They aren't declaring a mistrial because it would require them to do the entire trial over again. When they ask for one, it's not because they expect to get one, it's because they know it gives them more and more ways to appeal a guilty verdict, among other things.

I don't know how this isn't a mistrial 100x over, this the state should be embarrassed and fired.
