    Actus Reus means "guilty act." It describes the action or act that is illegal. For example the actus reus for assault is " causing physical injury to another person."
    Mens rea means "guilty mind." It describes our mental state, or how we choose to perform our action. There are four mens rea: intentionally, knowingly, recklessly, negligently. The law will assign a mens rea to every crime.

    Hi everyone.
    I decided to start studying criminal justice to get my Bachelor because I want to help the people to live in a safe environment ., I love to live in a country with zero criminal percentage if I am the one to be the that type of guys I will make my city safe and clean from criminal this is my great ambition, god bless America that gave me this opportunity to achieve my purpose.     I want to start following the law better. Sometimes I feel like some of the laws are obvious, but it's good to read up on them because you never know when you are going to slip up and do something stupid.
    I wish they had a guidebook for people to know how to follow the law and it's not just a hearsay type thing. What are you guys recommending give people to basically know all the laws they will reasonably need to know?
    I mean it's basically baked in my conscience not to do dumb things that hurt people, but I wish it was just more clearly laid out for people who didn't have that conscience.
    I'm lucky that I have a conscience. Some people don't have that luxury.

      ‘Gotta think about what he’s saying. Also, taking long pauses is normal practice in law. It is better to review one’s notes and say the next sentence correctly, than to misspeak and confuse the listener on a dense informational comment.

    Here is the three street rules or criminal code or rules that should be in everyones book or list,
    Rule one: do the crime by yourself.
    Rule two: never tell anyone about your crime.
    Rule three: stick to your Story.

    Selecting an appropriate kind of Criminal Defence lawyer for your case is not an easy task. Firstly you have to know about his working and practicing experience. Thanks for such a informative video from a Lehman point of view it is quite clear by this video.

    This is misleading. Mens Rhea is not state of mind but rather element of intent. In statutes these elements are articulated with words like knowingly, intentionally, maliciously, with malice aforethought, etc. Some crimes can also have specific intent- such as theft requiring the specific intent to deprive the owner of property. The exception is the strict liabillity statute where an action is always illegal no matter whether a person has a guilty mind or not. It is also possible to form mens rhea instantly.

    Really good! Could go a bit easier on the pauses between the sentences though, would make it easier to listen to!

      That is a good point. It is probably still a crime, but I was trying to illustrate how it no longer qualifies as a crime of intent.

      depends on how he hit the person. If he just hit a sugar high kid running around on a road. It was more of an accidental homicide. If he ran a red light and hit someone it would be a constructive manslaughter (a type on involuntary manslaughter) or if he was on a phone talking/texting/doing whatever while driving that would be negligent manslaughter (another type of involuntary manslaughter). This applies to Canada though so idk about everywhere else.

    Focus needs to Shift from giving publicity to criminals and punishment to Helping Victims of crime & giving an attentive ear to Victims instead. the System should be more Proactive in seeking to prevent at-risk folks from committing crime and rehabilitating convicts rather than just punishment which often leads to future victimization from recidivism and is a burden to society. & Amends should be made mainly to the Victim of crime rather than the government.

      There are some areas of overlap because American common law is based on English common law, especially for basic criminal law concepts. But the English system has evolved very differently since then, so I can't say for sure which stuff does apply and which stuff doesn't.

    I didn’t know you can’t do an attempt recklessly. I imagine the same principle would apply to wilful blindness-that a person cannot commit an attempt crime through willful blindness.

    why is it that some beginner lawyer when working as a public defender want to get you to plead guilty like i had an experience the atforney was insisting me to plead guilty for community hours i told her it was a misunderstanding i am not guilty when she saw that the plaintiff didnt come obviusly because i was not guilty she was giving me an attitude how rude

      Some lawyers are assholes who don't care about the well being of their clients and just want to finish a case to move on to the next. As I have heard Public defenders are not paid per case but by salary and they have a target input every month. But what is more disgusting was my immigration lawyer for my wife. She had to adjust her status but I have no problem however the lawyer wanted me to pay too because my citizenship is involved and I paid her 2,000 dollars without getting anything from it and just because my wife is her client and paid her already 6000 dollars for her own case.

      It's not about being a beginner lawyer, it's depending on what the charges are. You would go to jail if you plead not guilty and the jury or judge decides you are, but you could make a plea deal with the prosecution to get the community service you were talking about instead of going to prison

    American criminal law is very complicated and confusing. In most civil law countries it is simple. If the act is made with intent it's an intentional crime like murder or homicide when it was not planned or premeditated but resulted to intentional killing. And if there is no intent but negligence is the cause it is called Reckless Imprudence or negligence thus it could be Reckless imprudence resulting to homicide or resulting to physical injuries. In USA there are too many elements and definition to become first degree, second degree murder or manslaughter etc.

    I really request you to answer my question ...a friend of mine is stuck in a case where he is beaten because a friend of him murdered someone and because they both were friends also they are past friends they used to be friends a year ago and the murder took place 3 months ago , my friend was beaten by police badly because they were friends even he was not at all included in murder , even he didn't really knew about that murder anything, Is this correct ?? If not tell me the remedy he can take

      Such act of police is unlawful. An application under 22-A CrPC can be moved against police. If your friend is innocent than he has to prove his innocence after Bail. First of all, a Post Arrest Bail should be moved along with 22-A application.

      Generally, emotion isn't considered part of intent. So however you feel when you decide to do something, it's the decision that counts.

    your bank robbery example for mens rea is more appropriate when related to actus reus. The act would be involuntary, bc someone could still have the proper mens rea when sleep walking if they knew of the disorder and knew the danger/frequency occurred and they didn't take preventive measures. The mens rea would be Reckless or Negligent at the very least.

      I can see your point. I used the sleepwalking example because it got the point across in a way that would help people understand a concept that abstract, but it might be applicable to actus reus as well.

      But if you are reckless/negligent, then intent is mitigated if it exists at all. That's why you can still be guilty of murder even if you didn't intend to kill, through the theory of depraved heart! It's not first degree murder but it's still murder. Right?

      Qwon Animations only way a lawyers tells u to plead guilty is if there’s a deal on the table of some sorts. Or u have a really bad lawyer...an online lawyer

    You could use as a defense with man's rea that you wet temporally insane because you were mad for instance you acted out of blind rage so you didnt have a clear conscious mind

      you have to be able to prove that such as a crime of passion. Its not as easy to plead insanity. Also not all states let you walk free from claiming insanity.
