Ep. 17 | Why Churches are Tax-Exempt

  • Опубліковано 17 жов 2019
  • Last week, Democratic presidential candidate Beto O'Rourke argued during a televised town hall event that churches and other religious institutions should be stripped of their tax-exempt status if they fail to accept and affirm same-sex marriage. Honestly, I was reluctant even to address the issue in light of his comments because they were almost entirely irrelevant. Not only did I strongly disagree with former Congressman O'Rourke's remarks, but so did the frontrunners in the Democratic primary as well as the Constitution of the United States. But even though the tax-exempt status of religious organizations is not presently under threat, I think we do need to know why tax-exemption exists and why it matters.

The local mega church where I live just spent over $1,000,000 on new "branding". Signs, paint scheme etc. That is atrocious. Churches should be taxed to support the communities where they hold real estate. If churches don't pay taxes in order to maintain their freedom, why do I have to?

Exactly. It’s a joke. We could fix the national debt by having these freeloaders pay their fair share. I am utterly so sick of this- I work my ass off helping people in my profession and give 1/3 of my income to the government while they get a free ride because they are promoting God? What ? Why am I responsible for subsidizing the promotion of their religious beliefs?

Life ain't fair hommie, politicians are criminals that tax you. Thats theft through intimidation of legal consequences. That is defined as extortion. Anyway, life isn't fair, that being said, learn to play their game. Learn to make a LLC and start deducting or exempting anything you can. Life isn't fair and the world is mean. You know why I'm here, brcause like you, I'm sick of it all too. So , I'm leveling up and learning legal loopholes and other things I can easily do, to play their game and win. Hell, I'll start a church if it'll save me money. Anyway, best wishes, none of this was said to sound rude either, so , please take no offense as my tons is to be understood as pleasant.

Couple of things on this as I think it is a common question and I am no expert here. But by law in many states to be a church they have to have "gregarious association", so you need a congregation. Second, zoning laws become an issue as it is not uncommon for people to try and convert single family homes into churches but many residential zoning laws require a special permit or conditional use permit for religious assembly.

I don't care about whatever reasons someone can make up as to why churches shouldn't be taxed. They are businesses which make money, some a lot of money, and I've seen where some of these heads of churches live. I saw a Baptist minister's house in Texas years ago. I guess that person has every right to make money and be as rich as possible. But I also believe they can still be very well off and pay their fair share just like the rest of us. If they are doing good deeds, God will reward them. If people want to give them even more money, let it be out of their pockets.

Sorry, it doesn’t sound like a good argument to me.

Being taxed exempt has its perks but why mention that? But you carefully say that being tax exempt is not a benefit from the Government but in reality religious institutions do benefit from being tax exempted which in essence is a benefit from the Government. Religious institutions all over America benefit from taking in billions of dollars without paying one red cent in taxes. If America made drug dealing legal and forced drug dealers to pay taxes then why not religious institutions?

We should not be exempted from Taxes, it it would probably be even good to pay full taxes and discourage the wolves disguised as sheep from infecting churches who walk after the evil and greed in their hearts. As our Lord Said in Mark 12:
13Later they sent some of the Pharisees and Herodians to Jesus to catch him in his words. 14They came to him and said, “Teacher, we know that you are a man of integrity. You aren’t swayed by others, because you pay no attention to who they are; but you teach the way of God in accordance with the truth. Is it right to pay the imperial tax b to Caesar or not? 15Should we pay or shouldn’t we?”
But Jesus knew their hypocrisy. “Why are you trying to trap me?” he asked. “Bring me a denarius and let me look at it.” 16They brought the coin, and he asked them, “Whose image is this? And whose inscription?”
      “Caesar’s,” they replied.
17Then Jesus said to them, “Give back to Caesar what is Caesar’s and to God what is God’s.”
And they were amazed at him.

most of the money the churches get is not for relief of the suffering, it is to maintain their status. If I and my business is to be taxed, then all business should be. Whatever church money really used to relief the poor, that could be tax-free, but that is a small portion of their revenue. Only about 10% of the money the church receives goes to charity, the rest is for self-preservation.

All churches and so-called religious organizations should depend on taxing or getting support from their own followers. The tax exemption penalizes the non-believer. Religions own millions of acres of prime real estate and people claiming to love Jesus make hundreds of millions of dollars. We need to end this ridiculous tax exemption or at the very least update this exemption. When these organizations 'help' people it is with the intent of converting them to one religion or another.

First of all, churches help people regardless if they'll convert. 2nd that's not their primary intention in most cases. 3rd who cares what their intentions are if they succeed in helping people. @@wakkablockablaw6025 I agree. The state and the church should work on different paths and do not interfere with each other; but still head towards the same destination: the betterment of people and life in general. Although it is very unfortunate to see how some religions would proudly favor a certain politician over another, I believe that we should really work this out and make sure that both ends meet.
In choosing a religion, we all have the freedom to believe whoever we may choose to believe; and do so the practices that may follow upon joining that institution or organization. However, there will always be a limit as to how much freedom we get with our actions and practices that may concern and threaten the public safety, security, and order.
To go back, I really believe that churches and religion partakes an enormous hand in the betterment of the society. Our church, to give an example, have house projects almost every month to help provide shelter to those who need them, regardless of religion. And if I may add, the family whom our church mentioned, did not encounter any talk or encouragement from the church, for them to convert into our religion. Our church teaches us to love our neighbors, which is why we help.
I just feel grateful that apart from the government, there are more outlets like churches that can help our community. And to me, by the end of the day, it is what matters the most.

If churches don't pay taxes, that'd be fine. As long as they didn't expect the firetruck to pull up when their steeple catches fire, if they didn't want the police to respond when they get robbed or a judge to advocate to in the following preceedings, if they weren't capitalizing on the public roads and sidewalks to get there and back, and they didn't want to tap into the welfare system they refuse to pay into. That'd be fine. But they want to get their cake and eat it too. They want to take it without giving into it. Is THAT what your god wants? Cause it sounds like the opposite to me.
The problem isn't that they're tax-exempt. The problem is that they AREN'T being exempt from taxes, only it's costs. It's simply and obviously unfair.

(Amos 3:3) Tax exemptions are a benefit to the recipients and to qualify for them, the recipients must adhere to the dictates of the government that bestows the exemption.
Those qualifying dictates can be unilaterally changed anytime without approval from the recipients. Don't accept the changes, then there goes your tax exemption.
The tax revenue these organizations escape paying are paid by the rest of society. There is no free lunch.
    However...
If one reads the first amendment as intended, then no government intervention, law or statutes should be created which affects
the "establishment of religion or prohibiting the free exercise thereof". Wouldn't this include taxation?
From this it appears that any religious institution should already enjoy tax exemption without the oversight and dictates of a 501c3.
The fact that religious entities participate in tax exemption status is an implicit admission that they think the government has the right to tax them.

I’m an atheist, I adamantly disagree with religion, but this is a great point. It would potentially give the government power to financially destroy one church vs another, or silence a church etc. I haven’t thought too deeply on this topic yet so I can’t say that this is the right answer, but it’s a great argument in favor of keeping churches tax exempt

it's a terrible point. There are lots of other checks and balances you can create to avoid having the government destroy a given religion.
Does the state go around destroying private companies it collects tax from ? Of course not, because those companies are legally protected despite being taxed.

Let's be clear, if there's a clear separation between church and state in the law, religions have to obey the law.
I understand that many religions in America like to own a lot of property and wealth... and if they had to pay taxes over all of that... that would upset... God or the ministers?
Russell Moore said that: ´´a state that has the capability to tax religions, is a state that has the capability to destroy``.
He even quoted a biblical text that doesn't have anything to do with this... however, the bible does say: ´´to Caesar the things which are Caesar's; and unto God the things that are God's.`` Matthew 22:21
´´Let every person be subject to the governing authorities.`` Romans 13:1
What does Russell Moore is afraid of?
´´For if their purpose or activity is of human origin, it will fail. But if it is from God, you will not be able to stop these men;``
Once again, let us be objective here, religion is considered to be a part of culture, just like Disney.
If Florida has the power to change the status of Disney, any state has the power to change the status of religion as well.

Bruno Sirigad Since when does faith in God require physical buildings? I think churches are generally playing a con game to offer salvation in exchange for money. Maybe it's all with good intentions but why should that matter? It's all great if people are made to feel better by going to church, but it's still a business and should be taxed just like any other business. As far as the separation of church and state, that should continue, just like no other business should be influencing or interfering with our government.

Apart from that, for a church or organization to be exempted from paying taxes, they should be non-profit and non-stock... therefore, no part of its net income or asset should benefit any member, organizer, officer or any specific person.
I also feel sad regarding religions who shamelessly favor and endorse a political figure. And I believe that this specific issue should be addressed inside the church; the same way that the state shall keep their line firm and not cross the boundary betwen them and the church.

Russell Moore: The Pete Buttigieg of American Evangelical "Christianity" for his endorsed appearance of Institutionalized Religion's tribute to Ceasar which he renders the things of GOD to that "Peculiar Institution" of the American Christian Establishment's faux allegiance which publicly boasts (The Pharisee and the Tax): "Then Jesus told this story to some who had great confidence in their own righteousness and scorned everyone else: “Two men went to the Temple to pray. One was a Pharisee, and the other was a despised tax collector. The Pharisee stood by himself and prayed this prayer: ‘I thank you, God, that I am not like other people-cheaters, sinners, adulterers. I’m certainly not like that tax collector! I fast twice a week, and I give you a tenth of my income.’ Woe is I, saith the "Christian" clergy when the Master shall take a cat-o'-nine-tails and flog them fiercely for their agony of deceit. Listened carefully to see if the Russell ever plainly said the Government has no power to tax church... Nope. Regardless, the Gov. via the Johnson Amend in the IRS Tax law has power to remove tax exempt status of a church for certain political activity. and that provision has been used in the past. Let me conclude by saying, (and such is the case in all issues where good is called evil, and light is called darkness...) the Johnson Amend was enacted by democrat Lyndon Johnson; and Beto Rourke, a democrat. So, let me be plain: I'm not calling the democrats good; they are not good; they are evil, they are dark, they are bitter.
