    You can blame the current DA for that one. She's the one that doesn't want the death penalty. Thank God she's gone at the end of the year. She has screwed over so many victims it's not even funny.

    Most of y'all are commenting before watching the video. They can't change his sentence and if they could it would be worrisome. Get your emotions in check people. If you want change get the democrats out.

    He won't survive prison. Prison justice will take care of him. Death penalty means he sits on death row for 20+ years anyway.

    So just because prosecutors choice not to seek the death penalty it doesn’t mean they are right. They should have put themselves in the victim’s parents place!

    Yes, he should have. Blame that on the outgoing DA. She said it would cause too much pain to the venezuelan immigrant community or something lame like that. My hope is that his crime gets out among the GP while he's in prison.

    He can be tried federally as he was in the process of committing a federal crime of entering this country illegally. He needs to be tried and put on a federal death penalty case.

    1:53 This is technically correct, assuming the judgment is not reversed on appeal. If the judgment is reversed, then the state can potentially seek the death penalty in the retrial.
    The reason why is how the Double Jeopardy Clause of the Constitution works.
    Though not mentioned in the video, it's the Double Jeopardy Clause that prohibits the state from increasing a penalty after conviction. However, if the conviction is reversed for legal error -- i.e., not because of insufficient evidence or outrageous government conduct -- then jeopardy does not attach. And going forward, the state would be free to prosecute the case as though it was just filed. That includes making a new decision on whether the death penalty should be sought.

    Can I ask a question? Would they be considering the death penalty for this guy had the victim been a man or a non white woman? The reason I ask is because we all have heard about the "Missing white woman syndrome"...
    Yes, what Laken Riley endured was horrible, however, aren't lots of people murdered every single day in this country? Just the other day I was reading a news article about 3 people who had been stabbed in New York, 2 of them (both men) died as a result of it.
