Our ansectral property according to RSR it is a joint property with other cast persons and no partition or sub devision took place and in adangals its a notional subdivision numbers mentioned and some numbers are showing vacant and in real. Possession also fallow un cultivated on that one of joint holders name we are title holders in other 18 properties Now in court for parttion along injunction suit Or Declaration suit which one best for time and money.... Please guide me...
Sir, good morning For an petition moved in high court for quash was not listed till now as in show cause notice served to respondent where listing date mentioned as 19th dec22 for the same presently found in online status where respondent counsel filed vakalat and showing as pending for scrutiny, in the said case can the respondent counsel with an intention to harass petitioner collude with Registrar and try to postpone the listing date mentioned in Show cause notice , attempt not to get admission of petition.As the examination of accused date in lower court merely matching with listing date.....kindly advice.
Sir, what is "PENDING FOR SCRUTINY" in remarks mentioned for QUASH petition filed in HIGH COURT ... the said remark is found for Respondent advocate ...kindly clarify the doubt , thanks
sir, good evening i have a doubt that we filed a petition for quash in high court against criminal case moved by family member , the case is listed nex month december 2022, in connection to the same in lower court last month October 2022 before filing of quash petition ,an absent petition moved in lower court on hearing date held for EXAMINATION of Accused ,now again NEXT HEARING for EXAMINATION of accused posted in November 2022 ,for the same kindly advice whether accused need to attend lower court for examination and parallelly continue with proceeding for Quash moved in High court ,which was listed next month for admission no notice is served to respondent from high court nor from petitioner end. what steps we need to take kindly guide ....literally confused with present situations.
As there is no stay of lower court proceedings, appearance is must. In the meantime you can represent to the lower court regarding quash petition to the lower court and seek adjournment. However it's lower court advocate to take appropriate action dependending upon circumstances.
