    producers on beatstars are swindling masters and mechanical royalties in these contracts. It’s because most producers don’t even understand their own contracts so they are scared to do fair business. Someone leasing a beat doesn’t entitle you to 100 percent of someone’s masters and mechanical royalties after an artist creates a new work. A lot of taking advantage of green artist. No producer would want to be done that way. So a real conversation needs to be had concerning artist who purchase lease for these beats. Whoever controls the master of a derivative work controls the money. In many cases artist are getting very bad deals through beatstars. If producers are going to lease beats, they need to split the masters and mechanical royalties 50/50 for the new work. Anything else is unethical

      Yeah the truth about these contracts are they need to be edited by each individual producer before they sell their products, the beatstars contract is really just a template, don’t worry I will make a updated video so producers can know where to go in order to make a better contract

      @@CyrilJewels If you buy the exclusive beat do they own the masters? Its a big difference between a beatmaker and a producer. Can you change the contract to the artist owns the beats in its entirety?

      @@zzasss3407 just because an artist buys an exclusive contract does not mean he owns the masters. The beat is still owned by the producer.

      I think that's true. Contracts and Royalties are arcane, complex subjects. From questions I've asked beat sellers I can tell they don't even understand it themselves. Try, for example, aking what they do to justify the publisher's share of the royalties. I think most producers just go with the basic Beatstars template which is very unfavourable to the lessee IMO.

    Beat lessees need to read the Beatstars licensing info very carefully. You might be surprised how mean the terms are. For example usually you can only use a beat for 10 years. Also note how the royalties are apportioned, particularly with regard to the publisher's share.

    Thanks for the vid my man thing is these licenses because down the road problems I plan on just saving up buying the exclusive if possible just in case a song blows up I’m a keep in touch bro I need all info on the business side

      Truthfully the exclusive is always the better option because if you are serious you’ll make the money 10x and no one will have the same Beat as you plus more backend benefits

    LOL I laugh when I see this template that everyone is using.. lets use common sense here... do you really think ANY artist will be able to clear any samples ???? the producers are being extremely shady here by leaving all the responsiblity with the artist when they know for damn sure 99% of people dont know what that even means..... I am sorry but if you make the damn beat you should be able to tell me if you are stealing or let me say "sampling" shit or not jesus christ..... and then the one license where they just put the writers share split but dont mention the publishing split LOL most artists will think : oh cool I have 50 % when in reality they only own 25% because the publishing is not mentioned anywhere... I honestly think producers are being stupid for using this template thinking they are safe simply by not mentioning things, that is not the case. If you leave things up for interpretation like the publishing, that could easily be a point in a law suit...... another thing with the sampling, you cant just flat out steal someones work and then sell licenses to a rapper and say : its the rappers responsibility now to "clear samples" LOL thats now how it works .... thats like stealing something in a shop and then going to someone else and selling them that thing and tell them :dude you gotta make sure this is not stolen in case anything ever happens you vouch for it LOL ..... I have huge experience with contracts in my professional live and as an artist myself I simply stopped buying any licenses from producers because they all use these dumb ass useless contracts.... might aswell not have a contract at all. Not hating on you at all please dont take it personal I just get so frustrated when I see this shit

      Thats real.. The beat makers want 50 of this and 100 of that becuz they feel they're owed but you just profited off using someone else's sample sounds yourself without letting the artist know, but your not taking your cut of the money to pay them off.. Ain't that what your trying to keep from happening to you? Why can you make money off them but leave the rapper to take his small split to clear that?

      @@sjmotnezmusic facts, the contract is ridicilous - and this is coming from someone who plans on selling beats on beatsrars. I think its important for artists to find producers who don't have weird / greedy terms.

      It depends where the samples come from and what the producers licence was when they used them. I've written a few songs then later discovered the producer was sampling from Cymatics. In that case it should be ok, but it does mean that other beat producers will be producing very similar melodies and there's always the prospect of legal action if your song should blow up.

      For the most part the agreement comes in the packs so make sure you read and follow them don’t slight anybody because it’s never a good turn out

    How do I do the profit split after purchase lease a beat from Beatstars? I don't live in the USA. Is there such an option when releasing the song on streaming platforms? Or paypal etc.? I'm really confused.

      Ok so the producer you purchased the beat from should enable splits on certain leases if you have a beatstars profile you can setup splits and if you have a distrokid account you can split with the producer every legit producer has a online distributor so you should be able to connect to them

    Do you think it would be posible to keep control of the sale of beats without stores like beatstars?
    I mean you having your own contracts and making your own licenses? Or isn't that posible?

      Definitely is possible it will take some leg work at first but nothing is impossible once you figure it out

    So when I’m uploading the song through distrokid , do I need to manually put in the splits myself (the splits layed out in the contract) or does the producer get that automatically , I haven’t published any music so I’m not fully aware of the process , great vid by the way 👍

      Great question thank you for asking and in distrokid you will be able to put in the splits manually and from there you will be covered on the beat side streams according to your agreement with the licensor and you being the music artist have to add the split on the song as well

    I am on a free plan on beat stars , which basically means i have to manually deliver the beat to a customer when he buys one . What do i have to include on the email (except ofc the audio file)?

      If anything I would say at least pay for the 10$ plan so you won’t have to manually do it because that’s extra work, and in your emails you can create whatever value you want to give

    Quick Question, this is in Every contract ive seen so far, can you help me with understanding this “THE LICENSEE IS EXPRESSLY PROHIBITED FROM REGISTERING THE BEAT AND/OR NEW SONG WITH ANY CONTENT IDENTIFICATION SYSTEM, SERVICE PROVIDER, MUSIC DISTRIBUTOR, RECORD LABEL OR DIGITAL AGGREGATOR (for example TuneCore or CDBaby, and any other provider of user-generated content identification…” So does this mean i cannot upload my music to apple music spotify etc… and if not, how the hell am i supposed to make digital streams and revenue off my music? Can you help me under this part? Would be appreciated! Thank you

      And one more question, i seen where you answered a similar question, and you said it had to do with uploading to multiple distributors from my understanding, so say i use Tunecore as a distributor regularly and not distrokid for the rest of my music, can i still use tunecore to upload my track? Or does this break the contract agreement? I just dont want any legal trouble man, and if i cant upload my track then i need to know before spending the money on a beat i can only use at home and at performances for profit, you know?       I NEED THE ANSWER TO THIS AS WELL! I keep seeing this question but no one has an answer. How do these leases contradict themselves soooo badly? In one section, it says "PROHIBITED from registering the new song with a music distributor (WTF???) and in another section it says you can upload it to Spotify, Apple Music, etc. Which one is it? This is SO confusing. @cyriljewels

      Of course you can upload your music on platforms, you just can't register the beat if it's a non-exclusive lease

    This might a stupid comment but when you get like a royalty free samples is it completely free like for example the artist dont have to get the sample cleared or what? 😅

      So for royalty free samples it’s a catch you have to read the terms and agreements from where you made the purchase…but as a Artist you should be good because the producer handles that.

    if someone bought for example the mp3 (non exclusive) already, does the option to buy the exclusive rights vanish? Because you are not able anymore to get it exlusive for you because someone already bought it.
    Another question would be: If someone buys the exclusive rights, does the beat automatically get off of your page so no one can buy it anymore or do you have to take it down by yourself?

      Great questions and yes if you bought a basic non exclusive lease then your rights for that lease are still in place until the allotted date on the contract. If someone else bought that exclusive you no longer have the option to buy the exclusive unless you and the producer reach out to the person who bought it and make a deal 🫱🏽‍🫲🏻. When the exclusive is sold you have to take the beat down yourself you can still leave it for listeners if the person who bought the exclusive allows it other than that it has to come on down off the beatstore for no further leases or purchase.

    What happens if the song surpasses the caps/limits agreed?
    For example 100k stream limit and it hits 1,000,000
    And also how can you make that the person who buys gives you splits when uploading to streaming services?

      For the most part it’s all in the leasing agreement when you buy either a non-exclusive or exclusive beat, if it surpasses just communicate with the producer and work something out to where you get the exclusive beat and workout what works for you

      Just don’t see what’s stopping an artist treating my beat with a cheap $50 license as an unlimited, it doesn’t seem like beatstars actually limit the streams (as agreed)
      And the same story if they don’t set up splits with the distributor… is this when you need to call the lawyer ?🤣
      Or can the P.R.O help with these steps

    this might be a stupid question but: any type of license that a producer sells, and then the artist goes and gets streams on spotify etc, the producer always gets a share of those streams/plays after selling upfront (that 29.95), exclusive or not? e.g. like when it shows that 'number of audio streams' and has 250,000, will those 250,000 streams go straight to the artist and then the rest is split or is it completely something else and i look dumb right now lmao

    The part where the contract says, the new song should not be be associated with distributors like CD baby and more to avoid copyright as the beat might be used by others
    What about distrokid, I use distrokid and I wanna post an ep with leased beats??

      Distrokid is good, most producers use distrokid and you would be able to add the producer as collaborators

      That includes Distrokid too right?

      Of course you can distribute your song using those services like CDBaby, Distro or TuneCore, the only thing they are asking you is not to use content ID services that can flag other songs from people who have purchased the same beat, it is only allowed to be used in exclusive purchases , since there is no one else with the right to distribute songs with the beat in those cases.

    I am sorry but this is completely nonsense.... you said that the rapper would have to get the clearance to use the sample ?? LMAOO.... you do not seem to understand how copyright works... you CANNOT make money of a sample that you do not own or have the license to .. so you are basically contradicting yourself in this contract by saying " I warrant I own the rights to the beat" but then say " but the sample issue you have to get clearance for"... makes no sense at all and this agreement would be deemed invalid in court of law. You as the producer could even get sued for making money using a sample that you do not have the "clearane" for... I keep seeing producers use these templates from sites like beat starts that are so poorly done, any lawyer could tell you that this agreement would immediately deemed invalid because it is contradicting itself as mentioned above... Its crazy how much misinformation is out there in regards to this
    Edit: sorry if I sound rude I am not trying to attack you personally! I am just mad at how stupidly complicated and shady the whole producer rapper scene is right now in terms of leasing beats

If you need any help I am happy to help I have quite some experience with contracts due to my profession and had specialised music lawyers look over some of those contracts that are typically used in beatstarts etc.. as I said there are so many issues with those
