    Bosing pag nalaman na wala kang permit po ay pinagpeperahan ng mga opisyal, pag mag legalise ka naman kailangan mo magbigay kasi pag hindi, kasohan ka ng mabigat kaya tahimik ka na lang.

    Dapat itinuturo ang mga ganitong topics sa school... I mean at least some topics at secondary level. Naka embed na kasi sa mga Pilipino ang makalumang sistema akala lahat madadaan sa palusot. This generation and the next must all be compliant already. Dyan nag uugat ang palakasan system (another form of corruption) lalo sa Munisipyo.

    Good day fellow architects and sir.
    I want to incorporate some additional information in this video that may help our client in this kind of situation thereof. First, the client needs to investigate the validity of the title of the lot by visiting the Register of Deeds, Land Management Bureau, and other interagency related to. What if the lot is not registered or belongs to a certain claimant but you as a client build already a structure on a certain lot? By doing so, read every detail written on the title from lot owner, claimants, heirs, technical descriptions of the lot, and certain conditions provided herein. For lot having heirs and claimants, the client must submit at least a Special Power of Attorney (SPA) to the OBO with written conditions or agreement of the party (client, lot owner, heirs, or claimant) involve on the project to avoid complaints from the party involved, which in the worse scenario leads to filing a case against the involved.
    For such written conditions on the title such as Memorandum of Encumbrance, look if your lot is subject to expropriation. In this type of condition such as a lot located on the road, a portion of your lot may expropriate by the government subject for road expansion and other public utility for the benefits of the general welfare. One of the requirements of your building permit is to secure Road-Right-of-Way Clearance from DPWH if your lot is located on National Road and City or Municipal Engineering office is located on the local road. If the constructed building overlap on that portion of the expropriated lot, the building owner must remove that overlapping portion of the building. One way to determine whether that constructed building is overlapping or mislocated is by a 'Joint Relocation Survey' conducted by a hired license and registered geodetic engineer. What if that portion of that overlapping structure is part of the foundation? I think that's a major problem for both the architect and the client involved. In my experience, I advise my client to hire a geodetic engineer to conduct a joint relocation survey for the matters on the existing condition of the lot if matches on that on the title and as well if there is an overlapping structure within the lot. This includes also the condition of the lot lay down in the encumbrance such as expropriation. That joint relocation survey together with a topographic survey is the one I use for planning layout purposes and not the typical survey plan to avoid problems in the future.
    With these little tips I shared with our clients and fellow architects, we can determine already the condition of the constructed building base on the title of the lot and the existing condition of the surrounding. If that certain degree of problem arises on the constructed building such as mislocation and overlapping issue, there is a high possibility that your application for building permits will be revoked by the OBO and the worst-case scenario your building will be recommended to demolished. As for my fellow architects, these tips can guide you to determine if an existing building is worthy and appropriate for signatory for building permit purposes. We architect as a consultant to our client who has the same problem in this video, do not ignore immediately. Try to give them guidance such as in the example for applicability of signatory purposes. If you are a consultant architect, try to recommend your client to hire a structural or civil engineer that has sufficient knowledge and experience in this kind of situation and as well with equipment for the material and structural testing for an existing building. If you have a trusted one, try to recommend them as well. If there are defects in the stability of the structure, the civil or structural engineer might recommend providing bracing support to the structure of the existing building or retrofitting. This is the reason why the OBO is requiring the structural engineer involved in the project to submit structural analysis and certification of the said building certifying that it is safe for habitational purposes. These are few things that I can share with you.

      Very good inputs sir. There are more instruments now a days that can check the mix of concrete that they are using. There is also ferro scanner that can check the number and sizes of main bars ang ties that they are using including the concrete covering of rebars. There is also coring machine that can extract core sample to check the actual strength of concrete in place. But most of the houses that build with out the building permits are not complying with the specification requirements that's why it is very difficult for the engineers to attest easily the integrity of the structure in that case.

    Very nice information Maestro, very similar to my scenario. Nagmana po ako ng bahay at lupa from my mother, pinatayo nya po ito ng walang plano at building permit. Foreman lang po. Nasa pangalan ko narin po ang title ng lupa, patay narin po si mother, and gusto ko sya maging legal. Well, compared sa magpatayo/bumili ng bahay, kalingkingan parin naman pong maituturing ang gastos at sakit ng ulo sa pagpapa-legalize kaya ako'y very thankful parin sa aking inang namayapa.     Sir nice content! been following for a while now. ask ko lang po. required po ba kumuha ng permit if magpapatayo ang isang individual sa sariling lupain nya? for example may hacienda sya (bukid set up) na may existing structures na within the site, tapos magpapatayo sya ng isang guest house na bungalow. magfafile padin po ba dun ng permit before construction?

    Hi sir ask ko lang yung ground floor ay may bldng permit at concrete material na meron ng abang for secon floor yun na rin ang sa amelyar , then after 15yrs ginawa na ang 2nd floor without bldg permit.. once na mabigyan ng violation at magbayad na rin ano po need po ba na mag apply ng bldg permit? Paano po kung 7 years ago na po nagawa may mga required ba na mga renovations pa or better to demolished na lang ang second floor then mag pagawa na lang uli..

    Ung bldg permit good for 1 yr lng. Kya kung wala kng pera at hindi mo kaya matapos ang bahay mo for one yr wag k nlng magpagawa kc mgbbyad k ulit s pagpirma at permit. Ganyan ngyari s amin eh. Pero s totoo lng ni hindi nmn tlga cla nag iinspect.

      If the contractor is a legit license contractor, meaning that he is knowledgeable that no person can construct without the necessary permit, so the contractor can can also be liable.

    What about these charity vloggers who build houses for the poor, are they required to get building permits if the house is under 25sqm and one-story? Are they allowed to build on government land or private individual's land if they get permission?

      25sqm and below are excempted since those are expected to be a kubo, trellis, roofed patio or ancillary structures na tinatawag. Plus, even if it's for charity, need pa din ng permit to operate from the city/municipal hall. Of course, it depend on their local ordinances so better check na lang to make sure.

    You are right sir, this is too much risk to sign for a building that is already built like in this case. Pero kung gusto nyang ma-legalize yan then a series of test needs to be done by engineering specialist on the appropriateness of the building works. Kaso lang it will cost the owner more money. As it is though, bibilib ako sa lakas ng loob ng pipirma dyan.

    Hi Sir, good day, ask ko lang sir, kung ang residential building na walang permit at naka tayo, pero wala pa namang stop work order fro OBO, pwede po ba itong ipa fully furnish or e stop muna? May karagdagan bang penalty na fully furnish na ang building?

    may tanong po ako. nagpagawa ako ng fence at may fencing permit po ako, pero dahil sobrang sipag, yung contractor ko pinakialaman yung likod ng bahay ko at naghukay na sila at naglagay ng bakal kasi alam niyng magpapa extension ako soon pero wala akong knowledge kasi galing ako ng bakasyon. so when i found out na hinukay nila ang likod, pinastop ko agad at pinagalitan ko kasi bakit nila sinali eh wala pa akong bldg permit. ngayon nagprocess na ako ng mga papeles at ng mainspect na ang area ko may violation na ako dahil dun. anu pong gagawin ko? magkano po kaya ang penalty ko? at makakakuha pa ba ako ng bldg permit para matuloy ang construction?

    Bukod pa sa penalties and fines na nabanggit dito, pwede rin maningil ang City Assessor for back taxes. Pwedeng iassess ang undeclared structure at imultiply upto 10 years ang penalties. Matakaw ang assessor. Bukod pa ito sa Engineer's office.

    Hello Sir! Thank you for this vlog! May mga client naman sir na nagpapadesign lang tapos sasabihin na sila na kukuha ng building permit pero hindi naman pala. May liability ba ang architect or engineer na nagsigned and sealed, kung makita ng bldg official na walang building permit ang isang ongoing construction? Uso po iyan sa mga probinsiya e.

      If the processing of the Building Permit is not part of your services your not liable, but if it is part of your services under your contract of service, and you didnt act on this timely, then your liable.

    Sa pagkaka alam ko naman Arch., bago mag sign and sealed ang isang Architect sa drawings ay dinodoble check niya yung mga specs na nandun kung pasado ba sa planning, structural, electrical or mechanical at nag coconfirm din sa building code requirements. Tama po ba o mali?

    well exlplained IRR senyor Maestro :) Cheers! pero real talk lang, yan ang inaabangan ng mga engineer in charge. kasi talagang patong patong ang kaso nyan . i consider it DEAD END for the owner . walang pipirma nyan, that's a big structure, walang soil test, walang structural computation susme . Yung PF na iniwasan nya, mapupunta sa lagay..este sa mabuting mga kamay este....sa mga penalties tapos di pa sya sure kung anong klaseng quality meron ang building nya, not to mention walang mananagot kung sakaling bumagsak or masira yan. Lahat ng natipid nyang professional fee idodonate lang sa OBO. true story :( sana magsilbing aral ang pangyayaring ito.

    Ka-Maestro Napaka linaw na iyong explanation, Lalo na ang hirap ng Prosesso ngayon po siguro ng Building Permit.
    Napagtanto ko po na meron pang kasunod yan, yung Occupancy Permit? matinding requirements po ba ito, dito po ba papasok ang requirements na fire extinguisher? may certain sukat po ba para ma allow ang fire alarm system.
    Sana supportahan narin siya, habana kayo ay nag susulat ng katanungan wag nyo skip yung advertisement, maganda naman panuorin hehe. kaait 15 minutes pa yung advertisement si kris bernal nag exercise hehe. habana nag babasa nung batas na Sinabi ki ka- maestro

    Paano po ung Apartment building xa pero pinalagay na residential di commercial? tas wala lahat na permit pati fire or something po? almost 10 yrs na nag ooperate under residential pero wala xang permit to operate .

    Very Informative po eto. ngpatayo kami ng bahay 2 storey pero standard po lahat ng gamit namin ng bakal 16mm gamit namin column at sa footers beam 12mm and 10mm. Cement mix 123 1 1cement 2 corsand 3 Yy. Ako po ng plan din im an ordinary person.🍻

    QUESTION: Sir Arki, how about sa mga place ng barrios (barangay) na nag re-range ng 1-2 storeys
    Need pa din ba ng mga permits beside sa sabi niyo pong 2m pataas na structures
    Kasi pansin ko po, wala naman mga permits mga existing old houses/structures sa mga barrios

      tulad ng ina ko na tigas ang ulo. 3 storey ang gutos nya na may sun roof pa, mga kapitbahay namin nagrereklamo, binabalewala cla at warning ko, supervisor kasi; laki ng ulo, cya lang dapat masunod. Binisitahan cya ng taga city hall na may escort na nka fatigue at dun pa cya nakinig. Namutla cya at nagtago, lumabas na cya ng umalis ang escorts nka fatigue. Biglang lumaki ang ulo, biglang nabuhay, nangangatwiran ng kahit ano, pero biglang naging tuta pagbalik ng mga nka fatigue... nagpark lang pala cla sa unahan dahil nka harang ang police truck sa daan. Ayun. Halt lahat ng operation. 4 months bago na resume...took another 6 months at tangal ang 3rd flr para ma tapos. Di na cya gaano lumalabas ng bahay, paranoid na rin cya sa mga kapitbahay namin...

    Hello po sir, makakakuha po ba ng building permit kung ang mother title po ng lupa ay may pending case? May pending case po kasi meron po nag squat ng 100sqm sa 1000sqm na lupa.. Hindi nmn po part ng squat yung lupa namin.
