No doubt GHAMIDI sb is a great scholar in the Islamic world. He has done a marvelous job.
But this interpretation of Zina as Haq Talfi requires more deliberation and re evaluation. Its interpretation as haq talfi doesn't appeal to the mind.
Here I put some proposition. For example, a male and a female are engaged to each other. They committ zina with mutual consent before the Nikah. Later on, they get married. Now the question arises, whose Haq Talfi has been committed. It's a very practical example, not based on some supposition.
The answer requires re evaluation of the issue.

مسئلہ اس لئے سمجھنا مشکل ہے کیونکہ شدی شدہ اور غیر شادی شدہ افراد دونوں کئے لئے لفظ زنا استعمال کیا جاتا ہے جبکہ قانونی طور یہ دو الگ الگ فعل ہیں۔ حدود اور اسکی سزا صرف شادی دہ افراد پر لاگو ہو گی کیونکہ اس میں حق تلفی نہ صرف بیوی یا شوہر کی ہوتی ہے بلکہ ناجائز بچہ ہونے کی صورت میں بچے کے لئے بھی معاملہ مزید سنگین ہو جاتا ہے ۔ اس لئے حدود کی سزا صرف اڈلٹری یعنی شادی شدہ مرد یا عورت کی زنا کے جرم میں مثلث ہونے پر ہی لاگو ہو گی۔ غیر شادی شدہ افراد کے لئے بھی گو کہ حرام ہے مگر گنا کے زمرے میں آئے گا جرم نہیں کہلائے گا نہ ہی حد نافذ ہو گی۔ حکومت صرف جرائم کی سزا دے سکتی ہے گنا ہ پر سزا کا فیصلہ خدا کا اختیار ہے ۔

First ghamidi said it's not clear in case of Zina if its Haram and halal by human reasoning thus Allah clearly mentions about zina and riba. With all due respect what you just use is just human reasoning. Allah can't say Zina is okay but sometimes its not. There is greater wisdom that we can't understand.
It's Haram cause it's addictive once it becomes a trend you can get engage and have a sort of livin relationship you think it's good for society? And it will not grow. You are looking into an individual case brother 😊

Science can prove marry your sisters for some generation can result in major at-birth issue with the children but one time with condoms who matter for science it won't effect life or nature
Zina n interest r related not only to haqooqul ibaad but haqooquLLah also. As Allah has warned not to go closer to that, thus u still went n later married each other.

Zinah Kay Gunah e kabeerah honay mein koee issue hee nahee hay. Yeh baat bari wazeh hay Keh Badkaari ko Deen main bra Gunah qaraar diya gaya hay.
Agar aik couple, nikah say pehlay voluntarily zinah kr laita hay aur baad main wohee couple apis mein nikah kr k shadi kr laita hay to iss mein Haq Talifi kis ki huee. Iss baat ko wazeh krnay ki zarurat hay.
Aam Tor per bachay bachyaan Jin ki apis mein mangni huee ho, to woh aisi ghalti kr baithtay Hain. Allah Taala muaaf farmaey.

In Pakistan, most marriages are enforced particularly from women view point cuz either they are not educated or are not financially independent. Also, in our society, girls are conditioned to accept anything thrown her way. The same girl who accepts a husband selected for her, if gets proper education and financial independence, would reject the same husband. Hence in Pakistan, 90% of marriages are zina as they are enforced making the whole thing unjust and unfair

۔جاوید احمد غامدی دورِ حاضر کے فتنوں میں ایک عظیم فتنہ ہے خصوصی طور پر ہمارا بنیادی دینی تعلیم سے محروم نوجوان ، دنیاوی تعلیم یافتہ ، اردو دان طبقہ کافی حد تک اس فتنہ کی لپیٹ میں آچکا ہے ۔فی زمانہ غامدی فکر ایک مکمل مذہب کی شکل اختیار کرچکی ہے
یہ دور حاضر کاایک ایسا تجدد پسند گروہ ہے۔ جس نے اپنے امریکی آقاؤں کی ھدایت پر دین اسلام کا امریکن ایڈیشن تیار کرنے کے لئے قرآن و حدیث کے الفاظ کے معانی اور دینی اصطلاحات کے مفاہیم تک بدلنے کی ناپاک جسارت کی ہے۔ یہ کہا جائے تو غلط نہ ہو گا کہ یہ بھیڑ کے روپ میں ایک بھیڑیا ہے یا جیسے رنگین خوشنما کیپسول میں زہر بھر کے بیچ رھا ھے
۔ ان میں سے ایک سلسلہ عبداﷲ چکڑالوی اور شیخ اسلم جیراج پوری سے ہوتا ہوا چوھدری غلام احمد پرویز بٹالوی (معروف منکرِ حدیث) تک پہنچتا ہے۔جن لوگوں نے اپنے عزائم اور فاسد نظریات کی ترویج میں احادیث کو رکاوٹ گردانا ، انہوں نے حجیت حدیث کا انکارکیا جبکہ قرآن پاک میں واضح ارشاد ہے کہ
وما اٰتٰکم الرسول فاخذوہ ومانہٰکم عنہ فانتھوا (اعشر آیت 59، ع 7)
ترجمہ: رسول جو کچھ تمہیں دیں، اس کو لے لو، اور جس چیز سے روکیں اس سے باز رہو۔
غامدی نہ صرف منکر ِحدیث ہے بلکہ اسلام کے متوازی ایک الگ مذہب کا علمبردار ہے ۔ یہ شخص اپنی چرب زبانی کے ذریعے اس فتنے کو خوب پھیلا رہا ہے اور اس مقصد کے لیئے امرہکی ایجنسی سی آئی اے کی مدد سے اُس کو پاکستانی الیکٹرانک میڈیا کی پوری توجہ و سرپرستی بھی حاصل ہے۔
غامدی کے منکر ِحدیث ہونے کے کئی وجوہات ہیں ۔ وہ اپنے من گھڑت اُصولِ حدیث رکھتا ہے ۔ حدیث و سنت کی اصطلاحات کی معنوی تحریف کرتا ہے اور ہزاروں اَحادیث ِصحیحہ کی حجیت کا انکار کرتا ہے آسان الفاظ میں یوں سمجھیں کہ وہ صحیح حدیثِ رسول ﷺ کو بھی دین اسلام میں دلیل تسلیم نہیں کرتا

Male and female physical relationship in Islam is exclusively for the formation of the family which is the building block for a Muslim society. This can't be done if there are relationships outside of marriage. Ustad did not say that the only reason is to prevent addiction. It is not the only reason. It is one of many reasons.

Another fact could be considered too - if zina is ok for people who never want to get into marriage, such behaviour would propagate and be immitated among society (including married couples). One's personal or subjective actions no longer remain personal, if there is a slight chance of it, impacting the society. To keep the society homogeneous, subjectivity has to be sacrificed, and some sort of objectvity has to be subscribed to ( although it is not relevant to one's personal or subjective circumstances, e.g. person who decides to never get married - therefore has no wife to impinge her rights - has to subscribe the law of never committing zina).
Primarily, he said Allah has made it illegal and so we cannot now oppose it. We can TRY to understand. So, the explanation he has given is his understanding. One may disagree with it but even fornication is haraam and punishable and that is crystal clear.
