Data Protection laws like GDPR and PECR apply to charities as much as any other organisation. SCCs are typically put in place when there is a transfer and there's no adequacy decision. If you're sending emails to a person, that doesn't sound like a transfer (unless you're sending them personal data), it sounds like you'll want to look at the email marketing rules. The UK ICO has a good guide on charities and has an FAQ on marketing: ico.org.uk/for-organisations/in-your-sector/charity/charities-faqs/. Hope that helps!

Hi. Do charities need to do the SSC if we only send emails ?
Hi Austin, SCCs are about transfers of personal data whereas we're imagining by 'emails' you mean you send marketing / fundraising emails? In that case SCCs aren't applicable - if a person receiving the email responds to you directly that's not a transfer. If you've an agent in the EEA who collates everything and then sends it to you (or vice versa) then those are transfers. At present you've got the adequacy for transfers from the UK to the EEA and the 24 Dec 2020 agreement giving 4 or 6 months transition period for transfers from the EEA to the UK, so plenty of time to get SCCs ready in case the UK doesn't get an adequacy decision in its favour! We don't give legal advice fo course, but hope that high level outline helps!
