    Mr. Kim, Thank you so much for this video. You made it so simple to understand. Seeing an example of a legal memo is so helpful, and they are not easy to find. Your notes and highlighting as you went along were also very helpful. I have been at a loss for how to write my legal memo for my paralegal class, and this will help me so much. Watching this has simplified things enough for me to fully understand what I have unfortunately not learned in class.     This rule of law comes from Cohen v. Petty, in which the Court of Appeals of the District of Columbia held that a defendant whose passengers were injured in a car crash caused by the defendant’s sudden fainting was not chargeable with negligence when he had never fainted before and was in good health at the time of the accident.     Here, like the defendant in Cohen v. Petty, Defendant Keegan was in good health at the time of the accident, and had never before fallen asleep while driving. Plaintiff Marino may argue that the present case is distinguishable because unlike in Cohen v. Petty, Keegan has a history of narcolepsy. Marino may argue, therefore, that Keegan should have known that he might suffer a narcoleptic episode while driving.

    But Keegan has successfully controlled his narcolepsy for the past several years with medication, and his last narcoleptic episode was over three years ago. Thus, he had no reason to think that he might suffer another narcoleptic episode on the day of the accident.

    Sir, great teaching but one question: the above said video was from the prospective of student point of view but will it come into effect in more professional way or lawyer who are beginners or newly pass out lawyers from college or give you more clear picture, Will its relevancy came into effect when someone who has to read 500 pages files with relevant document also with order sheet- ORIGINAL AND APPELLATE POINT OF VIEW..WANNA SHED LIGHT UOPON IT
