I listened to the instigator of this event when he testified. He called a stranger a pedo, ramped up the accusations, involved another group of strangers, and then retreated to stand back and revel in the chaos he had created. He then filmed himself pretending to be shocked instead of trying to offer assistance. That is who should be on trial. Classic sociopath yelling fire in a theater.

Wrong. Watch the entire thing. Nik , maybe jokingly, said I am looking for little girls, according to many witnesses. He could have walked away. I have been down that rive many times tubing. so I know how shallow it is there) That man rushed the group,, he instigated, never said a word with a crazy blank stare, could have left, and if scared, could have showed his knife and said "I will defend myself". No, he hid it and went on a stabbing spree.

They all acted like children... 99.9 percent of the population does... When has deadly force ever been acceptable for kids acting like kids?
If he was in real fear for his life he would not have changed his cloths and tried to lie about what happened... You dont hold a knife blade up unless you are trying to kill... Never did he say he was armed or tell anyone to get back. He never even told his own group he was scared.
The issue is none of you know what a fight really is... This wasn't even a skuffle how does this constitute deadly force?

I saw all the videos of these young people on the witness stand and every time I thought that hopefully no such people will ever move into my neighbourhood. The video with sound shows clearly how they enjoyed tormenting the man for sadistic pleasure, as drunk and drugged cowards do.

@@johnpatterson9037 What a dishonest set of lies you just spread. The men incited violence against him by shouting defamatory lies about him like claiming he was "looking for little girls". This did incite two women to go over to him. The women blocked and shouted at him without listening. They then assaulted and battered him on camera grabbing and pushing him several times. These men then shouted more lies about him and used them as an excuse to physically attack him. They pushed him down onto a rocky and gravelly river bed in a foot and a half of water. Easily enough to hold someone down in to drown. All while shouting even more lies
They immediately punched him in the face while he was helpless on the ground. When he tried save himself by standing he was attacked from behind by another man in this pack of laughing hyenas. That man pushed him down again (and even admitted to it on the witness stand that he was trying to keep him down). Of course, the victim would think he was in a life or death situations. He managed to get up and face the new assailant but was still being pushed.
He had a gang of 5 adult men attacking him simultaneously, joined in with a 17 year old. Harrassing him, attacking him physically with zero provocation.
He was merely looking for a cell phone and googles. A cell phone they pretended to have at the beginning to tease him.
It was only after all that they he stabbed the man who had just assaulted and battered him from behind.

This case reminds me of something that happened to me which could easily have gone South. I had walked down this trail to go to a swimming hole I had been too many times before. It wasn’t warm enough yet to swim but I liked going there just to chill and listen to music. It was midweek during the workday so there wasn’t really anyone else around. As I made my way down the trail I noticed a backpack along with some fishing gear leaning against a tree right next to the trail. When I looked down the thickly wooded hill to my left I could see some guy wading in the creek fishing. I figured the stuff was his and just kept heading down the trail without thinking much more about it.
I eventually got to my destination, threw on my headphones and just chilled out as planned. About ten minutes later I saw some guy walk out of the woodline with a fishing pole. I immediately recognized him as the fisherman and figured he was looking to drop a line in the swimming hole as its a pretty good spot. So I just gave him a small wave of acknowledgment and nodded my head. But he continued to walk towards me and I could tell he was saying something?
So I took out my ear buds. He was young guy about 25 with long curly hair and a muscular build. Looked like he definitely worked out. Thats when he spoke to me. He asked “Hey man. Did you happen to see a backpack and some fishing gear? I left it up in the woods and cant find it. Ive got all my stuff in there. My wallet and everything.” Immediately I didn’t like the energy that was coming off of him. His question was more accusatory than anything else. So I said yeah I saw it. I described exactly what I saw, that I saw him fishing, and that it was leaning against a tree right next to the trail. He kinda looked at me for a second and said “Cool. Thanks.” Then he walked off towards the trail. He came back about five minutes later only this time he’s much more animated. He says he couldn’t find it. So im thinking how could he not find it?? I mean its right there! Only a blind man could miss it! Now I could tell he’s convinced himself that I stole it. He starts giving me the third degree. Do you live around here? What’s your name? All that stuff. So now im getting pissed. Im out here just trying to enjoy my day. This trail and swimming hole is practically my backyard and I got this stupid absent minded guy basically accusing me if stealing his stuff. Keep in mind its just us in the middle of the woods and flip phones had only recently become a thing. I dont even think there were cell towers up in this area. So I had a choice. I could tell this guy to F off and risk getting into a fight or something worse. And judging by his physique I wouldn’t have had much of a chance without any weapon. Scenario two. He walks away cursing me and eventually calls the cops. Or scenario three which would cause me to swallow my pride and check my ego a bit and walk this dumb SOB to where his gear is. Ruining my otherwise chill day. I chose option three.
So I asked him how far down the trail he went to search? And it was obvious he didn’t go far enough. I told him to follow me and I’ll show him exactly where his stuff is. Sure enough after a very long, tense and silent walk there was his stuff exactly where I said. Leaning on that tree right next to the trail. He says, “Oh. Thanks.” No apology or anything. Thats when I told him in the future he should pay closer attention to where he leaves his stuff and not be so quick to judge and accuse people. Immediately he got defensive. “I didnt accuse you!! I didn’t accuse anyone! Where the Hell did you get that from!?” I said, “You know what forget it. Im outta here.” And I split. That whole situation could have easily gone South like with these kids. And its often all about ego. Everyone seems so quick to fight these days. Rational thought is just gone.

lol- your story was not even close to the current one in any way i can see. But it was a cool story, the only thing i'd add is that = the world is not going to just mesh with the peaceful zen mode you got going in your own mind, that's vanity and thinking your special or the world circles your butt - not the other way around. you have to be like bruce lee used to say like water, adapt to the many moving parts of this world like that guy with his missing stuff, his head was slightly spaced out, no doubt and being a built muscular specimen like all body building types, they tend to think different than intellectuals and the rest, so having patience and showing the time it takes to lead someone to the right path in life, or to their lost personal items is a credit to you and is at the least what christ would want you to do - at the least. So slow your roll and give people plenty of space to prove to you - THEY ARE BAD, or are def going to f... you over then you will be good and mad, and they will be justly dealt with by yourself so relax and always remind yourself in this world you are a grain of sand on a beach just be patient chilled out and flow my friend. p.s. this case is complicated, i think the kids got that adjustment they needed, but i don't like the way he bull dogged his way over to their inflated tires looking for his phone, like they took it or were trying to hide it, and they had no choice about him bull dogging over to sniff around...that was weird and stupid, i guess your man in the woods did the same thing to you, now i'm seeing what i think you were seeing in both cases. O.k then i read your message loud and clear now, if that guy did that with you then both him and nico the russian were wrong for that much no doubt, good thing you handled it different than these kids.

I was surrounded by three men trying to get into the conversation and I'm a 63 year old woman. Next thing I knew a total of five men started yelling at me , surrounding me and calling me a bunch of very inappropriate names. No one came to my defense. I started to leave and three of the men followed me to the door. I ran to my car. I was shaking and crying all the way home. I haven't went back since then. Too scared to. So I completely understand this guys mindset. Our world has become very scary and angry.

Politics are not a great topic to discuss in today’s world. If you are confronted by an opposing person or group of politics start talking to them about enemies of America and if they attack the U.S. would they be able to stand together with the other party to fight in war. You have to think about what really matters , and being American is much more than having a violent fight over a position on a topic that in the big picture is truly meaningless in the passage of time

I don't understand why they were so hostile. I used to go camping with friends often when I was young, and sometimes we encountered drunks, mostly we were the drunks, but there was never any violence.
I would have helped the man look for that lost phone.
One time a guy walked up, helped himself to our (imported!) beer from an ice chest. We looked at him funny, "Hey man! Are you looking for someone?" He grinned, "Yeah! Billy told me to meet him at the campsite near the boat ramp!" "Okay, we don't know anyone named "Billy" but, ya want a burger? We've got plenty!"
He hung out with us until his friend Billy came looking for him. Then they BOTH hung out with our group. We had better beer and cuter girls.😉
That was so typical for us, and the people we met. The whole point of going to the river or lake was to have fun, drink too much, and play bad music badly around a campfire. That was simpler, happier times in the 1980s.

This was a river of underage drunkenness, yelling, showing off, mental bullying, physical aggression and refusing to communicate because they were annoyed and then angry at a 52 year old man. Even one of them could have said " Okay, let's move on." or something to bring down the tension of the situation, but they were having a good time making him uncomfortable to the point of pushing him down in the water and putting a hand on his throat.
I feel like Nic Miu was at a disadvantage being a foreign born citizen. He was obviously taken by surprise by the very aggressive speech and actions of these teens and younger adults that is tolerated by their parents. He saw their actions as a serious threat to
his life. I don't think he knew what he was getting into by hanging around them looking for a phone. I don't think they realized that they were creating a deadly situation with their aggressive behavior. I wish Nic had walked past Madison and tried to speak with Mr. Carlson Sr.
I also don't know why anyone would want to bring a sharp knife like that to a tubing river when a box cutter would work for cutting rope. That knife seemed too big and too sharp. If it had been only a box cutter, Mr. Miu wouldn't be facing life in prison, in my opinion. This whole thing was so preventable, but is now an American horror story.

Ultimately, the smart move is typically to try to end the interaction when someone is acting in an aggressive manner out of the blue. But that doesn't mean it's the teens' fault that they were assaulted. It's natural for people to be upset when they're harassed and wrongfully accused of stealing. He brandished his knife and had it in his hand before anyone touched him.
You can’t see it in the video, but he did hit one of the girls before he was pushed into the water, as evidenced by her sunglasses being on her face just a moment prior and then missing when she comes into frame again. THAT’S when they started yelling at him and pushed him into the water.
This is when he sliced up the first guy’s stomach (in the orange shorts) and disemboweled him.
He then stabs the girl in the bikini in the back, when she wasn’t even facing him.
At this point people realize he is going on a stabbing spree and begin to run away. Instead of him doing the same (if he was truly afraid for his life), he stabs/disembowels 3 more of them, killing one.
Then he calmly walks away as if nothing happened, discards the knife in the trees (conscious knowledge of guilt and disposal of evidence), and then walks to the opposite side of the river to rejoin his group.
He did not try get help, for himself or any of his victims. Instead he convinced his group to continue their float down the river and left the victims for dead.
After getting out of the water, he changed his clothes to disguise himself and then lied multiple times to police, because he didn’t know there was video of the encounter.
This guy is an absolute psychopath, and no matter how loudly those kids were yelling at him, he initiated this encounter, refused to leave their space, and drew his weapon before anyone had touched or threatened him.

@@mckernan603 Good to hear an alternative account, but I don't think much of what you say is that convincing.
      1. Being guilty of lying to the police does never and has never proven guilt of anything else (except to clowns like you). Equally trying to 'evade justice' doesn't imply you know or believe yourself to be guilty of anything. There are many reasons to lie to the police and evade justice, for instance if you are not 100% sure that justice would prevail in court, or simply consider the entire court fiasco you would likely be put through to be unpleasant or a waste of your time.
      2. You say "Instead of him doing the same (if he was truly afraid for his life), he stabs/disembowels 3 more of them, killing one."
What time span elapsed between the first stab and his retreat? If you feel your back is against the wall, that you're surrounded by aggressors calling you the worst names, and you have to go into fight for your life defensive mode with a knife, how long after 'chaos' erupts and your enemies retreat is reasonable to elapse before you feel safe in retreating yourself? Was he lunging at these other people? Why were they so close to him?
      3. You claim he invaded their personal space. How much of the river constituted their 'personal space'? How close was he to them when they began verbally attacking him? Did they stay put, or did they come towards him and surround him, while bullying him for their own sadistic pleasure? Was that not an invasion of his personal space, greater than any you claim he did to them? Why were they all within stabbing reach of him exactly?

I agree with you. However, after watching again, I see it is really a totally mishandled situation. He should have left, realizing he had a knife, and that the knife would be his only defense he would use, he must avoid these situations. A phone is not worth the trouble he appears to instigate. Kids need to know that it is not ok to fuck with people, I feel he situation could be over, and everyone involved still be alive if better judgment had been applied. Sad but he is not guilty of murder. Being pushed into a couple feet of rapidly moving water is deadly force, and he can respond with deadly force. The court got this one wrong.

I have a real issue with this case. This entire Case could and should have been avoided by all parties involved. I agree w everyone that the teenagers verbally assaulted the defendant which is not a very becoming way for young men to act in any public setting- period. Then add in the consumption of alcohol and marijuana. And this group was a ticking time bomb. This group of kids became completely irrational bullies looking for a target. The defendant should have told his group that he needed help . and that he needed-assistance. they were all around 17 years old and were high. The kids were wrong and obnoxious but did they deserve to be murdered or severely injured? The answer is no.

One person even had their hands around his neck, and the group was easily capable of drowning him.
