    good advice as ever - thank you - i'm going through the 'employment tribunal decisions' & screenshotting the relevant points of law & then noting them - there's loads to remember!! - will start to read the ET regulations each night, will sleep like a baby!! 😴 - I agree, you need to know your stuff to counter dirty tricks from solicitors & possible bias within the court system too 😊

    Great advice, Would you host a live stream so some of your subscribers can share their experiences or to show what they are dealing with at the moment?. This would be great for supporting each other. I think anybody going through a tribunal process would love this opportunity to share the burden and help each other in understanding this amount of information. Wish i found your content sooner.

    Hi - I find your videos very informative, helpful and encouraging - long story short, I recently been unfairly dismissed and similarly to yourself, the decision to dismiss was pre-determined- I recently asked for DSAR which will confirm all of the above
    My question is in relation to pensions loss calculations as they are quite confusing, I was in a pension scheme where my employers contributed before tax but wondered if there was a good formula to work it my loss for about 24 months to include up to hearing and future loss?

    • @beentheredonethat9647
      @beentheredonethat9647  Рік тому

      Apologies your comment had been held for review by UA-cam. Just include the employer's contribution and if its not calculated right it can all be corrected at remedy

    I’ve seen a lot of videos about employment tribunal but never saw anything about company liquidation as a way to avoid any charges. Do you know anything about that?😩

    • @nickijames9
      @nickijames9 Рік тому +2

      As a general rule If a UK employer enters into voluntary liquidation during the employment tribunal process, the employment tribunal proceedings will usually be stayed or terminated, depending on the timing of the liquidation.
      If the company goes into liquidation before the hearing, the employment tribunal claim will usually be stayed, which means that it will be put on hold until the liquidation process is completed. If the company is unable to pay the compensation or damages awarded by the employment tribunal, the employee may be able to claim some or all of the amount owed from the government's National Insurance Fund.
      If the company goes into liquidation after the employment tribunal has made a judgment against it, the employee's claim will not be affected by the liquidation. The employee may still be able to recover compensation or damages either from the appointed liquidator from the company assets, or in the alternative, from the National Insurance Fund.
      It's worth noting that entering into voluntary liquidation to avoid employment tribunal claims is not an acceptable practice. If the insolvency practitioner appointed to handle the liquidation believes that this is the case, they may report the company to the government's Insolvency Service.
      I hope that this helps.

    With regards to strategizing my case, I've had a few PHs so far and now working towards FH and i don't know whether all the points, arguments, evidence used in the PHs should be used again towards the FH or new evidence only that i obtained from after the last hearing? 🤔. Can you advise please? Thank you

      Expect the FH to cover everything and don't leave anything out. I had 2 PH and then a totally different judge for the FH

    Hello dear, can I ask about tax liability? Like after 30k you have to pay tax. At the ET, can I claim tax liability, or does the law state we have to pay even under discrimination claim and constructive dismissal?X

      The panel will automatically work all that out (thankfully!) And increased the award to account for tax so effectively the other side pays it. I recommend using an accountant when you come to declare it as it's complicated what is considered "earnings" and what isn't
