    If i fill out form 1310 for my dad does the refund get issued to his name or to my name. He had no will no estate no assets. No probate filed. Nothing.

      The reason for Form 1310 is so that any refund is issued in your name, rather than your dad's.

      @TheTaxGeek thank u! I thought the irs would of made it way more difficult then that. That makes it so much easier for me that I don't have to file more paper work I thought they would issue in his name etc.

      @TheTaxGeek also can I file 1310 e file? I know a couple years ago you had to send in paper??
