    This lawyer deserves praise. He is a defender of our rights and more people need to follow his lead.

      Indeed. Lawyer is expected to protect privacy of his clients or he can be removed from his profession, so given this how is request for password to his computer or his mobile phone a reasonable request? Same with medical doctors and some military services members.

      You can try to sue them. Whether or not you have a case is another matter. The fact that they're required to have multiple indicators that evidence might exist on these devices, when they had none, means he may well have a case. They can't simply search through people's devices because they feel like it.

If you are talking source of cocaine, if this man has no history then that's a baseless suspicion and an over reach of power. I'm not for arbitrary personal data collection.

      It's more like having locked, sealed documents relating to a court case in which you are a lawyer defending a client against the state, and the state demands you open and unseal those files so they can make photocopies of the confidential documents... and if you refuse they'll just take them from you.

      Not at he border no warrant needed and this also happens when you come back into the US. This is why use a burner device flip phone no password all you can do is dial a number it doesn't even have history of calls. I buy a local sim card just throw it away when they ask too look at the phone they play with it a few minutes ask why I'm carry this phone. I tell them I don't risk losing an expensive phone or my phone being hacked. They can't keep you from entering even if they take the phone it's not worth more then $20 I will get another one.

      Unpopular Patriot why should the lawyer encrypt information to stop the government breaking its own law? Also, how do you know it isn't encrypted? I have machines that are entirely encrypted and hence password protected. Providing password decrypts the data. It wouldn't be unprofessional for him not to encrypt the data. If you haven't noticed, most people don't. He took responsibility by not allowing them to access his device.

      Sybrand Botes First off, Canadian laws allow this type of searches and seizures (it’s in the video). Second, a lawyer, knowing that law, should not have kept that information on his devices, if he knew it was sensitive. There are ways to email, transfer or carry files on a zip drive or the like, without having them on a laptop or smart phone. Furthermore, the specific files could have been encrypted, allowing him to open his devices for the customs, while keeping specific sensitive files secure.

    I recommend wiping your device clean before crossing the border, and set up a password that will be fun to give to a border agent, like FYOUCBA. Put one document on the desktop or home screen of your device titled "Why Most Government Employees are Morally Deficient" or something like that. Use your imagination and have fun with it!

    I had my laptop top seized because I lost my charger on vacation and the battery was dead so they weren’t able too go through it.

      I was given a seizure number and told to contact them in 3 business days. When I contacted them, I kept on getting the runaround. Then I filled a complaint never got a response. Eventually I just gave up this happened in 2011. I was coming back from Australia with my family.

      @@aab4219 if you know to send letters in a way that states if they do not reply POST USPS and notarized within a time frame, they agree. You then sue them, for what ever agreement they agreed to by not responding.You still have to file a charge of theft regardless, and sue them for private property stolen with no victim,or complaint of a victim.

      @@grumblesNhoneybee The problem is that he will have to fork out thousands of dollars in legal fees which will trump the price-tag of his laptop. You can't just make up a figure when it comes to actual goods, such as a laptop in this case. So, if his laptop is worth 700-800, is it worth the thousands he will have to pay to take them to court? And when you go against the government, it's a tough battle. More times than not, you end up losing. I feel for the guy but that's the truth. I wish it wasn't. ;(

    I agree with this lawyer. Border patrol or any officer should not be allowed to search any laptop or smartphone. That’s invading your privacy. Regardless of whatever situation nobody has the right to go through your device. That’s none of their business what’s on your phone or laptop. Encrypt everything and set everything to delete with 3 wrong password attempts.

    The Supreme Court of Canada has ruled that Client-Solicitor privilege is protected under S. 7 as a fundamental justice for all Canadians. But apparently border officers are above the Constitution.
    The Supreme Court has also ruled that any statutes that may infringe upon Client-Solicitor privilege is to be read as restricted as possible. Even if that border agent was operating under an act that allowed a warrentless search, that act would not extend to the border agents discretion to search a lawyer's work device.

      CBSA will not go through your case! CBSA Officer is just making sure this "lawyer" or anyone else don't bring into Canada stuff that is prohibited like child pornography... Its easier for everyone else to abide by this than letting everyone else come into Canada without being searched

      @O K i agree, you dont think that lobbying wasnt done by manufacturers of these devives for govt to seize as many as possible or make it easier to just buy an extra one imstead of following their rules. There are policies about destroyi g personal electronics/siezing personal electronics in all sorts of govt agencies and departments.. Really nearly every dept that deals with people directly has policy of confiscating cell phones and destroying them, and your consent is given to do this by enetering their property/building/custody ...its just another way to seperate you from your money again for something youve already purchased...

    This happened to me to! They took my phone and started calling all my contacts not believing me on what I was doing in the U.S. I have never felt so invaded! Then on top of that they took my finger prints and my photo.

      You’re referring to USCBP Officers NOT CBSA Officers. CBSA Officers would never fingerprint or photograph a Canadian Citizen or Permanent Resident of Canada.

      Unlawful is unlawful only if it's unlawful ... if statute provides for the power to do so, they can do so. There are instances where a warrant is not required when doing a search.

      @@AdeptPaladin It's unfortunate that this is happening, but it is understandable if a lawyer needs to be searched (under reasonable circumstances) since the greater interest of safety is at stake. One of the rules of law is that no right is absolute - this goes for solicitor-client privilege, although it is near absolute. No litigation has occurred on this matter yet, but such a law that allows for search under reasonable circumstances (although quite possibly not the case in this instance) might be saved under Section 1 of the Charter.

    Unfortunately, these cases are becoming all too frequent. Our devices carry so much information about ourselves, which are easily lockable with passwords and encryption. I can understand government worries because of terrorism, crime etc. But on the other hand, these are private devices. There needs to be a balance between what is okay and not.

      Compared to areas like Thailand no Australia isn't as bad. If you look and act like a total creep you will likely be checked. If your answers set off something that worries the officer then you'll be checked. It's not an exact science but spending months in Columbia as a lawyer it starts to be suspicious. A fiscal question, or bloodshot eyes, or even a nervous twitch or laugh can get the ball rolling.

      Or keep your files encrypted in a cloud and use clean laptop and mobile phone anywhere you go from a local office in country of your destination. I do understand the need for procedures due to risk of terrorism but still some professionals cannot give access to the content of their files to anyone because regulations of their professions do not allow such security bridge. It is true about lawyers, sworn translators, people who work with all kinds of sensitive and confidential data protected by legal regulations referring to third party rights, third party interest, patent protection etc. Safety procedures of immigration offices or airport security cannot just ignore such additonal legal restrictions with which travelling professionals have to comply.

    I really hope this issue will finally be tested in court, even in the Supreme Court if need be. Being asked to surrender passwords to personal devices feels like a fundamental breach of privacy, it's like being asked for password to email, or bank account. There are no compelling reasons to do that at border crossings.

    Any (international) lawyer who travels with sensitive client data on their devices, and doesn't encrypt it, is asking for troubles in certain countries.
    As a tech geek since the early nineties, I am fully aware of how to subvert such overreach of authority. If a border officer asked for my $500 laptop, I'd happily hand it over to them, knowing full well that when they fire it up, they'll be presented with an empty Linux based operating system (Tails OS), completely void of anything of interest. And even if they found the USB stick I kept my important files on, it's heavily encrypted anyway, and backed up (and encrypted) elsewhere..

    We are dealing with organized stalking groups who are given jobs in positions where they may have access to ppls personal info which is used for criminal purposes. I was a target of ID theft and have had to deal with hacked electronics and accts, intercepted phone calls, stolen utilities, and home break-ins, among other things.
    I hope this lawyer finds a way to protect his privacy as it may lead to protection for everyone. It amazes me how ppl just seem to accept all the crime associated with the rapidly growing technology. If we have to spend all our time trying to untangle the messes perpetrated on us, how will we ever accomplish any productive work?

    If you watch border security you would know they were checking if he had any contact with a drug related conatcs because he was comming from a drug source country and they wanted to make sure he was not smuggling drugs into Canada.

It's enough that a lawyer with his drawers in a twist that spent alot of time in a high drug exportation zone should not be your poster boy. You aren't technically back in canada at a port of entry think of it as being on the front step. Ports of entry and border crossings are set up under international agreements. Hence why you can have statesless people in them. It's only after you clear the border that you revert back to canada. Hence why the border security differs from the RCMP on jurisdictional bases and rules. A lawyer should damn well know this as the laws about inspections have been around for generations. He's either hiding something or trying to get his 15min of fame.

      Sybrand Botes no it doesn’t iPhones have a setting that can wipe or lock your phone after a certain amount missed consecutive passcode attempts. Also when activating iCloud lock or remotely wiping an iPhone, it will work even if the phone is off. The instructions are simply queued until the phone is turned back on. He probably either locked/wiped it remotely with iCloud using another device or someone else’s device.

    Canadian border is awful. Every time I travel there it's a nightmare, they always screen me for secondary examination without reason, even though they have all my information and ETA.
    I don't get why they are so afraid of people immigrating illegally from Europe, since we have a much better life standard here. I also don't get why invading the people's digital privacy like that, if someone has something actually compromising, they will just send it over the internet or other means and download the information once they were there.

      Agree with you Sim. If there are something to hide, I would send it to my email by attachment and download it again after arrive the Canadian soil. So CBSA can not find anything if one wants to hide the the things in purpose. By the way CBSA is violating the privacy of the passenger. Where is the Human Rights as usually referred by Canada ?     Whenever I cross a border I always back up my iPad to the cloud, then wipe it to factory defaults before crossing, then after crossing I'll resync to the cloud to download everything. I'll only cross borders with completely empty/clean/wiped devices.

      Indeed but the problem is that in case of certain documents procedure doesn't foresee the possibility of digital processing outside off someone's company issued device. As for this case: there are other options to check if the device is not filled with explosives than going through it's content. As for this case I can feel the lawsuit coming since it's obvious conflict of two values protected by the law and in such case legal protection of clients should have superiority.

    The attorney really had no choice in what he did. He had to protect privilege.
