” members of society to abide by certain basic rules by which most people would choose to live their lives by. The idea of justice is that it is fair and applied fairly, I totally accept that this does not happen, laws are made by politicians and are generally to protect themselves and their way of thinking and living not the whole of society. Laws are enforced by the justice system which if it represents society is operated by people who are good, bad or average at what they do. Numerous laws and rules are just plain stupid and wrong but to visit your drink/drug driver, the question is how do you stop them driving whist under the influence? I don’t know the answer to that but perhaps an education combined with punishment approach is best. I have dealt with a couple of drink involved fatalities and certainly everything has to be done to stop that also I have had to inform parents or spouses that their child or partners has been killed by a drink driver. So what I’m trying to say is there are lots of things not working with society, lots of questions that need answers but maybe the wrong people (politicians) are answering them.

On the point of of drunk driving or under the influence, I believe in strict laws. A vehicle driven by someone under the influence is almost like someone in a park shooting his gun wildly with no aim. If that happened we wouldn’t be driving him or her home. Lot of families have been wiped out by drunk drivers.

Agree with you Aymen, for the most part, but I wonder about those who simply don’t care about others on the road. About 15 years ago, a workmate, in his forties, shocked me when he remarked casually that; the Third time he lost his license for DUI, he got X amount of fines, etc. Now I don’t drive or ride like Grandpa who keeps under the speed limit ALL the time, but in half a century of driving and riding, I’ve never lost my license. I lost my Mum when I was 12 in a single car accident and I know that has something to do with how I drive and ride. I have a healthy respect for what incredible damage road trauma can lead lead to, so for my own health and safety as well as that of others, I try to make sure I don’t put myself in a position where this is a possibility.
I know about hardship and I’m regarded as a bit of a softy because I tend to put myself in other peoples’ shoes. (Perhaps too much, but that’s debatable)
All that said, I do feel that people who don’t care about possible consequences of their actions do actually need some kind of punishment for them.
I have a great deal of sympathy for people who are struggling (having gone through struggles myself) but there are some people who don’t and their careless disregard for the health and safety of others just puts them outside of such sympathy.
I had a young guy tell me once that life is so tough that he saw nothing wrong with breaking into peoples homes and stealing whatever he could lay his hands on. I told him if he was to steal my bike, his life would be in serious danger of ending, because my sympathies don’t stretch that far. He thought that was unfair. I don’t. There are always consequences for our own actions.

Amon, a little advice to those in the States (since I have I have no experience in AU.) Before you get close to your court date, arrange a meeting with the DA and at that meeting negotiate a compromise between what the charge is and what the State will allow. Every DA has a matrix regarding the charge and the leway they have to drop the charge, lessen the charge or even change the charge. All they are interested in is getting the money that the initial charge would cost you. So if you lets say you have a speeding ticket for 13mph over the posted speed, they can reduce it to 9 over. (less points in the point system but they get the same cash. Or they could change the ticket to unreasonable speed which has no points but charges the same cash. Alsays talk to the DA or ADA (assistand DA) before court, nothing to lose. If they won't work with you, do the Dom profile in court, be the finest dressed person in the court. It shows respect and that you are not a low life. The judge will be pleased.

    It’s a difficult one.
In my opinion the area between punishment and the alternative is too grey, and therefore there would be far too many circumstances where the incorrect method was applied… this is for more serious crimes.
Lesser crimes such as minor traffic offences, well that’s just revenue raising and creating far more aggravation.
If you removed punishment, irrespective of whether it should be applied or not, chaos would emerge and run rampant.
There needs to be common sense and a balance between punishment and assistance… good luck getting that right though.

Here in the U.S.A. and more so in Texas we have a two tier (not officially) system of justice. One for the more affluent and low on skin pigmentation and one for the rest of the citizens, poor or people of color. Those in the first category either totally get a pass or when they go to court, they buy their way out with a good attorney or are given leniency do to their status. The second category get arrested with no mercy and sometimes just because of the status listed above. My kids are mixed race and my son, because he played 100 soccer games a year became quite tanned. I saw this two tier system in action with him when it came to law enforcement and at school. It became even worse under the former President that promoted "othering" people that were poor or different. I could write more but I think you get the point. Enough said!

Many officers I worked with were like minded and wanted to support and help our community. There needs to be a line, but where do you draw it? Who should make that decision? If the police kept helping this drink driver get home safe and sound but one day don't catch him and he kills someone, taking an innocent persons life and destroying their family, who do you blame? I don't want to say "It's Ok, you keep drink driving and we will keep letting you do it and help you until you hurt or kill someone" or help this person in other ways that are too many to list here. Basicly I believe, Rules and Laws are only made for the people that follow them, the rest don't give a rats. Just be better to one another, treat people with respect and live your life. Ride safe :)

What drugs do you think legalising will result in such a massive reduction in crime that police won't be needed? Surely you're not suggesting legalising ice, which is a major factor in violent crime. I agree that traffic laws and mandatory/set fines are not effective, but for other (actual) crimes like burglary, which has a major impact on the victims, often results in extremely lenient consequences from the court. I think you'd be surprised at the amount of referrals/programs provided to people by the court and police. I can't nominate individual drugs - Im not a drug taker. My understanding is that the impurities in each drug is what causes harm and the drug is "just" addictive. I think it would be better to control drugs and allow them - it takes the mystique out of them and enables people to get the help they need. Burglaries are often just to fuel a drug habit and addicts could be supplied for free until they are helped.

It’s a shame that some police don’t have a more common sense approach- it’s not all. It is a shame that the judicial system isn’t based upon more common sense and best results. So much of it is antiquated. I live in England and a lot of speed restrictions have been reduced even more in the last 5 or so years - is this because it’s a bunch of old farts making the law who no longer feel safe doing 60 or 70 themselves so impose a limit lower on all when perhaps they should look harder at the situation and maybe retain or not drive themselves!

My wife never understood that, but I think that the lack of rules, actually strengthens your common sense and you just kinda know. I don’t wanna live in that insane place and time I was born, but I think we’ve gone too far. There’s now 1000 rules for things that used to be obvious and some of them don’t always make sense. Fortunately I live now in a place that was occupied by the nazis and then behind the iron curtain, so the older generations still remember that not every law is necessary right and behave like sensible humans….. including the cops. But as I said not matter what opportunities some people are given the outcome will be the same, and to allow or not punish drug or alcohol affected drivers that may go on to kill someone innocent... As for the speed issue that is truly over the top punishment that at time does not fit the offence. Eg entering a freeway on a motorcycle and finding yourself side by side or directly behind a 18 wheeler is not where I will sit for any amout of time and a quick squirt of the throttle to clear the truck is what I will be doing which of course means I could be over the 100k speed limit for a few seconds.. I believe speeding and going over the speed limits are two different things. 100kph in a 50k zone is definitely speeding 55 in a 50 zone is going over the speed limit..It would seem that some speed limits on some roads are there to frustrate drivers to no end.... The amount of new speed limit signs on roads, all reduced speeds are out of control. We, especially those of us on motorcycles, risk our lives with the average driver as it is so I don't see why we should add to that risk by allowing those who are blasé about their drug or alcohol use to be on the road next to us, I sure as hell don’t want these selfish a-holes driving near me. I don’t see why we should have to suffer because the "user" thinks they should be given more chances than they deserve.

Amon (sp) You’ve worked in this field so what do you suggest? If (for example) someone is a drug or alcohol abuser because of what happened to them in the past this will always be there you’re not fixing that, those people are broken and their problems can’t be fixed, only minimised or suppressed. CPTSD is permanent brain damage and is not going to be undone with clichés like, “just forget the past” or “move on” etc so.
I’ve been carrying “issues” with me for close to fifty years and the level of hate and anger I have inside me towards specific people is chilling, but at the same time I’m not on the road with a gut full of suds or off my face bearing down on some other road user because I’m “having a bad day”
People need to take responsibility for their behaviour especially when it puts others at risk, there are many government and private agencies that offer some sort of help aren’t there and yes I do understand a lot of them are next to worthless, so again I ask, what do you suggest? Thanks

@@LJS01 thanks, many people carry emotional pain from past experiences and there are a few different ways to heal (to complex for comments here) so help/healing etc is possible if someone wants it. It's not about supressing or burying the emotion - you literally have to remove it. I'm not suggesting people shouldn't be responsible - lets say we fine a heroin addict - he will still be an addict who now needs to steal more to pay the fine. Here families are being fined enormous sums (relative to their meagre income) for minor indiscretions - the fines and punishment far outweigh the rule they break. All it means is someones children don't get food. It's easy to say "dont do it again" but this assumes alot about peoples nature and ability which is not true for a large portion of the population. Fines and punishments usually don't work - just look at the world now lol.

(irrespective of who is at fault) Most people are doing the best they can and a system of punishment for victimless breaking of regulations (not crimes) is stupid (in my not so humble opinion)

@@OldNotDead-Club Cheers mate - and this is not having a go. I wonder how people reflect on these things after the fact. No one likes being told "No" am I right? And so getting in trouble so to speak in the manner in which you did may feel demeaning. Not unlike when we were little kids getting in trouble etc. Now that we're grown men with grown men ego's these things don't sit as nicely. Not everyone will agree with the justice system and the way in which it's managed by all levels of the judiciary, I don't think anyone professes that it's without fault. However, if you're not part of the solution - you're part of the .........? Stay safe, stay upright.

Thanks, there are many opinions on this. I have got solutions but that's for another channel... I am also part of the problem. I don't feel demeaned at all - i understand the laws and I understand enforcers are only doing their jobs - and I believe they are necessary. It's the law and Gov that needs reform.
This was my point in the first part of the video. Where does their job finish? What's really necessary and whats really just tax collection? Here in Vic we have just witnessed the enforcers being turned on the people - by the Gov. Now they (enforcers) are having trouble recruiting? I have never in my life seen so many "normal" family men, business owners and people turn against the Gov and lose complete respect for the enforcers. This spells long term trouble for everyone. (I am deliberately calling them enforcers)

the answer to your question about the gender of the CVO motorcycle street glides the male road glides the female
also the justice system what I personally think is while I beleave people do need punishment to learn there lesson the justice system should be trying to get them the help they need in order to not repeat what they did to get that punishment

Like the channel, but driving is a privilege! Just common sense.

    • @OldNotDead-Club
      @OldNotDead-Club Рік тому

Thanks -- that's what "they" say, it's a privilege. The reason there are literally 10's of thousands of unlicensed drivers, driving around Melbourne (let alone everywhere else) is that people need a way to get around to earn a living. If they are going to take the "privilege" away they should pay people their salary to stay at home or make public transport practical / usable. They literally do not care what happens to people.

Aiman,(sp), there isn't a mean bone in your body, So I'm thinking that the cop that was eye balling you was indeed a " f-wad". If You'd been in your suit, (With Chaps on), when the two of them pulled you over, ... the end story would have been ... " Thanks for your cooperation Aiman, this is just a warning, ... keep it under the posted please", ... "You're free to go...." ( Your story being that the car's broke, Wife has the Flu, and I'm a tad late for a meeting at the office, so I took my Bike... etc....)....
We all "Dress the Part", be it financial or insitu... by this I refer to coveralls when on the job..... or sporting our leathers/colors, when we ride,.... or just our lack of proper appearance due to fiscal issues.
With that cop, I think first impressions were driving his "lizard brain" instead of common sense .... and if you hadn't tried to "figure-out what his testosterone levels were under his 20 #'s of beer fat", ( lol ), the whole occurrence would have been moot. and the cop doing the paper work would have told you to skedaddle.
As for the justice system, the current laws are still from the 1800's or prior, (we all know that), but whom or better yet... which governance is going to step up to the plate to make the changes for the better.
    Stay Safe

The systems not great bit a lot better than other countries. Cops are ok although you can get some having a bad day.
It is not easy for Cops. Having to deal with cons and other riff raff. Of course if you confront a Cop and try to intimidate then you should expect trouble.

Make drugs legal but if you take your whip off the health system I believe in that and the cops won’t make money bringing it in from the top off Queensland 😂

Very well said, indeed this place is almost designed as a slave trap to extract as much pain and missory out of the occupants/prisoners here almost as if something was feeding on it and this is a farm of sorts.
