My take - 100% open source and open weight models can train on any public data, closed source and for-profit models must have a mechanism to not train on content creators work if they wish to opt out or be paid.
This isn't even a leak of the most current model. The model that we will see will be trained on way more compute. This is an API to a beta version of the system. We can't draw any conclusions based on this. I also want to add that only recently have Open AI great increased their compute amount. There is now evidence that they are looking to increase their compute by around 4-5x with the new set of Nvidia GPU's. This will make a huge difference with a diffusion transformer model like SORA.
There is so much pent up demand for artwork production. The corporate lock on artwork production is what the tool COULD eventually unlock. There are many many people who have creative ideas but lack the technical knowledge to bring them forward. People that are threatened here depend on that lock to make a living. If the tool provides at least a mechanism to capture the ideas, then it's a huge win for everyone.

The common case of the first companies can simply take what they want, no policies to protect the artists whose materials are used - they won't even know if their work was used by OpenAI. Then everything gets regulated, and other companies are left unable to close the gap.

I'm confused as to how they've leaked anything. That code was still using the openai endpoint and if normal accounts can't just switch to using the turbo model then surely this is just running some pool of their api keys and they will eventually lose their access. I guess perhaps the just having a standard openai key lets you use the endpoint itself which is quite interesting.

as a photographer and videographer myself I think we have different ideas of what looks incredible. every one of those had telltale flaws. almost all of it would be unusable in my studio.
What did they expect? Step 1: ingest all media that artists created, step 2: ask artists to give feedback on your model for free, step 3: replace artists and make money from this model. Err… who could have guessed they would rebel when they're treated like pawns? And it's a pretty good manifesto, I agree. OpenAI has always taken access to other people's IP as their right, famously exemplified by Mira Murati's reaction when she was asked about their use of UA-cam videos. This is far from the only kind of content they vacuumed up, and between the numerous lawsuits and this new leak let's hope that OpenAI will eventually learn to respect other people's hard work and play nice with the creators they couldn't exist without.
It doesn't seem that anything has leaked. They just gave everbody access to a front end to generate stuff, a kind of unofficial frontend that used that Sora API. It's nothing more than if somebody made a a frontend for accessing ChatGPT using a stolen API key. It works until the key is revoked or in case of Sora the API gets disabled. That's all unfortunately.
Regarding artists should they get paid or not; No, they should not. If they have images in public they also let people train their brain on it. And get influenced by it. This is no different to what a model do. If artists want to keep their art private, keep it private. Problem solved. (Problem is that they don't want to keep it private because it will not give the art-hype they need to sell it expensive). Also, should we in the west have a harder time to train models, while in the east they do not have these limitations? See whats happening in Europe, they are so behind because of the laws that they will be so behind technologically to US and China that they will be seen as second rate countries very fast.

Sora has gone the way of DallE. It was great when first revealed, but slowly faded away as other models passed it by. I'd rate it 6 out of 10 right now.
Opt-out is a namesake to render any complaints ineffective in the court of law. If a violation gets flagged, it allows stakeholders an option to remedy without compensation. Video gaming environments already do this, except, for the intended purposes, it lacks needed assets, that brings the topic of artwashing.🤔. I don’t like ClosedAI but I don’t respect people leaking IP when given a unique position and opportunity to have a headstart against the inevitable, nobody forced you dto take part of it, just like beta testers sinces ages, the deal is you get access to cool toys before eveybody else in exchange for you time and knowledge. I completely understand the free use argument. Artists have painted their version of other artworks with significant original interpretation. Taylor Swift re-performed her own songs, to get around the copyright and contractual ownership by a label. It's not the work, but rather the performance or interpretation. AI does not recreate copyrighted work, it generates new work. Yes, it uses the knowledge it derives from existing works (e.g., depth and shading techniques). If an AI significantly recreates an existing work, then sure, that's an infringement. But the knowledge is free, for every field.
