Nasa pangalan ko narin po ang title ng lupa, patay narin po si mother, and gusto ko sya maging legal. Bosing pag nalaman na wala kang permit po ay pinagpeperahan ng mga opisyal, pag mag legalise ka naman kailangan mo magbigay kasi pag hindi, kasohan ka ng mabigat kaya tahimik ka na lang.

Thank you sa info. Dun sa walang pipirma dahil walang magpapahamak sa profession niya, dun papasok ang pera, corruption. Yung binabayaran na pirma ng engineer, inspector atbp (P10k noon). Dapat rinesolve na yan 20, 30 years ago kadi stale mate. Never malegalize kasi no one will put his neck for something he's not sure. Dami na bang kumita? Structures built with common sense still stand today.

Good day fellow architects and sir. I want to incorporate some additional information in this video that may help our client in this kind of situation thereof. First, the client needs to investigate the validity of the title of the lot by visiting the Register of Deeds, Land Management Bureau, and other interagency related to. What if the lot is not registered or belongs to a certain claimant but you as a client build already a structure on a certain lot? By doing so, read every detail written on the title from lot owner, claimants, heirs, technical descriptions of the lot, and certain conditions provided herein. For lot having heirs and claimants, the client must submit at least a Special Power of Attorney (SPA) to the OBO with written conditions or agreement of the party (client, lot owner, heirs, or claimant) involve on the project to avoid complaints from the party involved, which in the worse scenario leads to filing a case against the involved. For such written conditions on the title such as Memorandum of Encumbrance, look if your lot is subject to expropriation. In this type of condition such as a lot located on the road, a portion of your lot may expropriate by the government subject for road expansion and other public utility for the benefits of the general welfare. One of the requirements of your building permit is to secure Road-Right-of-Way Clearance from DPWH if your lot is located on National Road and City or Municipal Engineering office is located on the local road. If the constructed building overlap on that portion of the expropriated lot, the building owner must remove that overlapping portion of the building. One way to determine whether that constructed building is overlapping or mislocated is by a 'Joint Relocation Survey' conducted by a hired license and registered geodetic engineer. What if that portion of that overlapping structure is part of the foundation? I think that's a major problem for both the architect and the client involved. In my experience, I advise my client to hire a geodetic engineer to conduct a joint relocation survey for the matters on the existing condition of the lot if matches on that on the title and as well if there is an overlapping structure within the lot. This includes also the condition of the lot lay down in the encumbrance such as expropriation. That joint relocation survey together with a topographic survey is the one I use for planning layout purposes and not the typical survey plan to avoid problems in the future. With these little tips I shared with our clients and fellow architects, we can determine already the condition of the constructed building base on the title of the lot and the existing condition of the surrounding. If that certain degree of problem arises on the constructed building such as mislocation and overlapping issue, there is a high possibility that your application for building permits will be revoked by the OBO and the worst-case scenario your building will be recommended to demolished. As for my fellow architects, these tips can guide you to determine if an existing building is worthy and appropriate for signatory for building permit purposes. We architect as a consultant to our client who has the same problem in this video, do not ignore immediately. Try to give them guidance such as in the example for applicability of signatory purposes. If you are a consultant architect, try to recommend your client to hire a structural or civil engineer that has sufficient knowledge and experience in this kind of situation and as well with equipment for the material and structural testing for an existing building. If you have a trusted one, try to recommend them as well. If there are defects in the stability of the structure, the civil or structural engineer might recommend providing bracing support to the structure of the existing building or retrofitting. This is the reason why the OBO is requiring the structural engineer involved in the project to submit structural analysis and certification of the said building certifying that it is safe for habitational purposes. These are few things that I can share with you. Thank you! =)
Very good inputs sir. There are more instruments now a days that can check the mix of concrete that they are using. There is also ferro scanner that can check the number and sizes of main bars ang ties that they are using including the concrete covering of rebars. There is also coring machine that can extract core sample to check the actual strength of concrete in place. But most of the houses that build with out the building permits are not complying with the specification requirements that's why it is very difficult for the engineers to attest easily the integrity of the structure in that case.

What about these charity vloggers who build houses for the poor, are they required to get building permits if the house is under 25sqm and one-story? Are they allowed to build on government land or private individual's land if they get permission?
25sqm and below are excempted since those are expected to be a kubo, trellis, roofed patio or ancillary structures na tinatawag. Plus, even if it's for charity, need pa din ng permit to operate from the city/municipal hall. Of course, it depend on their local ordinances so better check na lang to make sure.

Just receive consultation last 2 weeks froma resident also in Antipolo who disregarded the notice of violation issued twice by the OBO, in that, the OBO filed a complaint with the prosecutor and probable to file a case was determined and the prosecutor now release a resolution for the filing of case in violation of Sec. 302 of PD 1096. baka di pa na tsambahan.
Mahuhuli yan pag nag-file ng occupancy permit o kaya sa tax declaration ng building. Kung wala silang ganun, illegal settlers sila at kung sakali nagpatupad ng Eminent Domain ang gobyerno, pwedeng kunin ang property nila ng hindi sila kailangan bayaran.

Yung PF na iniwasan nya, mapupunta sa lagay..este sa mabuting mga kamay este....sa mga penalties tapos di pa sya sure kung anong klaseng quality meron ang building nya, not to mention walang mananagot kung sakaling bumagsak or masira yan. You are right sir, this is too much risk to sign for a building that is already built like in this case. Pero kung gusto nyang ma-legalize yan then a series of test needs to be done by engineering specialist on the appropriateness of the building works. Kaso lang it will cost the owner more money. As it is though, bibilib ako sa lakas ng loob ng pipirma dyan.
under ethical standard of professionals wala talaga pipirma at magseal dyan or magtake ng risks at liability... sa mga draftsman pwede pa siguro...legalizing is a big question and subject to abuse such as corruption of a certain office.

If the processing of the Building Permit is not part of your services your not liable, but if it is part of your services under your contract of service, and you didnt act on this timely, then your liable.

Thank you sa info. Dun sa walang pipirma dahil walang magpapahamak sa profession niya, dun papasok ang pera, corruption. Yung binabayaran na pirma ng engineer, inspector atbp (P10k noon). Dapat rinesolve na yan 20, 30 years ago kadi stale mate. Never malegalize kasi no one will put his neck for something he's not sure. Dami na bang kumita? Structures built with common sense still stand today.

Good day fellow architects and sir.
I want to incorporate some additional information in this video that may help our client in this kind of situation thereof. First, the client needs to investigate the validity of the title of the lot by visiting the Register of Deeds, Land Management Bureau, and other interagency related to. What if the lot is not registered or belongs to a certain claimant but you as a client build already a structure on a certain lot? By doing so, read every detail written on the title from lot owner, claimants, heirs, technical descriptions of the lot, and certain conditions provided herein. For lot having heirs and claimants, the client must submit at least a Special Power of Attorney (SPA) to the OBO with written conditions or agreement of the party (client, lot owner, heirs, or claimant) involve on the project to avoid complaints from the party involved, which in the worse scenario leads to filing a case against the involved.
For such written conditions on the title such as Memorandum of Encumbrance, look if your lot is subject to expropriation. In this type of condition such as a lot located on the road, a portion of your lot may expropriate by the government subject for road expansion and other public utility for the benefits of the general welfare. One of the requirements of your building permit is to secure Road-Right-of-Way Clearance from DPWH if your lot is located on National Road and City or Municipal Engineering office is located on the local road. If the constructed building overlap on that portion of the expropriated lot, the building owner must remove that overlapping portion of the building. One way to determine whether that constructed building is overlapping or mislocated is by a 'Joint Relocation Survey' conducted by a hired license and registered geodetic engineer. What if that portion of that overlapping structure is part of the foundation? I think that's a major problem for both the architect and the client involved. In my experience, I advise my client to hire a geodetic engineer to conduct a joint relocation survey for the matters on the existing condition of the lot if matches on that on the title and as well if there is an overlapping structure within the lot. This includes also the condition of the lot lay down in the encumbrance such as expropriation. That joint relocation survey together with a topographic survey is the one I use for planning layout purposes and not the typical survey plan to avoid problems in the future.
With these little tips I shared with our clients and fellow architects, we can determine already the condition of the constructed building base on the title of the lot and the existing condition of the surrounding. If that certain degree of problem arises on the constructed building such as mislocation and overlapping issue, there is a high possibility that your application for building permits will be revoked by the OBO and the worst-case scenario your building will be recommended to demolished. As for my fellow architects, these tips can guide you to determine if an existing building is worthy and appropriate for signatory for building permit purposes. We architect as a consultant to our client who has the same problem in this video, do not ignore immediately. Try to give them guidance such as in the example for applicability of signatory purposes. If you are a consultant architect, try to recommend your client to hire a structural or civil engineer that has sufficient knowledge and experience in this kind of situation and as well with equipment for the material and structural testing for an existing building. If you have a trusted one, try to recommend them as well. If there are defects in the stability of the structure, the civil or structural engineer might recommend providing bracing support to the structure of the existing building or retrofitting. This is the reason why the OBO is requiring the structural engineer involved in the project to submit structural analysis and certification of the said building certifying that it is safe for habitational purposes. These are few things that I can share with you.

Very good inputs sir. There are more instruments now a days that can check the mix of concrete that they are using. There is also ferro scanner that can check the number and sizes of main bars ang ties that they are using including the concrete covering of rebars. There is also coring machine that can extract core sample to check the actual strength of concrete in place. But most of the houses that build with out the building permits are not complying with the specification requirements that's why it is very difficult for the engineers to attest easily the integrity of the structure in that case.

What about these charity vloggers who build houses for the poor, are they required to get building permits if the house is under 25sqm and one-story? Are they allowed to build on government land or private individual's land if they get permission?
25sqm and below are excempted since those are expected to be a kubo, trellis, roofed patio or ancillary structures na tinatawag. Plus, even if it's for charity, need pa din ng permit to operate from the city/municipal hall. Of course, it depend on their local ordinances so better check na lang to make sure.

Just receive consultation last 2 weeks froma resident also in Antipolo who disregarded the notice of violation issued twice by the OBO, in that, the OBO filed a complaint with the prosecutor and probable to file a case was determined and the prosecutor now release a resolution for the filing of case in violation of Sec. 302 of PD 1096. baka di pa na tsambahan.

Yung PF na iniwasan nya, mapupunta sa lagay..este sa mabuting mga kamay este....sa mga penalties tapos di pa sya sure kung anong klaseng quality meron ang building nya, not to mention walang mananagot kung sakaling bumagsak or masira yan. Lahat ng natipid nyang professional fee idodonate lang sa OBO. true story :( sana magsilbing aral ang pangyayaring ito.

You are right sir, this is too much risk to sign for a building that is already built like in this case. Pero kung gusto nyang ma-legalize yan then a series of test needs to be done by engineering specialist on the appropriateness of the building works. Kaso lang it will cost the owner more money. As it is though, bibilib ako sa lakas ng loob ng pipirma dyan.

May liability ba ang architect or engineer na nagsigned and sealed, kung makita ng bldg official na walang building permit ang isang ongoing construction? Uso po iyan sa mga probinsiya e.
If the processing of the Building Permit is not part of your services your not liable, but if it is part of your services under your contract of service, and you didnt act on this timely, then your liable.
