This is the First Amendment in action. The First Amendment would mean little if it only applied to the speech you agree with.
The First Amendment doesn't incite the evacuation of the White House
the constitution regulates law making itself. it is used when you want to fight validity of a law itself. outside of that you point to laws, instead of constitution, constitution is above them, but the finer laws are used they are more specific.
it's like a pyramid constitution is at top, then federal, then state, then local(which maybe enforce things like parking rules on roads, etc).
if you violated a state or federal law, you will not be able to point to constitutuion, you only bring it up if you are fighting the existence or creations of laws. it's used in the law making processes. it makes the court cases too complex when in the court case itself is time to bring up if a law should exist or not.

There was a British Mandate for Mesopotamia (Iraq) (for the local Arabs) and a British Mandate for "Palestine" (Israel) which was to turn over control of the land to the Jews.
