- Jonathan Sumption argues that judges - especially those of the European Court of Human Rights - have usurped power by expanding the interpretation of human rights law.
Lord Sumption argues that concepts of human rights have a long history in the common law. But by contrast, the European Convention on Human Rights has become a dynamic treaty, taking on new interpretations and powers.
Article 8 - the right to private and family life - is the most striking example. Should these decisions be made by judges or parliament?

What a teacher . Anazing
Ask as many people as you like, I doubt you will find a single one that can actually define a right to you, or tell you exactly what they mean when they use the word right or a right, and you would expect Jonathan Sumption to come up with some sort definition of a right because that is a function of a lawyer, or one of the functions of a lawyer that he can define his terms.
George Carlin does an excellent job of explaining exactly this point about rights. There are others but his is the best imo & I'd be delighted to hear ANYONE try to argue against it, including Jonathan Sumption.
